Co-Chair Ollie Sadler called the meeting to order at approximately 1:15 p.m.

ITEM 1 – Adoption of October 15, 2003Agenda
Item 1 adopted on motion of Linda Klee.

ITEM 2 – Review and Adoption of September 24, 2003minutes
Two corrections were presented before the motion was adopted.  First, the word “District Attorneys” should be added to the words “deputy” so as not to confuse the person with Sheriff personnel.  Second, the date of the Justice and Courage meeting was October 22, 2003, not October 2 as presented.  Adopted on motion by Linda Klee and second of Belle Taylor-McGhee.

ITEM 3 – Review of Data Collection Dataflow Diagram
Co-Chair Ollie Sadler that drafts of recommendations needed to be looked at before the next ICCC meeting.

Cynthia Alexis asked about the DTIS Stay-Away Order software project.  Co-Chair Oli Sadler said that the Courts should initiate the Stay-Away information distribution.  Inspector Gianrico Pierucci stated that a copy of Stay-Away orders will be in the Lieutenants office at every Police station whether the order is served or unserved.  An EPO (Emergency Protective Order) clipboard will be attached to the Lieutenant’s chair.  Linda Klee noted that the orders served by the District Attorney’s Office are different from EPOs.

Gianrico Pierucci mentioned that a faxed copy of a Stay-Away Order would be placed on file.  He thought that if the orders could be faxed to the two (2) Inspectors on duty each day, at the district stations.

The short, mid and long term fixes were reviewed.  The ECD’s (Emergency Communications Department’s) recommended action is done and The D.A.’s training re: fixes has started.  Linda Klee said the office was prepared to move forward with another short term fix, adding the Penal Code section for continuing violations.

Gianrico Pierucci said that in a domestic violence dispute, if a person pushes first, the person could still be the victim.  Cynthia Alexis talked about a scenario where the Defendant throws a phone and the victim picked up a butter knife.  The victim could be taken into custody.

Belle Taylor-McGhee noted that she was concerned with the lack of data to the committees on this issue.  Susan Fahey pointed out that in some cases, both parties may be arrested.   Linda Klee stated that in most cases the victim would not be booked, and that she rarely sees situations where the victim is charged.   Gianrico Pierucci noted that there are cases of false reports. 

Co-Chair Ollie Sadler asked if Police resources were the only issue.  The Police may not be able to meet the timeline to review felonies in 48 hours and 24 hours if misdemeanors.

Gianrico Pierucci stated that the assigning officer contacts the victim or leaves a message and that this is part of the duty of the Inspectors on duty.

Linda Klee stated there are four (4) deputies in the Misdemeanor Domestic Violence Unit and that additional resources need to be made available.  Linda Klee stated that the District Attorney’s Office does not get victim statements in misdemeanor cases.

Susan Fahey pointed out that the recommendation was not clear on the fact that additional resources were necessary.

Belle Taylor-McGhee said that data is important. 

Linda Klee pointed out that the only time the District Attorney Investigators get involved with cases is after charging.

Gianrico Pierucci suggested another training bulletin to inform line officers.

Linda Klee emphasized that this issue was a police enforcement and arrest issue.  She said that the District Attorney’s Office doesn’t have the capacity to assist 24 hours.

Co-Chair Ollie Sadler said that she understood that the issues were “cost dependant.”

Linda Klee wanted it noted on the record that she objected to this recommendation because nothing could be done until after charging.

Susan Fahey recommended that the recommendation include verbiage on resources and that Belle Taylor-McGhee forward the recommendations on.

ITEM 4 – Feedback on Domestic Violence Statistics and Ownerships
Linda Klee noted that training for Assistant District Attorney’s has been done and a training manual is being prepared.  She noted that there are other ways to corroborate the victim’s statement and noted that there are four different tracks, not all beginning with Police arrests.  She stated that knowing who to contact and who to subpoena, makes the case better.

Because the courts are not here, it was decided to wait to discuss their ownerships until Sally Pena returned.  ECD random checking of call coding has started as well.

Mid Term Fixes
Gianrico Pierucci suggested that crime data could be collated by computers using the QALL facility.

Co-Chair Ollie Sadler suggested that all justice members use the coding recommended.  Linda Klee mentioned that she wanted to talk to Kerry Evensong.  Co-Chair Sadler said that she will draft the coding issue recommendation.  She also said that she would draft the recommendation on personal computers for police officers.

Linda Klee inquired about the Police Department’s status with the RMS system and whether incident report forms would be available to JUSTIS agencies electronically in the future.

Recommendations one (1) and two (2) have been rewritten by Belle Taylor-McGhee and staff.   Co-Chair Ollie Sadler mentioned that Kerry Evensong of the District Attorney’s Office would review the codes presented.  It was suggested that a draft recommendation regarding the Stay-Away Order system be developed.

New Item – Belle Taylor-McGhee
Belle Taylor-McGhee announced that the 3rd Anniversary of the death of Claire Joyce Tempongko will coincide with the October 22, 2003, Justice and Courage Oversight Panel meeting. 

Belle Taylor-McGhee also announced that Police Chief Alex Fagan has dedicated four (4) cadets to clearing up the Stay-Away backlog in room 475 and anticipates having the orders current in a month.
