PRESENT: Vice President Michael Garcia, Commissioner Frank Fung, Commissioner Katharine Albright, and Commissioner Robert Haaland.

 

Catharine Barnes, Deputy City Attorney, Office of the City Attorney (OCA); Ron Tom, Chief Building Inspector, Building Inspection Department (DBI); Tina Tam, Senior Planner, Planning Department (PD); Robert H. Feldman, Executive Secretary, and Victor Pacheco, Legal Assistant for the Board; and Easteller Bruihl, Official Court Reporter.

 

ABSENT: Randall Knox, President.

 

(1)    PUBLIC COMMENT: 

 

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

 

SPEAKERS: Walter Paulson described his mother’s experience many years ago which showed fairness of City’s enforcement of traffic code.

Appealing the denial on November 1, 2006, of Parking Variance (proposal is to allow 5      off-street parking spaces where 6 are required for a 6-unit residential building).

VARIANCE CASE NO. 2006.0878V.

PUBLIC HEARING HELD & CLOSED ON JANUARY 10, 2007.  FOR FURTHER CONSIDERATION TODAY.  Note: Matter continued to allow appellant time to research alternative options pursuant to the Board’s comments.

 

ACTION: Upon motion by Commissioner Fung, the Board voted 4 – 0 – 1(President Knox absent) to continue to 4/18/07, for engineering study to be completed.

PUBLIC COMMENT: Gerald Wolf spoke in favor of Appellants and He explained that he has decided to change his position and no longer opposes the project if the unit is removed.

Appealing a Health Permit Zoning Referral, dated November 28, 2006, addressed to Greg Griffin, which states that massage establishments are not allowed as a primary or accessory use in South of Market Zoning Districts, per Planning Code §§ 803.4 and 803.3(b)(1)(C)(ii).

PUBLIC HEARING HELD & CLOSED ON JANUARY 10, 2007.  FOR FURTHER CONSIDERATION TODAY.  Note: Matter continued to allow appellant time to research alternative options pursuant to the Board’s comments.

 

ACTION: Upon motion by Commissioner Haaland, the Board voted 4 – 0 -1 (President Knox absent) to continue to 3/07/07, Appellant did not appear for hearing and the Board will call or send a letter to remind the Appellant about the appeal.

ACTION: Upon motion by Vice President Garcia, the Board voted 3 – 1 – 1 (President Knox absent and Commissioner Haaland dissented) to uphold the permit.

FOR HEARING TODAY.

 

ACTION: Upon motion by Commissioner Fung, the Board voted 4 – 0 – 1 (President Knox absent) to uphold the permit on conditions that the 4th floor deck railing be 42 inches high and be made of glass.
