Minutes of Special Meeting

 

Monday, September 29, 2008

 

3:00 p.m.

 

I.

The Special Meeting was called to order at 3:38 p.m.

 

 

 

Present:

President Donald A. Casper

 

 

Vice President Morgan R. Gorrono

 

 

Commissioner Mary Y. Jung

 

 

Commissioner Yu-Yee Wu Sheridan

 

 

 

Not Present:

Commissioner E. Dennis Normandy (Notified absence)

 

 

 

Note:

1) Commissioner Jung announced she reviewed the tape recording of the September 22, 2008 Special Meeting and can participate in today’s meeting.

2) President Casper announced that he and Vice President Gorrono met with parties and their counsel in an attempt to begin settlement discussion prior to the meeting.  President Casper stated that what was discussed would not affect his and Vice President Gorrono’s evaluation and analysis of the facts of the matter before them and the applicable laws and Civil Service Commission Rules.

II.

Public Comment on all matters appearing on the Special Meeting Agenda Session.

 

 

 

Gary Delagnes, President, SF Police Officers Association asked the San Francisco Police Department, Civil Service Commission and City Attorney to provide clarity and transparency in the promotional process.

 

 

 

Lea Militello, President, LGBT Pride Alliance stated that she took the 1997 Q-35 exam and the Q-35 Eligible List should remain active.  She does not support removing the recently appointed Q-50 Sergeants from their positions.

 

 

 

Julian Hill, President, Officers for Justice stated that the departments should work together to improve the promotional process and include the appellants in the remedies.

 

 

 

Juanita Stockwell – stated that she was happy to see the other Union representatives present at the CSC meeting.

 

 

 

Michael Lewis requested clarification on whether the Q-50 appointments were valid since the Q-35 list is active.  He is seeking to promote within the department.

 

 

 

Nick Borthne spoke on classification changes.  The department should follow the Civil Service Commission Rules and procedures to change a classification.

 

 

 

John Affeldt, Public Advocates requested the Civil Service Commission to continue this discussion at a meeting in two (2) weeks and to ask the department to refrain from assigning Q-50 Sergeants to traditionally Q-35 Assistant Inspector positions.

 

 

III.

Challenge to Classification Decision Relating to Q-50 Sergeant Appointments and Assignments Made in August 2007: (1) Decision Whether Assignment to Sergeants of Work Traditionally Performed by Q-35 Assistant Inspectors and 0380 Inspectors as Described in the Class Specifications for those Ranks was Proper under Civil Service Commission Rules; (2) If Not, Decision as to the Appropriate Remedies.(File No. 0268-08-1 ) ACTION ITEM

 

Continuation of Hearing of Appeals from Q-35 Assistant Inspector Eligibles on List ID 21055 Challenging the Classification Decision and the Q-50 Sergeant Appointments and Assignments and the Failure to Appoint Appellants to Q-35 Assistant Inspector. (File No. 0268-08-1 ) ACTION ITEM

 

 

 

Action:

 

 

 

 

         Note:

Continue the meeting in two (2) weeks and request the Chief of Police to not make Q-50 appointments to traditionally Q-35 Assistant Inspector positions until this matter is resolved.  (Vote of 4 to 0)

 

The Commission directed the Executive Officer to check with Commissioners’ schedules and the availability of a hearing room in scheduling the continued meeting.
