Discussion and possible action item: the Committee with review and discuss state legislation affecting the City and County of San Francisco. Items are listed by Department, then by bill number.

 

a. SB 1439 (Leno) Residential real property: withdrawal of accommodations
Recommended Position: Sponsor
This bill would authorize the San Francisco Board of Supervisors to adopt an ordinance prohibiting a landlord from evicting tenants under the Ellis Act, or threatening to evict tenants under the Ellis Act, if not all the owners of the property have been owners of record for 5 continuous years or more. The bill would also permit San Francisco to require a landlord to notify the City of: (1) an intention to Ellis Act a building, (2) the identity of each person or entity with an ownership interest in the accommodations, and (3) to identify all persons or entities with an ownership in an entity. 

b. AB 2325 (Perez): Medi-Cal: CommuniCAL
Recommended Position: Support
Existing federal law provides increased funding for translation and interpretation services for enrollment, retention, and use of services under the Medicaid Program. This bill would require the department to establish the Medi-Cal Patient-Centered Communication program (CommuniCal). This program, commencing July 1, 2015, would be administered by a 3rd-party administrator to provide and reimburse the costs of medical interpretation services to Medi-Cal beneficiaries who are limited English proficient (LEP).


DEPARTMENT OF THE ENVIRONMENT




a. SB 1014 (Jackson): Pharmaceutical Waste: home-generated
Recommended Position: Sponsor
Current State law allows unwanted medicines to be disposed of as trash (i.e., into landfills) or be flushed down the toilet or drain (i.e., into the wastewater system). Both options cause pharmaceutical chemicals to enter the environment and impact our health. This bill would enact the Home-Generated Pharmaceutical Waste Collection Disposal Act and would define terms for purposes of the act. The bill would require a producer of covered pharmaceuticals to submit to the Department of Resources Recycling and Recovery, by July 1, 2015, except as specified, a product stewardship plan and would authorize one or more producers to submit a plan or designate a stewardship organization to act as an agent on behalf of the producers to submit a plan.



HUMAN SERVICES AGENCY




a. SB 899 (Mitchell) CalWORKS: Eligibility
Recommended Position: Support
SB 899 would prospectively eliminate the Maximum Family Grant (MFG) Rule, meaning that the CalWORKs grant would be increased for children born into a family that is already on aid. Under existing law, the grant is not increased for a child born into a family that was on CalWORKs for 10 months prior to the birth of the child. This policy is known as the MFG Rule. The rule may be waived in specified circumstances, e.g., when the child is conceived by rape or incest, or when the mother is a victim of domestic violence. The bill would also implement privacy protections for CalWORKs applicants and recipients by prohibiting the conditioning of eligibility for aid on the disclosure of information regarding rape, incest or contraception. 

b. SB 1029 (Hancock) CalWORKs and CalFresh Eligibility
Recommended Position: Support
SB 1029 would allow individuals previously convicted of a drug felony, who meet all other eligibility rules, to receive assistance through the CalWORKs and CalFresh programs. The bill would also direct the California Department of Social Services (CDSS) to seek a federal waiver to allow for the pre-enrollment of prison and jail inmates into the CalFresh program one month prior to release, and require counties to implement a pre-enrollment program within 6 months of the waiver being granted.

c. SB 1341 (Mitchell) Statewide Automated Welfare System
Recommended Position: Support
In 2013 the state implemented the CA Healthcare Eligibilty, Enrollment and Retention System (CalHEERs), an administrative database used to determine eligibility and enroll individuals into California Health Exchange products and MAGI Medi-Cal (i.e., the Medi-Cal expansion authorized under the Affordable Care Act). This bill would codify the original agreement among Covered CA, the state and the counties with regard to CalHEERs and SAWS. Specifically, the bill would:
1) Require SAWS to be the system of record for Medi-Cal and to contain all Medi-Cal eligibility rules and case management functionality; 
2) Authorize CalHEERs to house the business rules needed to make MAGI Medi-Cal eligibility determinations;
3) Require CalHEERs to make those business rules available to SAWS; and
4) Require SAWS to house the functionality to create and send Notices of Action for Medi-Cal, including MAGI Medi-Cal, no later than 1/1/16.


SF FILM COMMISSION




a. AB 1839 (Gatto/Bocanegra) Taxation: credits: qualified motion pictures
Recommended Position: Support
Existing law provides $100 million per year in tax credits to film and television productions. Feature films with budgets under $75 million and one-hour TV series airing on basic cable and network TV series relocating to California can apply. This bill will allow all feature films, regardless of budget size, to be eligible for tax credits. Other features of the bill include: 
1) 20 percent tax credit will be limited to $100 million of qualified expenditures. 
2) All new 1-hour television series, regardless of where they air (broadcast, cable, Netflix, etc.) and TV pilots are eligible to apply. 
3) Includes a 5 percent increase in the tax credit (25% total credit) for filming done outside the LA Film Zone. 
4) Offers a 25 percent tax credit for TV shows relocating to CA in the first year. 


SF Municipal Transportation Agency




a. AB 1532 (Gatto) Vehicle: accidents
Recommended Position: Support
This bill would provide that a driver of a vehicle involved in an accident where a person is struck but not injured, shall immediately stop the vehicle at the scene of the accident and provide specified information including, but not limited to, his or her name and current residence address. A violation of these provisions would be a misdemeanor punishable by imprisonment in the county jail for 6 months, or by a fine not exceeding $1,000, or by both, and the Department of Motor Vehicles would be required to immediately suspend the driver’s license of a convicted driver for 6 months.

b. AB 2398 (Levine) Vehicles: Pedestrians & Bicyclists
Recommended Position: Support
Would provide that a driver who violates specified offenses and, as a result of that violation, proximately causes bodily injury or great bodily injury to a vulnerable road user, as defined, is guilty of the public offense of unsafe operation of a motor vehicle with bodily injury or great bodily injury. The bill would make a person who is convicted under these provisions punishable by a fine of not less than $145 and not more than $1,000.

c. SB 1151 (Cannella) Vehicles: School Zone Fines
Recommended Position: Support
Would require that fines for specified violations relating to rules of the road and driving under the influence be doubled or increased if the violation occurred when passing a school building or school grounds, as specified, and the highway is posted with a standard "SCHOOL" warning sign and an accompanying sign notifying motorists that increased penalties apply for traffic violations that are committed within that school zone. The bill would require that these additional fines be deposited in the State Transportation Fund for purposes of the Active Transportation Program.
