PRESENT:  President Randall Knox, Vice President Michael Garcia, Commissioner Frank Fung, Commissioner Katharine Albright, and Commissioner Robert Haaland.

(1)    PUBLIC COMMENT: 

 

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

(3a)  JURISDICTION REQUEST TO ALLOW LATE FILING OF APPEAL:                        

Subject property at 1945 Pacific Avenue.  Permit issued on October 10, 2006. Last day to appeal was October 25, 2006. Jurisdiction request received on January 18, 2007.  Letter from Richard Hurlburt, attorney for Bruce Hoban, requestor, asking that the Board take jurisdiction over Building Permit Application No. 2006/10/10/4510.  Permit Holder: Daniel Fong.  Project: on       12-unit apartment building; remodel three full bathrooms and half bathroom and kitchen in penthouse unit; remodel existing kitchen and bathroom on 1st floor (Unit 2C) per plan.

 

ACTION: Upon motion by Commissioner Fung, the Board voted 5 – 0 to reschedule the matter to 3/7/07, and both parties will not be present.

ACTION: Upon motion by President Knox, the Board voted 5 – 0 to continue the matter to 4/4/07, for mediation to take place, and with the Public Hearing closed.

ACTION: Upon motion by Commissioner Fung, the Board voted 5 – 0 to reschedule the matter to 3/14/07, and with parties to attempt mediation at Community Boards. The Board of Appeals will get information of community Boards for Appellant and Permit Holder.

ACTION: Upon motion by Vice President Garcia, the Board voted 5 – 0 to revoke the subject variance, with findings to be adopted on 3/07/07.

Protesting the issuance on November 28, 2006, to Alex Volkov, Permit to Alter Building (on two-unit building: internal remodeling; convert ground floor playroom with ½ bath into smaller playroom with full bath and storage room, and connecting with 2nd story unit with new stairs; at 2nd floor, remodel kitchen with new cabinets, appliances, and fixtures, and remodel bathroom in order to have tub and shower).

APPLICATION NO. 2006/11/28/8606.

FOR HEARING TODAY.

 

ACTION: Upon motion by Commissioner Albright, the Board voted 5 – 0 to uphold the permit on conditions that all work should be completed within 90 days of the start date of the Appellant’s temporary eviction.

ACTION: Upon motion by Commissioner Fung, the Board voted 5 – 0 to uphold the denial.
