JANUARY 23, 2013 REGULAR MEETING

 

The Police Commission of the City and County of San Francisco met in Room 400, City Hall, #1 Dr. Carlton B. Goodlett Place, San Francisco, at 5:40 p.m.

PRESENT: Commissioners Mazzucco, Marshall, Chan, Kingsley, Turman, Loftus

ABSENT: Commissioner DeJesus

PRESENTATION OF CERTIFICATES OF APPRECIATION

- Mr. Awinn J. Swann, Mr. Mario Jimenez, & Mr. Darryl Mickens

Captain Corrales, Park Station, read the summary of the incident. Chief Suhr then presented the Certificates of Appreciation to Mr. Swann, Jimenez, and Mickens.

PUBLIC COMMENT

Ace Washington discussed concerns regarding a homicide in his community and the Commission having a meeting about tasers in his community and served notice that the African-American community is in a state of emergency.

Urban Solution 6

 

th Street resident spoke in regards to the 6th Street community and talked about bringing new business into the 6th Street community. She asked for help to sustain safety on 6th Street. (document submitted)

 

Elen, Project Manager Urban Solution, spoke in regards to concerns of good business prospects being discouraged in the 6

 

th Street corridor. She went on to read a letter from one of the merchants asking for support and presence from the police department and urged opening of the substation. (letter submitted)

 

Nicholas Renault spoke in regards to attending the community meeting regarding tasers last night. He stated that the Department does need something between stop, put that gun down. He went on to thank the Chief and the Commission for asking the community for their opinions.

Mr. Abilin, 6

 

th & Minna, discussed comments made by tourists about the area of 6th and Minna. He also discussed concerns of people standing around the Rose Hotel.

th Street small business owner stated that the merchants are working hard to bring respect to the area and asked for help and support from the police department.

 

Rakesh Modi, OMG on 6

 

th Street, stated that they found it challenging to open the business and that people are still afraid to come to 6th Street and stated that that issue has to be addressed. He asked for support from the SFPD and urged that the substation be opened. He also asked for more light on 6th Street.

 

Sobi, Sonoma Market on 6

 

th Street, spoke in regards to aggressive panhandlers and how they use the streets as a bathroom and asked for help from the Department and hopes that the substation open soon.

 

Unidentified spoke in regards to trying to get a job and how the city can help. He went on to talk about tasers and asked why the police need more weapons.

Ted Cortell, Monarch at 6

 

th and Mission, spoke in regards to encouraging small businesses in the 6th Street corridor and stated that his business have put up lights and security around his business and stated that he is willing to help work with the police department.

 

Mott Sevilla, Ponzo Pizza, echoed the different concerns of fellow business owners and discussed safety concerns around in the 6

 

th Street corridor. He asked for a consistent presence and maybe have a first name basis relationship with the Department and the merchants.

 

Chief Suhr stated that the substation will be activated by the end of the month and stated that the Market Street foot beat will be increased.

Commissioner Mazzucco thanked all the 6

 

th Street merchants who attended.

 

REPORTS AND ANNOUNCEMENTS

a. Chief’s Report

- Review of recent activities

- Presentation of the annual report regarding the Department’s work with the JTTF

- Presentation on Crime Statistics Reporting/CJCJ Report

Chief Suhr reported on recent two homicides in the city. He went on to talk about recent win by the 49ers and spoke of incidents in the Mission District after the championship game. The Chief went on to give a brief update on crime statistics.

Deputy Chief Loftus presented the annual report regarding the Department’s work with the JTTF.

Deputy Chief Tomioka commended Director Giffen and her team for their work with crime statistics. She went on to talk about statistics on crime trends.

Director Susan Giffen presented the Crime Statistics Reporting. She went on to thank Lt. Dave Hardy of the Sheriff’s Department for his help in the data collection.

Selena Teji, Center on Juvenile & Criminal Justice (CJCJ), presented their report titled, "San Francisco Drug Arrest Trends."

b. OCC Director’s Report

- Review of recent activities

Director Hicks reported on recent activities and talked about the NACOLE conference in September. Director Hicks went on to talk about outreach and mediation.

Commissioner Mazzucco had nothing to report.

Commissioner Marshall gave a brief update in regards to his recent trip to the White House in regards to fact finding about gun violence. He stated that a lot of ideas were put on the table. He stated that he is actually going back next week on Monday and Tuesday.

Commissioner Loftus gave a brief update in regards to the community meeting about tasers last night. She announced the next meeting on Feb 4

 

th at the Scottish Rites and on Feb 11th at the Bayview Opera House.

 

d. Commission Announcements and scheduling of items identified for consideration at future Commission meetings

District Meeting will be in the Northern on Feb 27

 

th, St. Vincent DePaul, starting at 6 p.m.

 

Commissioner Kingsley would like a presentation by the Department regarding gun violence.

PUBLIC COMMENT

Zoey Holt, Attorney from Human Rights Commission, spoke in regards to the meeting with the Human Rights Commission regarding the CJCJ report.

Tina Sahan, Coalition for Safe San Francisco, spoke in regards to the relationship between the SFPD and the FBI and spoke of the Ordinance passed by the Board of Supervisors and signed into law by Mayor Lee. She went on to discuss concerns that they are not notified that this report will be presented and the report’s lack of information.

Nadia, Coalition for Safe San Francisco, discussed disappointment about lack of notification of this report and concerns about substance of the report.

Rachel Roberts, Council on American Islamic Relations, discussed concerns about receiving notice for this report. She discussed concerns of her clients regarding being questioned by the FBI.

nd Chance Coordinator, discussed concerns about disproportionate arrests of African Americans.

 

Michaela Davis, ACLU, thanked the Commission for having the community meeting regarding tasers. She went on to talk about looking at racial disparities in the criminal justice system.

DISCUSSION AND POSSIBLE ACTION TO APPOINT MOISES ROMERO AS ASSISTANT PATROL SPECIAL OFFICER TO PATROL SPECIAL OFFICER CALVIN WILEY

Sergeant Jusino presented the follow-up answers to the Commissioners’ questions.

RESOLUTION NO. 13-4

APPROVAL TO APPOINT MOISES ROMERO AS ASSISTANT PATROL SPECIAL OFFICER TO PATROL SPECIAL OFFICER CALVIN WILEY

RESOLVED, that the Police Commission hereby approves the appointment of Moises Romero as Assistant Patrol Special Officer to Patrol Special Officer Calvin Wiley.

AYES: Commissioners Mazzucco, Marshall, Kingsley, Turman, Loftus

NAYS: Commissioner Chan

ABSENT: Commissioner DeJesus

DISCUSSION AND POSSIBLE ACTION TO RECOMMEND THAT THE BOARD OF SUPERVISORS ADOPT A RESOLUTION RETROACTIVELY APPROVING THE AGREEMENT BETWEEN THE SAN FRANCISCO POLICE DEPARTMENT AND THE SAN FRANCISCO HOUSING AUTHORITY FO THE POLICE DEPARTMENT TO PROVIDE SUPPLEMENTAL LAW ENFORCEMENT SERVICES AT DESIGNATED HOUSING AUTHORITY DEVELOPMENTS AND FOR THE HSOUING AUTHORITY TO PAY THE CITY $1,000,000 IN FISCAL YEAR 2011-2012 FOR THOSE SUPPLEMENTAL LAW ENFORCEMENT SERVICES, OR TO TAKE OTHER ACTION REGARDING THE PROPOSED RESOLUTION OR CONTRACT

Commander Orkes asked the Commission to urge the Board of Supervisors to adopt the resolution.

RESOLUTION NO. 13-5

APPROVAL OF THE REQUEST OF THE CHIEF OF POLICE TO RECOMMEND THAT THE BOARD OF SUPERVISORS ADOPT A RESOLUTION RETROACTIVELY APPROVING THE AGREEMENT BETWEEN THE SAN FRANCISCO POLICE DEPARTMENT AND THE SAN FRANCISCO HOUSING AUTHORITY FOR THE POLICE DEPARTMENT TO PROVIDE SUPPLEMENTAL LAW ENFORCEMENT SERVICES AT DESIGNATED HOSUING AUTHORITY DEVELOPMENTS AND FOR THE HOUSING AUTHORITY TO PAY THE CITY $1,000,000 IN FISCAL YEAR 2011-2012 FOR THOSE SUPPLEMENTAL LAW ENFORCEMENT SERVICES

RESOLVED, that the Police Commission hereby approves the request of the Chief of Police to recommend that the Board of Supervisors adopt a resolution retroactively approving the agreement between the San Francisco Police Department and the San Francisco Housing Authority for the Police Department to provide

supplemental law enforcement services at designated Housing Authority developments and for the Housing Authority to pay the City $1,000,000 in Fiscal Year 2011-2012 for those supplemental law enforcement services.
