October 6, 2008:

Adopt the Human Resources Director’s report on PSC #4035-08/09 subject to the condition that 1) The Municipal Transportation Agency meet and discuss with IFPTE Local 21 the utilization of existing classifications to perform part of the work and that such discussions take place in good faith on all sides; 2) Should civil service classifications be identified which can perform some portion of the work, the work which is contracted out be adjusted accordingly, and; 3) Within thirty (30) days, both the Municipal Transportation Agency and IFPTE Local 21 report to the Commission the progress of the discussions.

President Casper stated that he voted to sustain the decision of the Human Resources Director due to a lack of the required documentation that Mr. Harris needed to demonstrate that he had the primary responsibility for the administration, oversight or management for a program providing health care services required for a Class 2593 Health Program Coordinator III position.

REQUEST TO SPEAK ON ANY MATTER WITHIN THE JURISDICTION OF THE CIVIL SERVICE COMMISSION  (Item No. 12)

 

Ging Louie, IFPTE Local 21 noted that he has come across several situations where employees have no previous performance appraisals or records documenting any acting assignments.

 

James Peavey, Department of Public Health, shared with the Commission the Court of Appeal decision in the case of Michael Kreutzer v. City and County of San Francisco that an exempt employee is not entitled to civil service protections.

 

COMMISSIONERS’ ANNOUNCEMENTS/REQUESTS  (Item No. 13)

 

President Casper suggested that the Commission enter into discussion with the Office of the City Attorney on how to keep the Commission apprised of cases where the Commission is named a defendant in litigation and court decisions which affect the Commission’s merit system jurisdiction.  

 

President Casper also requested the Office of the City Attorney to compile all its opinions affecting the jurisdiction of the Commission going back to 1906 and copies of the opinions be placed in the Commission office.

 

Commissioner Normandy requested the Executive Officer to draft a policy for Commission review and approval in regards to the Commission’s interface with the Office of the City Attorney.
