of the

POTRERO POWER PLANT CITIZENS ADVISORY TASK FORCE

Thursday, March 28, 2002

1. CALL TO ORDER AND ROLL CALL

The meeting was called to order by Chair Philip DeAndrade at 4:10 p.m.

2. APPROVAL OF THE MINUTES

The minutes of the meeting of February 28, 2002 were approved as written.

3. REPORT FROM THE OFFICE OF THE CITY ATTORNEY

Deputy City Attorney Jackie Minor: prehearing conference for Mirant application scheduled for Monday, April 29th at 6:30 p.m. at the CPUC. The PUC has been holding public meetings on the Electricity Plan. Wants to talk to Task Force chair regarding the role the task force anticipates playing in the hearings.

Deputy City Attorney Joe Como: reported on the Jefferson Martin transmission project.

One of the components of the energy plan is a future look at transmission projects. Best and future one is the Jefferson Martin 230 kv project. 1998 blackout was a wakeup call highlighted need for additional transmission to satisfy SF’s growing electricity needs. As result, SF Long-term Planning Study initiated by the ISO. Looked at variety of plans and chose Jefferson Martin, 31 mile line, rebuild overhead section from Jefferson substation to the junction of Sneath Lane, proceeding underground 16 mines to Martin substation. Will add 350MW of additional import capability for SF. Proposed to be operable by September, 2005. PG&E is owner, operator and proposer of project.

Two requirements: permit from CPUC. PG&E will submit application in Sept. City involved in process. CPUC has flagged project as high priority. Part of overall approval must come from ISO. Indication project will be approved. Costs $175 million. Rights of way will have to be acquired by PG&E. PG&E is asking ISO to shut down Hunters Point Power Plant with completion of this project

4. REVIEW OF THE CITY’S ENERGY PLAN

Cal Broomhead, Dept. of the Environment reported on the public meetings. City has to push for strong efficiency and renewable energy program.

Members questioned Mr. Broomhead about the Plan. Plan does not address disaster preparedness issues other than the supply and end use of energy. Plan is a response to the Maxwell Ordinance; was intended to provide the Board of Supervisors the analysis they might use to make the decision about the Mirant Power Plant and the direction of energy planning in the City.

Steve Moss: City has done a good job, is a good start. Has written a memo for the Task Force that creates a priority list on behalf of the Task Force. Electricity Plan implies that the Mirant plan should be flatly rejected by the City; that it would be inappropriate for the power plant to go forth in the size that has been proposed.

If Mirant plan is approved, it will sell power outside the City. As long as Hunters Point Plant continues to stay open, capability should be capped. Suggests that TF add its suggestions to the Electricity Plan.

Mr. Moss moved that the TF adopt the points delineated in his memo, TF to prioritize. Mr. DeAndrade and Mr. Boss suggested that air quality and environmental justice be at top. Mr. Boileau wanted local control as first point. Air quality as second,

environmental justice as third. Affordability, efficiency, renewability, reliability to be included. Would also include costs, etc. Based on information in the plan, the plant of the size proposed by Mirant should be opposed. Mr. Boileau suggested that the energy position of the City should be to close Unit 3 and Hunters Point and to encourage the transmission upgrade. Mr. Boileau also suggested including a decrease in PM10s.

TF also moved to include in its response to the Electricity Plan that a merchant plant should be taxed on the power it sells outside the City. Motion lost.

5. RECOMMENDATIONS TO THE BOARD OF SUPERVISORS RE POTRERO POWER PLANT

Mr. DeAndrade: requested that the TF be included in presenting testimony to the CEC in its final consideration of the Mirant application.

Mr. Boss: moved that the City Attorney imclude the TF on its list of witnesses testifying before the CEC. Seconded by Mr. Moss, motion carried unanimously.

The meeting was adjourned at 6:20 p.m.
