Minutes

Present: Oli Sadler, DTIS; Bell Taylor-McGhee, Department on the Status of Women, Linda Klee, District Attorney; Kerry Dalrymple, Emergency Communications; Nixon Lazaro, Adult Probation; Lt. Bren, Sheriff;  Reg Smith, District Attorney; Justine McGonagle, Department on the Status of Women.

Chair Oli Sadler called the meeting to order at 1:14 p.m.

Item 1 – Agenda

June 18, 2003, agenda was adopted.

Item 2 - Minutes

Changes were made to the 5-21-03 minutes. The revised minutes will be available for approval at the next Data Collection Committee meeting.

Item 3 – Co-Chair

Oli Sadler mentioned that she would like to add a second chair whose duties could include reporting to the Oversight Panel but would include serving as chair of the Committee meetings when she was not present.  Oli Sadler believes that she may not make the meeting if held on July 30th.  Kerry Dalrymple of Emergency Communications was voted in as the second co-chair.

Item 4 – Gaps (short, mid and long term)

The Committee discussed and reviewed the short-term fixes.  A draft protocol of the recommendation process was handed out to Committee members.

There was a discussion around the San Francisco Police Department changing its protocol to book all misdemeanor domestic violence cases.  Belle Taylor-McGhee suggested that further legislation was possibly needed. 

There was a discussion around making a request to the Criminal Law Advisory Committee of the California Judicial Council that all domestic violence cases get booked.  This could be done by amending California Penal Code Section 853.6 (I) (1-9), and add domestic violence as a “continuing offense.”  Currently Police use Penal Code section 853.6 (I)(1-9) to arrest all misdemeanor DV cases.

There was discussion around domestic violence courts issuing flyers to victims instructing them to contact the Probation Department and the Police Department when stay away orders are violated.  Local police stations have copies of stay away orders, and hand out the flyers. Linda Klee said she did not believe legislation was necessary because the action could be defined as a “continuing offense.”

Linda Klee suggested that the committee ask the Police Department to consider a misdemeanor Domestic Violence, as a continuing offense under 853.6(I).  An alternative is to get the statute amended. 

Belle Taylor-McGhee said that she talked to Sally Pena and thought we could recommend state legislation.  Linda Klee suggested that a subsection 10 to penal code section 853.6 (I) (1-9).  Someone who has knowledge of the code section could be assigned to draft the recommendation.

Because a certain level of detail is needed with the data collection issues of the Sheriff, the Emergency Communications Department was discussed.  Oli Sadler said that the due date for discussion items was June 23rd.  Many of the recommendations will be refined.

Oli Sadler also pointed to the overarching goal, which was to put data into the domestic violence module.    Linda Klee would like to see domestic violence defined as a “continuing offense” and that this is a priority.  She mentioned that the end of January was when new legislative issues will be brought to the legislators. 

There were questions around VINE (Victim Identification Notification Everyday) and what will replace the system if VINE goes away, possibly a live person?  Belle Taylor-McGhee said that the Sheriff suggested the District Attorney’s office is the department with more contact with the victim.  The problem is that the District Attorney does not have knowledge of the defendant’s custody status, only the Sheriff’s Department does.  The Sheriff believes that the statistics on the VINE (Victim Information and Notification Emergency) may not be effective and costs over $75,000.00.   Nixon Lazarro said the Adult Probation Department has some contacts, but they are usually after sentencing.  Belle Taylor McGhee said that she will research the money issues that have arisen.    

Members of the Committee will look into different tasks around this meetings discussion.

Kerry Dalyrmple noted that the Emergency Communications Department plans to monitor random calls to get a sense for what enhancements may need to be made to the system.

Item 7 – Next meeting date & time
