CALL TO ORDER

Chair Tan called the meeting to order at 5:32PM.

ROLL CALL

Director, Jocelyn Kane called the Roll.

Present at the meeting were Commissioners, Glendon Hyde, Steven Lee, Liam Frost and Demetri Moshoyannis, Bryant Tan and Al Perez.

Audrey Joseph was absent at the time of roll call.

1. Public Comment

Members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission with respect to agenda items, members of the public may address the Commission for up to three minutes at the time such item is called.

3. Report from Executive Director Legislative/Policy Update: Late Night Transportation Task Force Update, New Year’s Eve preparations. Staff and Office Update: Update on Annual Report; City Hall fellows proposals; Corrective Actions: Nothing to Report. Report from the Sound Inspector’s Sean Burke and Jordan Pauley report on recent venue sound inspections and report of activities by staff. [Discussion Item]

Inspector Sean Burke reported on the following:

INCIDENTS
11/15/14 1:20 AM The Parlor 2801 Leavenworth. Large fight started inside. Event was shut down and patrons ejected. Fighting continued in the street. Operator called SFPD for assistance. Meeting scheduled with operators for 11/19/14 to discuss security procedures and processes.
11/15/14 1:55 AM Atmosphere 447 Broadway. Fight started outside. Began again in parking lot.

INSPECTIONS
11/15/14 10:00 AM Laguna Cafe 1821 Haight. Found level of music to be reasonable, even with doors open. My findings are contrary to what has been reported by SFPD. Will continue investigating.

Inspector Jordan Pauley reported on the following:

INSPECTIONS
11/14/14 9:30 PM Mr. Smith’s 34 7th St.: A routine inspection was performed. The venue didn’t have their entertainment commission permit available. Will follow up.
11/16/14 9:30 PM The Cellar 685 Sutter St.: Performed a let-out inspection to ensure that the venue was obiding by the good neighbor policy. A busy night, the security team was able to disperse the crowd by 2:05 a.m. Added security members observed.

SOUND INSPECTIONS
11/8/14 11:30 PM The Fillmore 1805 Geary Blvd.: A comprehensive sound test is in the process of being completed (public request). Findings will be reported at a later date.

COMPLIANCE
11/14/14 10:25 PM Harper & Rye 1695 Polk St.: Congregations of people were overloading the sidewalk on Clay Street, violating both the good neighbor policy and a verbal agreement. A warning was issued. No further issues observed.

VIOLATIONS:
11/15/14 11:00 PM Taverna Aventine 582 Washington St.: The bar had a private DJ playing through his own speakers. The disturbance was the result of a breakdown in management communications. After having to return a half hour after fielding the first noise complaint, a notice of violation was warranted.

Deputy Director Cammy Blackstone stated the Entertainment Commission held a Limited Live Performance workshop called “Just Add Music” She added it was great information and was videotaped by SFGTV and will be made available on the Entertainment Commission website.

4. Police Department Comments & Questions. [Discussion Item]
(This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety).

No police comments were made.

Commissioner Hyde requested it would be nice to hear from various departments of SFPD once a month to give the Commission the context of what they go through.

Lt. Dave Falzon stated he was recently reassign to the ABC Liaison Unit stated it was a great idea and he would take it back to the command staff for discussion.
Chair Tan suggested it would be helpful to have topics for discussion.

5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

a) EC-1273, Larry Livingston dba, The Basement 222 Hyde St. Place of Entertainment Permit (continued from 11/4/2014).

The applicants requested a continuance to December 2, 2014 meeting to allow for more time for public outreach.

Commissioner Hyde moved to continued item a) to the December 2, 2014 commission meeting Commissioner Frost second the motion.

b) EC-1272 Edward Sirias dba Oye Managua
3385 Mission St. Limited Live Performance Permit. (continued from 11/4).

Commissioner Hyde moved to approve with the GNP & police conditions strike all of the SFPD conditions amend condition 8 (if they have any celebration or special entertainment events one week in advance party notify Ingleside station Commissioner Frost second the motion.

c) EC-1276 Paul McAleese, dba Kell’s 30 Jackson St. Limited Live Performance Permit.

Officer Mathias stated Central station is recommending approval and feels the good neighbor policy will take care of any issues they had. He added Central station would like to be notified of any special events.

Commissioner Hyde moved to approved Commissioner Perez second the motion.

e) EC-1278 Jawad Swirky dba Fog Lifter Café 1901 Ocean Ave. Limited Live Performance Permit.

Stefano Castalano stated the venue was a nice Cheers environment and an opportunity to create something special.

Commissioner Lee moved to approve Commissioner Moshoyannis second the motion.

Same house same call.

6. Commissioner Comments & Questions. [Discussion item]

Commissioner Moshoyannis asked what was the status of the report of the Office Economic Analysis on Outdoor events.

Director Jocelyn Kane stated the report was still pending and a draft was on the Controller’s desk.

Commissioner Hyde stated trans activist Leslie Feinberg an activist passed away.

Commissioner Perez welcomed Commission Moshoyannis to the Commission.

8. New Business Request for Future Agenda Items. [Action item] (This item is to allow Commissioners to introduce agenda items for
future consideration).

No new future business items were discussed.
