Meeting Minutes
May 12, 2005

1. Call to Order and Roll Call

Meeting called to order at 5:40 pm, May 12. 2005.

Present: Commissioners Kennedy, Franklin, Kipnis, Herndon, Guldbech, Weiss, DMV

Absent: Commissioner Wheeler, with excuse

2. Public Comment

None

3. Chairperson's report and opening remarks

Chair Kennedy reported that the SF Rules Committee will be meeting on May 18th, at 10 a.m. The Committee will hear from Commission candidates and recommend to the Board of Supervisors 4 appointments to the Commission.

Commissioner Franklin reported that she will be meeting with Elyssa Eckman, former Commissioner, and Supervisor Mirkarimi regarding UCSF animal testing and the Cambridge-style ordinance.

Public Comment - none.

4. Approval of Draft April Meeting Minutes

Public Comment:

Richard Fong - page 3, change reference to video tapes to, "use video optics to do procedure."

Commissioner Weiss moved to accept the minutes with changes.

Motion seconded by Commissioner Franklin

Unanimous

5. Committee/Commissioner Reports

Commissioner Kipnis reported that there were no update on the debate of the anti declawing bill in North Hollywood, CA.

Public comment - none.

6. Old Business

The Chair presented items 6a and 6c together.

6a. Endorsement of legislation that would prohibit those convicted of animal abuse/neglect from having animals for up to a five-year period.

6c. SF Health Code 42.3(c)(b) - Explore making a change of the time requirements for the scheduling of vicious and dangerous dog hearing dates, to be based not only on when the dog incident occurred but also upon when the dog and guardian can be found to receive notification.

Commissioner Franklin reported that she and Commissioner Guldbech will finalize the draft legislation regarding 6a and 6c and send to the City attorney in the next week.

Public Comment

Miriam - suggested that the Commission receive support from the DA's office prior to making a recommendation to the Board of Supervisors.

Gloria Rogan - since animals are private property, and private property is highly regulated, we can address the over population as an economic and/ health threat and use that approach as a strategy for getting legislation passed.

7b. Discuss legislation that would impose mandated counseling for those convicted of animal abuse/neglect.

Commissioner Franklin reported that counseling is mandated in the state of CA if an individual is convicted of animal abuse. Commissioner Guldbech stated that she was able to find any written state code regarding mandatory counseling. She stated that if mandatory counseling is located under any section of the law other than the penal code, it would be best if the Commission would work towards establishing a local code. Commissioner Franklin will send Commissioner Guldbech the web site link to the state law.

Commissioner Franklin will continue to research all current laws and codes regading mandatory counseling and report her findings at next the Commission meeting.

RonCole - has a copy of the state code and will send it to Commissioners Guldbech and Franklin

Miriam - suggested that the Commission do a lexus/nexus search. She volunteered to do a search since she has access to lexus/nexus.

New Business - none

Miriam - asked if there was any legislation in the city regarding the hit and run of animals.

Calendar Items:

Commissioners will submit July meeting agenda items to the Chair

Review of Task Allotments

1. Commission will continue to look into penal codes for mandatory counseling for animal abusers

2. Commissioners Franklin and Guldbech and Herndon will continue working on fine tuning language for item 7a and 7c.
