MEETING MINUTES- WEDNESDAY, MAY 26, 2004

5:00 P.M., CITY HALL, ROOM 416, ONE DR. CARLTON B. GOODLETT PLACE

 

PRESENT: President Kathleen Harrington, Vice President Hisashi Sugaya, Commissioner Arnold Chin, and Commissioner Sabrina Saunders.

ABSENT:  Commissioner Douglas Shoemaker.

Catharine Barnes, Deputy City Attorney, Office of the City Attorney (DCA OCA); Craig NIkitas, Acting Zoning Administrator, Planning Department (AZA, PD); Laurence Kornfield, Chief Building Inspector, Dept. of Building Inspection (CBI DBI); Robert Feldman, Executive Secretary, and Victor Pacheco, Legal Assistant, for the Board; and Claudine Woeber, Official Court Reporter.

 

(1)         PUBLIC COMMENT

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

Protesting issuance on June 20, 2001, to Raymond & Hazel Guaraglia, Permit to Alter a Building (demolish existing non-compliant residential units per Notice of Violation No. 200114983; remove all utilities to ground level; convert to original commercial space with no structural work to be done).

APPLICATION NO. 2001/06/20/1935.

PUBLIC TESTIMONY HEARD 6/19/03.

FOR FURTHER CONSIDERATION TODAY.

ACTION:  Appeal withdrawn by the appellant.

 

(5)    APPEAL NO. 04-014

KAREN DUGGAN, Appellant(s)

                        vs.

DEPT. OF BUILDING INSPECTION, Respondent

 

 

233-235 Corbett Avenue.

Appealing the denial on Feb. 24, 2004, of a Permit to Alter a Building (on two-family house: comply with notice of violation, correct record to show existing use of two-family dwelling plus housekeeping).

APPLICATION NO. 2004/02/06/5823.

FOR HEARING TODAY.

ACTION:  Upon motion by Vice President Sugaya, the Board voted 4-0-1 (Commissioner Shoemaker absent) to overrule the denial and grant the permit with a finding that the subject housekeeping unit is pre-existing. 

SPEAKERS:  Jeremy Paul, agent for appellant, described the subject housekeeping unit and gave a history of it and the relevant permit history and evidence of the unit’s existence since 1917.  Laurence Kornfield, CBI DBI, explained the Building Code provisions regarding housekeeping units and his observations on his site visit.  No public comment.

 

(6)   APPEAL NO. 04-026

RICHARD & DIANE FELDER, Appellant(s)

                        vs.

DEPT. OF BUILDING INSPECTION, Respondent

 

 

482 Bayview Circle.

Protesting the issuance on March 25, 2004, to Ive Freeman, Permit to Alter a Building (on single-family house: install a hot tub in back yard; no plumbing; electrical work for power; deck/slab existing). 

APPLICATION NO. 2004/03/25/9598.

FOR HEARING TODAY.

ACTION:  Upon motion by Commissioner Chin, the Board voted 4-0-1 (Commissioner Shoemaker absent) to uphold the subject permit. 

SPEAKERS:  Marilyn Kalman, attorney for appellant, explained the history of the subject hot tub and the discussions between her client and the permit holder and the HOA.  She also explained her client’s concerns with the project which is located next to her client’s living room window.  Ive Freeman, permit holder, described his efforts to address the appellant’s concerns and the Code requirements, and said that he would remove any portion of the deck that violates the Planning Code.  No public comment.

Laurence Kornfield, CBI DBI, said that hot tub installations of this type do not require permits unless special electrical or plumbing work is required, which is not the case here.  Craig Nikitas, AZA, described the Planning Code’s rear yard requirements which have not been violated by the hot tub, which does not appear to be located in the rear yard. 

 

(7)   APPEAL NO. 04-029

MALANA MOBERG, Appellant(s)

                        vs.

DEPT. OF BUILDING INSPECTION, Respondent

PLANNING DEPT. APPROVAL

 

899 North Point.

Protesting the issuance on March 30, 2004, to Galway Properties II, Permit to Demolish a Building (one-story gas station with 1,650sf of ground floor area). 

APPLICATION NO. 2003/04/25/3194.

FOR HEARING TODAY.

ACTION:  Upon motion by Commissioner Saunders, the Board voted 4-0-1 (Commissioner Shoemaker absent) to reschedule the appeal to June 9, 2004. 

SPEAKERS:  Malana Moberg, appellant, requested a rescheduling based on the absence of Commissioner Shoemaker.  Joel Yodowitz, attorney for permit holder, asked that the hearing go forward with four Board members. 

 

There being no further business, President Harrington adjourned the meeting at 6:00 p.m.
