MEETING MINUTES - WEDNESDAY, OCTOBER 29, 2003

5:00 P.M., CITY HALL, ROOM 416, ONE DR. CARLTON B. GOODLETT PLACE

PRESENT:  Vice President Kathleen Harrington, Commissioner Douglas Shoemaker, Commissioner Hisashi Sugaya, and Commissioner Sabrina Saunders.

Catharine Barnes, Deputy City Attorney (DCA); Julian Banales, for the Planning Dept. (PD) & the Zoning Administrator (ZA); Laurence Kornfield, Chief Building Inspector, Dept. of Building Inspection (CBI DBI); Victor Pacheco, Legal Assistant, for the Board; and Claudine Woeber, Official Court Reporter.

ABSENT:  President Arnold Chin, and Executive Secretary Robert Feldman.

 

(1)         PUBLIC COMMENT

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

HONOR BULKLEY, Appellant(s)

                        vs.

DEPT. OF BUILDING INSPECTION, Respondent PLANNING DEPT. DISAPPROVAL

3632 Sacramento Street.

Appealing the denial on August 14, 2003, of Permit to Alter a Building (on two-story office/residential building: level two of the subject property has been used for offices since about 1976; the purpose of this application is to bring the zoning classification into conformance with the longtime use as offices; no construction; no work).

APPLICATION NO. 2003/07/11/9285.

FOR HEARING TODAY.

ACTION:  This appeal was rescheduled to Dec. 3, 2003 prior to the meeting.

 

(5)    APPEAL NO. 03-123

HENRY KARNILOWICZ, Appellant(s)

                        vs.

ZONING ADMINISTRATOR, Respondent

1011 Howard Street.

Appealing a Stop Work Order Request for Building Permit Application No(s). 2003/02/19/7782.  Reason(s) for requesting stop work order: subject permit for vinyl windows was approved in error by Planning staff as an over-the-counter permit without the appropriate review that is required for historically rated buildings such as the subject property. 

JURISDICTION GRANTED JULY 30, 2003. 

FOR HEARING TODAY.

ACTION:  This appeal was withdrawn by the appellant.

 

(6)    APPEAL NO. 03-125

MARK NAGLE

dba “CHIEFTAIN IRISH PUB” , Appellant(s)

                        vs.

ZONING ADMINISTRATOR, Respondent

198 – 5th Street.

Appealing a determination dated August 6, 2003, addressed to Terence McVeigh, that a Place of Entertainment permit is not allowed at the subject property because Planning Code § 815.37 prohibits nighttime entertainment uses in the Residential/Service Mixed Use zoning district.

FOR HEARING TODAY.

ACTION:  Upon motion by Commissioner Saunders, the Board voted 4-0-1 (President Chin absent) to overrule the determination with a finding that there was a pre-existing night-time entertainment use at the subject property, with conditions of approval as proposed by the Police Permit Bureau. 

SPEAKERS:  Julian Banales, PD, explained the subject determination.  Mark Nagle, appellant, urged the Board to overturn the determination.  Public comment for appellant:  Roger Gordon, Angus McCarthy, Jeremy Paul, Dawn Colvin, and Joe O’Donoghue. 

 

(7)    APPEAL NO. 03-126

KEITH MATTOS, Appellant(s)

                        vs.

DEPT. OF BUILDING INSPECTION, Respondent PLANNING DEPT. APPROVAL

333 Ulloa Street.

Protesting the issuance on August 11, 2003, to Miranda Li, Permit to Alter a Building (alter and add bath on 2nd floor; add a bedroom on ground floor; legalize bath and bedroom on ground floor; add single level deck at rear of 2nd floor; add 4 skylights over bath and kitchen).

APPLICATION NO. 2003/08/11/1664.

FOR HEARING TODAY.

ACTION:  Upon motion by Commissioner Shoemaker, the Board voted 4-0-1 (President Chin absent) to uphold the subject permit due to the non-appearance of the appellant.   

SPEAKERS:  Jeremy Paul, agent for permit holder, urged the Board to uphold the permit.  Public comment for appellant:  Abrahim Pakzad.

 

There being no further business Vice President Harrington adjourned the meeting at 6:08 pm.
