1.        Adopt the report.  Sustain the decision of the Human Resources Director; deny the appeal by Mario Machi. 
Mr. Machi failed to appear.

3.         The Commission requested an Opinion of the City Attorney on the jurisdiction of the Court and the Commission to interpret and enforce the Stipulation and Order Re: Selection Procedure for the 1998 Q-35 Assistant Inspector Examination; and to provide guidance on the meaning of certain provisions therein.  (Vote of 4 to 0)

Future employment subject to the review and approval of the Human Resources Director after satisfactory completion of one (1) year work experience outside the City and County service from February 22, 2006; Must participate in an appropriate substance abuse program and receive a release to work from a Department of Human Resources (DHR) designated professional in substance abuse.  (Vote of 3 to 1; Commissioner Gorrono dissents)

 

REQUEST TO SPEAK ON ANY MATTER WITHIN THE JURISDICTION OF THE CIVIL SERVICE COMMISSION

 

1.         Nikolaus Borthne thanked the Commission for allowing them to speak and present their concerns.

2.         Michael Lewis stressed the point that the 21055 List has been underserved.

3.         Insp. Joseph Engler appeared as the representative of the appellants.  He stated that if the Chief of Police makes appointments of people using budgeted Inspectors positions as Sergeants, then everyone will be harmed. 

4.         Julian Hill, Vice President, Officers for Justice requested the Commission to demand that vacancies are filled for the Q – 35 from the active Q – 35 List.  He added that once the promotions are made, the majority of all the appeals that were denied without prejudice will probably disappear.

5.         Marion Jackson spoke on behalf of the appellants.  He stated they are very qualified and should get the job of Inspector.

6.         Sylvia Johnson spoke in support of the appellants.

7.         Silvia David asked to be allowed the opportunity to do the work of Inspector that she loves so well.

8.         Jacklyn Jehl thanked the Commission for hearing their appeals.  She praised her colleagues for the impeccable work they perform.

9.         Juanita Stockwell spoke on behalf of the appellants.

 

COMMISSIONERS’ ANNOUNCEMENTS/REQUESTS

 

Commissioner Gorrono requested that more information be included in the notices to the appellants regarding post employment restrictions and what they can expect at a hearing.
