 MEETING MINUTES - WEDNESDAY, SEPTEMBER 6, 2006

 

5:00 P.M., CITY HALL, ROOM 416, ONE DR. CARLTON B. GOODLETT PLACE

 

 

PRESENT: President Frank Fung, Vice President Randall Knox, Commissioner Katharine Albright, Commissioner Michael Garcia, and Commissioner Robert Haaland.

 

Catharine Barnes, Deputy City Attorney, Office of the City Attorney (OCA); Tina Tam, Senior Planner, Planning Department (PD); Laurence Kornfiled, Chief Building Inspector, Dept. of Building Inspection (DBI);  Robert Feldman, Executive Secretary, and Victor Pacheco, Legal Assistant, for the Board; and Claudine Woeber, Official Court Reporter.

 

 

(1)         PUBLIC COMMENT: 

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

(3a)  JURISDICTION REQUEST TO ALLOW LATE FILING OF APPEAL:                                                

Subject property at 3011 – 20th Street.  Permit issued on November 15, 2005.  Last day to appeal was November 30, 2005.  Jurisdiction request received on July 14, 2006.  Letter from Charles Wright, attorney for Dominador Ballesteros, requestor, asking that the Board take jurisdiction over Building Permit Application No(s). 2004/11/04/8587.  Permit Holder(s): Chin Soo Kim.  Project: erect a 4-story, 3-unit building.

 

ACTION:  Upon motion by Commissioner Garcia, the Board voted 5-0 to deny the jurisdiction request.

PLANNING DEPT. APPROVAL

 

700 – 4th Avenue.

Protesting the issuance on April 28, 2006, to Korean Covenant Church, Site Permit to Alter a Building (change occupancy with maximum at 100 persons; add elevator; revise exiting; revise property line fire walls; legalize ground floor kitchen and dining; variance for rear yard exit stair case, variance case no. 2004.0613V).

APPLICATION NO. 2005/06/08/4603S.

PUBLIC HEARING HELD & CLOSED ON JULY 12, 2006.  FOR FURTHER CONSIDERATION TODAY.  Note: Matter continued to allow parties time to work on settlement regarding mitigation measures.

 

ACTION:  Upon motion by President Fung, the Board voted 5-0 to continue the matter to      October 4, 2006, at the prior written request of the parties.

(5)    APPEAL NO. 06-118

KENNETH RAY WALKER, Appellant(s)

                     vs.

 

ENTERTAINMENT COMMISSION, Respondent

 

1419 Fillmore Street.

Protesting the conditional grant on August 1, 2006, to Sheba Piano Lounge, Place of Entertainment Permit.

PERMIT NO. EC-849.

FOR HEARING TODAY.

 

ACTION:  Upon motion by Vice-President Knox, the Board voted 5-0 to uphold the permit. 

 

SPEAKERS:  Netsanet Alemayehu, permit holder; appellant did not appear; Robert Davis, Entertainment Commission.

 

 

 

PUBLIC COMMENT:  Charles Spencer said he has several businesses on the Fillmore, and that the subject business is colorful and has good food.

 

Emmit Powell owns Powell’s Place and strongly supports the permit holder because this facility is important to the area.

 

Karen Babbitt said the neighbors take great pride.

 

Agonafer Shiferaw said he supports this business and he thanks the others who have come to this hearing to support Sheba Piano Lounge.

 

Kathy Evans said she had her birthday party at Sheba and their employees were gracious.  She saw this Notice of the Entertainment Commission hearing on the property and she supports Sheba because it is a wonderful addition to the Fillmore.

 

Paul Hyams represents of the owners of the Fillmore Center and said Sheba is a fabulous establishment and he supports it.

 

Rev. Arnold Townsend spoke in favor of the permit holder.

 

Jerome Clay said he is the pianist at Sheba and urged the Board to uphold the permit because this is an important venue for jazz and a perfect business in the Fillmore.

Appealing the denial on July 10, 2006, of Rear Yard Variance (construct a horizontal addition and egress stairs at the 2nd story level, that will extend into the required rear yard of an existing 3-story, single-family dwelling.

VARIANCE CASE NO.  2006.0153V.

FOR HEARING TODAY.

 

ACTION:  Upon motion by Vice-President Knox, the Board voted 5-0 to overrule the denial, grant the variance, with adoption of findings at a later date.
