MEETING MINUTES - WEDNESDAY, JUNE 5, 2002

(1)PUBLIC COMMENT: At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items. With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar. Each member of the public may address the Board for up to three minutes. If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

ITEM A: Public Comment concerning the Closed Session. None.

ITEM B: Discussion and vote pursuant to Administrative Code § 67.11(a) as to whether to conduct a closed session and invoke the attorney-client privilege.

ITEM C: Pursuant to Government Code § 54956.9 and Administrative Code § 67.8 (3), the Board of Appeals met with City Attorney’s representative in Closed Session to discuss and take action on attorney-client matters in the following case:

On September 12, 2001, upon motion by Commissioner Cullum, the Board voted 4-1 (President Chin dissented) to revoke all four permits; on October 10, 2001, upon motion by Commissioner El Qadah, the Board voted 3-2 (President Chin & Commissioner McInerney dissented) to deny the request for rehearing by the permit holder.

ITEM D: Adjourn Closed Session.

ITEM E: Motion to disclose or not disclose the information discussed in the Closed Session.

ITEM F: Reconvene Regular Meeting.

ACTION: Upon motion by Commissioner Cullum, the Board voted 5-0 to meet in Closed Session. Afterwards, upon motion by Commissioner Cullum, the Board voted 5-0 not to disclose the information discussed during the Closed Session.

(4)ADDENDUM ITEM(S):

ITEM A: 144 Eddy Street. Letter from Andrew Zacks, attorney for appellant Empress LLC, requesting rehearing of Appeal No. 01-082, Empress LLC vs. ZA, decided January 9, 2002. Upon motion by Commissioner Cullum, the Board voted 3-2 (President Chin & Commissioner El Qadah dissented) to uphold the subject determination. Determination Holder: Tenderloin Housing Clinic.

ACTION: This matter was rescheduled to June 19, 2002 prior to consideration.

SPEAKERS: None.

ITEM B: 144 Eddy Street. Proposed findings for Appeal 01-081, West Cork LLC vs. ZA, and Appeal 01-082, Empress LLC vs. ZA, decided Jan. 9, 2002. Upon motion by Commissioner Cullum, the Board voted 3-2 (President Chin & Commissioner El Qadah dissented) to uphold the subject determination. Determination Holder: Tenderloin Housing Clinic. For adoption today.

ACTION: This matter was rescheduled to June 19, 2002 prior to consideration.

ITEM C: 315 & 319 Edgehill Way. Letter from Tim Colen, agent for the Edgehill Way Homeowner’s Association, § 14 Party, requesting rehearing of Appeal No(s). 02-037/038, Forest View LLC vs. DBI, PCD, decided May 15, 2002. Upon motion by Commissioner McInerney, the Board voted 4-1 (President Chin dissented) to overrule the Planning Commission’s denial, and grant both permits with the following conditions: a) that the overall length of the building be reduced from 50 feet to 40 feet; b) that the gross square footage of each house not exceed 3600sf including the garage and storage space; c) that the project sponsor provide a street improvement bond for all roadwork; d) that no construction on the project begin other than foundation work until all roadway widening work in front of all 6 lots intended for development is complete; e) that the project sponsor will record an open space preservation easement for all six lots to be approved by the Board on June 5, 2002; f) that conditions of the Structural Advisory Committee be implemented by the project sponsor; g) and that findings be prepared by the appellant’s attorney for adoption by the Board on June 5, 2002.

ACTION: Upon motion by Vice President McInerney, the Board voted 4-1 (Commissioner Cullum dissented) to deny the request for rehearing.

Four to one to deny request for rehearing. Denied.

ITEM D: 315 & 319 Edgehill Way. Proposed findings and Notice of Special Restrictions (open space preservation easement) for Appeal Nos. 02-037/038, Forest View LLC vs. DBI, PCD, decided May 15, 2002. Upon motion by Commissioner McInerney, the Board voted 4-1 (Commissioner Cullun dissented) to overrule the Planning Commission’s denial, and grant both permits with the conditions as listed above in Item C.

ACTION: Upon motion by Vice President McInerney, the Board voted 5-0 to continue the matter to June 12, 2002 with the parties to submit documents directly to Board members.

ITEM E: 271 Cumberland Street #5. Letter from Chuck Louden, permit holder, requesting rehearing of Appeal No. 01-175, Holland vs. DBI, PDA, decided May 15, 2002. Upon motion by Commissioner Cullum, the Board voted 5-0 to revoke the subject permit. Project: comply with NOV, replacement roof deck, 2X4 sleepers on asphalt roof (legalize existing deck).

ACTION: Upon motion by Vice President McInerney, the Board voted 5-0 to deny the request for rehearing.

ACTION: Upon motion by Vice President McInerney, the Board voted 4-1 (President Chin dissented) to uphold the procedural denial (modification) by the Planning Commission with conditions as stated by Vice President McInerney, with adoption of findings set for June 12, 2002.

ACTION: Upon motion by Vice President McIenrney, the Board voted 4-1 (Commissioner Cullum dissented) to overrule the determination on condition that there be no seating on the subject balcony after 9pm, with adoption of all the conditions as stated in the settlement between the appellant and the Police Department.
