            (The public is now welcome to address the Commission regarding items that do not appear on tonight’s agenda but that are within the subject matter jurisdiction of the Commission.  Speakers shall address their remarks to the Commission as a whole and not to individual Commissioners or Department or OCC personnel.  Under Police Commission Rules of Order, during public comment, neither Police or OCC personnel, nor Commissioners are required to respond to questions presented by the public but, may provide a brief response.  Individual Commissioners and Police and OCC personnel should refrain, however, from entering into any debates or discussion with speakers during public comment.  Please limit your comments to three (3) minutes.)

3.         Discussion and possible action to interpret Interim Rules and Procedures for Patrol Special Officers and Their Assistants regarding ability of Patrol Special Officer Serge White to sponsor an application by an Assistant Patrol Special Officer (ACTION)

 

4.         Public comment on all matters pertaining to Item 6 below, Closed Session, including public comment on vote whether to hold Item 6 in closed session.

 

5.         Vote on whether to hold Item 6 in Closed Session, including vote on whether to assert the attorney-client privilege with regard to Items 6(d) and 6(e) (San Francisco Administrative Code Section 67.10) (ACTION)

                        PERSONNEL EXCEPTION:   Assignment of Disciplinary Charges filed in Case No. JWA C11-194/IAD 2010-0210 to a Commissioner for taking of evidence on a date to be determined by the Commissioner (ACTION)

 

            b.         Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative       Code Section 67.10(b) and Penal Code Section 832.7:

                        PERSONNEL EXCEPTION:   Assignment of Disciplinary Charges filed in Case No. ALW C11-211 to a Commissioner for taking of evidence on a date to be determined by the Commissioner (ACTION)

 

c.         Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative       Code Section 67.10(b) and Penal Code Section 832.7:

                        PERSONNEL EXCEPTION:   Withdrawal of an Appeal of the Chief’s Suspension filed in Case No. ALW D10-231 (RECEIVE & FILE)

 

d.         Pursuant to Government Code Section 54956.9(a) and San Francisco

Administrative Code Section 67.10(d)(1):

CONFERENCE WITH LEGAL COUNSEL:  Existing litigation:

Jane Warner v. City and County of San Francisco, Worker’s Compensation Appeals Board Case No. ADJ7115612 (filed 1/12/10) and No. ADJ7778316 (filed 5/6/11) (DISCUSSION)

                       

e.         Pursuant to Government Code Section 54956.9(b)(1) & (b)(3)(B) and San Francisco

Administrative Code Section 67.10(d)(2):

CONFERENCE WITH LEGAL COUNSEL:  Anticipated litigation as defendant

Discussion with counsel on anticipated litigation; possible action to recommend that the Board of Supervisors approve request for advance approval of Federal Rules of Civil Procedure Rule 68 Settlement Offer or to take other action (DISCUSSION& POSSIBLE ACTION)
