 MEETING MINUTES - WEDNESDAY, MAY 9, 2007

 

5:00 P.M., CITY HALL, ROOM 416, ONE DR. CARLTON B. GOODLETT PLACE

 

PRESENT: Vice President Garcia, Commissioner Frank Fung, Commissioner Katharine Albright, and Commissioner Robert Haaland.

 

Catharine Barnes, Deputy City Attorney, Office of the City Attorney (OCA); Laurence Kornfield, Chief Building Inspector, Department of Building Inspection (DBI); Tina Tam, Senior Planner, Planning Department (PD); Robert  Feldman, Executive Secretary, and Victor Pacheco, Legal Assistant,  Easteller Bruihl, Official Court Reporter .

 

ABSENT: President Randall Knox and Clerk Typist Manuel Payes

 

 

(1)    PUBLIC COMMENT: 

 

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

 

SPEAKERS: William Duke explained the neighbors frustration with the permit review process because a Permit Holder’s addendum plans are not consistent with the plans approved by Planning Commission and the Board of Appeals.

 

Ann Walker said the Permit Holder added a roof top railing which made a roof bench possible and different extension stairs from one side of the building to the other.

(3a)  JURISDICTION REQUEST TO ALLOW LATE FILING OF APPEAL:                        

Subject property at 39 – 6th Street.  Permit denied on March 27, 2007.  Last day to appeal was April 11, 2007.  Jurisdiction request received on April 13, 2007.  Letter from Jon Webster, attorney for Shlomo Gonen, requestor, asking that the Board take jurisdiction over the denial of a pawnbroker permit by the Police Department (SFPD). 

 

ACTION: Upon motion by Commissioner Albright, the Board voted 4 – 0 – 1 (President Knox absent) to grant the jurisdiction request.

Appealing the denial on January 31, 2007,    of Permit to Remove and Replace One (1) Tree.

ORDER NO. 176,671.

PUBLIC HEARING HELD & CLOSED ON APRIL 4, 2007.  FOR FURTHER CONSIDERATION TODAY.

 

ACTION: Upon motion by Vice President Garcia, the Board voted 4 – 0 – 1 (President Knox absent) to continue the matter to 06/06/07.  Both parties will submit additional information pursuant to the Board’s comments.

(5)  APPEAL NO. 07- 010

Protesting the issuance on January 17, 2007, to Ben & Wendy Yalom, Permit to Alter a Building (comply with NOV; revise BPA      No. 2006/07/26/7705 to show existing use at attic; permanent removal of illegal unit; return building to legal two-unit configuration to comply with NOV; new attic window (front); add seven new skylights).

APPLICATION NO. 2006/11/08/7196.

FOR HEARING TODAY.

 

ACTION: Upon motion by Vice President Garcia, the Board voted 4 – 0 – 1 (President Knox absent) to uphold the permit on conditions that DBI amend its records to reflect two (2) floors of habitable space.

Appealing a Notice of Violation dated February 23, 2007, addressed to Robert Katz & Debora Stanley, and Clear Channel Outdoor, that the west face of the general advertising sign on the roof of the subject property has been enlarged and intensified (light box) without a permit, in violation of Planning Code § 604(h).

ACTION: Withdrawn by Appellant.

Protesting the issuance on March 1, 2007, to Lorraine Kelley, Permit to Alter a Building (on two-unit building: extend garage into rear of existing building; cover two light wells at ground floor only; add elevator to each floor).

APPLICATION NO. 2003/10/22/8225.

FOR HEARING TODAY.

 

ACTION: Upon motion by Vice President Garcia, the Board voted 4 -0 -1 (President Knox absent) to uphold the permit on condition that the structural design be revised to add a bearing wall to match existing wall at rear yard stairs, and to design a new grade beam along west property line that will not surcharge Appellant’s retaining wall.

Protesting the issuance on February 27, 2007, to Milton Panagotacos, Site Permit to Alter a Building (on two-unit building: construct two-level deck at the back of existing three-story dwelling).

FOR HEARING TODAY.

 

ACTION: Upon motion by Vice President Garcia, the Board voted 4 – 0 – 1 (President Knox absent) to uphold the permit on conditions that lattice be added to both decks and that said lattice not exceed six (6) feet in height.
