MEETING MINUTES - WEDNESDAY, OCTOBER 16, 2002
5:00 P.M., CITY HALL, ROOM 416, ONE DR. CARLTON B. GOODLETT PLACE

(1)SPECIAL ITEM(S):

ITEM A: Drawing of lots to determine which members of the Board of Appeals shall serve two-year terms and which members shall serve four-year terms.

RESULT: 2-year terms: Commissioners Chin, Saunders & Shoemaker.

4-year terms: Commissioners Harrington and Sugaya.

Gloria L. Young, Clerk of the Board of Supervisors, conducted a drawing of lots to determine which

Commissioners are to serve two-year terms. After drawing, she announced that Commissioner

Arnold Chin, Sabrina Saunders and Douglas Shoemaker shall serve for two years and then may be

reappointed to serve for two more years. Kathleen Harrington and Hisashi Sugaya shall serve for

four years and all subsequent terms shall be four years.

(2)ELECTION OF OFFICERS.

ACTION: Upon motion by Commissioner Saunders, the Board voted 5-0 to elect Commissioner Chin President of the Board. Afterwards, upon motion by President Chin, the Board voted 4-1 (Commissioner Shoemaker dissented) to elect Commissioner Harrington to Vice President of the Board. Officers to serve until the annual election January 15, 2003.

(3) COMMISSIONERS COMMENTS & QUESTIONS:

ITEM A: Discussion of case backlog, future calendars, and special sessions/meetings.

The Board discussed methods of handling the backlog of appeals with ten appeals scheduled for

each meeting.

SPEAKERS: None.

(4)SPECIAL ITEM(S):

ITEM A: Presentation by the Office of the City Attorney on statute, ordinance, and Charter provisions regulating commissioners.

SPEAKERS: George Roberts, deputy city attorney presented a review of the Sunshine Ordinance as it affects the Board of Appeals and answered questions about it. Judith Boyagian, deputy city attorney explained the law and practice regarding ex parte contacts and answered questions.

No public comment.

ITEM B: Presentations by department representatives.

SPEAKERS (a) Gerald Green, Director of Planning Department welcomed the Board members and explained how the Planning Commission’s DR decisions are appealed to the Board. Lawrence Badiner, Zoning Administrator, described his role in implementing the Planning Code and how his various enforcement actions and determinations are appealed to the Board. (b) Lawrence Kornfield described his role as representative of DBI to the Board at hearings. (c) Captain O’Neill, head of the S.F.P.D. Support Services Division and the Permit Bureau explained the permit process and how P.D. actions are appealed to the Board. (d) Naomi Little, Executive Director of the Taxi Commission explained the taxi medallions process and how the Taxi Commissions’ activities are appealed to the Board and she explained the significance of the 3,000-person list of applicants for medallions, many of whom have waited 7 - 10 years. She said 1381 medallions have been issued so far. (e) Tony Walcott, the Urban Forester from the Department of Public Works, described the sidewalk tree planting and removal permit process and how the Board relates to it. (f) The executive secretary briefly described the permit review process.

(5)PUBLIC COMMENT: At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items. With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar. Each member of the public may address the Board for up to three minutes. If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

SPEAKERS: There was no public comment on the matters above. Attorney Brett Gladstone

wished the Board well and welcomed the new Commissioners.

There being no further business, President Chin adjourned the meeting at 7:40.
