I.

The Special Meeting was called to order at  1:46 p.m.

 

 

 

Present:

Commissioner Mary Y. Jung (Notified absence)

President Donald A. Casper presided.

 

 

II.

Public Comment on all matters appearing on the Special Meeting Agenda Session.

 

 

 

Criss Romero, IFPTE Local 21, stated that the Department of Human Resources did not provide enough description or reasons on its proposals for Civil Service Reform.

 

 

III.

Department of Human Resources Presentation on Proposals for Civil Service Reform Phase II.  Merit system issues that may be addressed include but are not limited to: Certification Rules; Appeals, Promotive appointments and opportunities; Sick leave; Layoffs; Recognition of seniority; Civil Service Rules – i.e. Rules consolidation, Recommendations to update, simplify, clarify the Rules on Fitness for Duty, Employee Relations Ordinance (ERO), Rule 118 – Conflict of Interest, Rule 115 – Rules Related to Employment of Persons with Disabilities, Near lists; and General update of proposals made in 2005 Civil Service Reform Recommendations. February 2, 2009:

Schedule a Special Meeting for Monday, February 23, 2009 at 2:00 p.m. in Room 400 City Hall for a briefing on Civil Service Reform.

 

 

 

 

February 23, 2009:

The Commission took no action.

 

 

 

       Commission

            Direction:

1) The Commission requested the Department of Human Resources to provide specific details on each of the recommendations to the Commission and all interested parties for transparency.

 

 

2) The Commission also directed the Executive Officer to schedule special meeting(s) to continue the Department of Human Resources presentation on Civil Service Reform proposals and provide interested parties opportunity to address the recommendations.

 

 

Speakers:

Jennifer Johnston, Department of Human Resources, presented proposals from the Department of Human Resources for Civil Service Reform Phase II

 

 

 

 

 

Criss Romero, IFPTE Local 21, stated that in 2006, laid off employees who were bumped to Moccasin, were told that they could only refuse a position twice.  He also stated that special conditions were being added to positions to avoid layoffs.

 

 

 

 

 

Alice Villagomez, Human Resources Director, San Francisco Police Department, provided information on the 5-year extended benefits for holdovers.  It was the result of litigation that the 5-years of extended benefits for holdovers would correspond with the 5-year vesting requirement.

 

 

 

 

 

Ted Yamasaki, Department of Human Resources, explained holdover rosters and return to duty.

 

 

 

 

 

Margot Reed, SEIU Local 1021, commented on holdovers who refuse positions with special conditions in different departments.  She also stated that unions need to be included in reevaluating or developing examinations.

 

 

 

 

 

Barry Rodriguez, SEIU Local 1021, expressed concern that creating sub seniority areas within functions would invite discrimination.  He also referred to the 2007-08 Civil Grand Jury report regarding best practices.

 

 

 

 

 

Kevin Hughes, Electrical Workers Local 6, thanked the Commission for bringing attention to issues rarely discussed on proposals on Civil Service Reform.

 

 

 

 

 

Alice Kwong, Acting Human Resources Director, Municipal Transportation Agency, supported the reform to modernize operations but said that MTA should not be included in the consolidation of the Civil Service Rules.  MTA’s separate Charter authority makes it clear to MTA employees where and to whom they file protests or appeals.

 

 

 

 

Action:

The Commission took no action.

Adjournment in memory of John Kanaley, CEO, Laguna Honda Hospital, who suddenly passed away March 19, 2009.  The Commission directed the Executive Officer to extend condolences to the family on behalf of the Commission.
