August 27, 2014

AUGUST 27, 2014 REGULAR MEETING
The Police Commission of the City and County of San Francisco met in Room 400, City Hall, #1 Dr. Carlton B. Goodlett Place, San Francisco, at 5:30 p.m.

PRESENT: Commissioners Mazzucco, Turman, Marshall, DeJesus, Loftus, Hwang, Melara

(Commissioner Loftus arrived at 6:50 p.m.)

PUBLIC COMMENT

Michael Welsh, SF resident, spoke in regards to a civil harassment complaint that he filed with the court regarding a restraining order. He stated that the person continues to harass him and that he is not getting any help from the police.
Reuben Goodman presented a rose to newly appointed Commissioner Melara. He went on to recommend commendations to some of the officers working at the Richmond Station.
Retired Inspector Tapia spoke in regards to Garfield Park and commended the Chief for what the Department is doing at Garfield Park.
Maria, Justice for Alejandro Nieto, expressed disappointment for not seeing the Commission at the rally and spoke of contradictions with the statements made by the Chief at the town hall meeting and expressed concerns that the officers are back on the streets and how the names of the officers have not been released.
Andrea Camerina, Justice for Alejandro Nieto, asked if this case is a high priority with the commission and spoke of witnesses at the incident and asked if the Commission will investigate cover-up of facts in the case.

REPORTS AND ANNOUNCEMENTS
a. Chief’s Report
- Review of recent activities

Chief Suhr gave a brief update in regards to violent crime statistics. He spoke of recent DV homicide on Peralta Street. He also spoke of an incident where a two-year old was hit by a vehicle. He also announced that 50 members of the Department have been promoted.

b. OCC Director’s Report
- Review of recent activities

Director Hicks reported on outreach activities to agencies looking at civilian oversight. She stated that Donna Salazar spoke to the group in regards to mediation. She also spoke of Ms. Marion’s involvement with Commissioner Marshall’s radio program. Director Hicks also gave a brief update on case status, mediation, and the upcoming NACOLE conference in Kansas City, Missouri, starting on September 4th, where use of excessive force and the militarization of police will be discussed.

Commissioner Mazzucco reported attending the graduation of the SF Police Academy where 34 recruits graduated.

Commissioner Melara reported attending the meeting at the Mayor’s Office in regards to “Road to Peace,” addressing violence in the Mission District.

Commissioner Hwang reported attending several promotional dinners and of attending a meeting chaired by Captain Cherniss, and attending a public safety meeting chaired by Captain Lazar in regards to the Chinatown community. He also announced that on Sept 4th the Central Station will have a Local Night Out.

Commissioner Marshall thanked Samara Marion and Patty Lee for coming on the show on Sunday in regards to citizen’s encounter with police.

d. Commission Announcements and scheduling of items identified for consideration at future Commission meetings

Inspector Monroe announced that the next meeting will be on September 4th and will be in the Central on September 24th.

Commissioner DeJesus stated that she will be out of the country from September 13th to October 2nd.

PUBLIC COMMENT
Emile Lawrence asked regarding meetings cancelled this year.

STATUS UPDATE RE: REVISED DEPARTMENT GENERAL ORDER 6.09, “DOMESTIC VIOLENCE”

Chief Suhr stated that on July 22nd the draft of the DGO was sent to the OCC.

Captain McFadden presented the status update of revised DGO 6.09. He stated that they are just waiting for Samara Marion for her input to go forward with the DGO.

Ms. Beverly Upton stated that there are still some concerns about the involvement of Child Protective Services. She thanked everybody that worked on this policy but there are still a few issues and concerns that need to be ironed out before it goes before the Commission for adoption.

PUBLIC COMMENT
Minoosh Kendal, Department on the Status of Women, thanked Captain McFadden and Sgt. Kilshaw for their work with this policy and went on to suggest that the term “criminal threats defined by the California Penal Code” be spelled out to explain what are threats of bodily injury or threats to kill as opposed to criminal threats.

APPROVAL OF THE AWARDS COMMITTEE RECOMMENDATIONS

RESOLUTION 14-40

AWARDS GRANTED TO MEMBERS OF THE POLICE DEPARTMENT

WHEREAS, the following named members of the Police Department are commended for courageous service under the provisions of General Order 3.09, Section I.A.1 of the San Francisco Police Department, as approved by the Awards Committee on July 14, 2014; and

WHEREAS, Chief of Police Gregory P. Suhr has recommended to the Police Commission that the said members be rewarded under the provisions of Section 8.405(a)(4) of the Charter of the City and County of San Francisco; and

RESOLVED, Lieutenant Gaetano Caltagirone, Sergeants Arran Pera, Dennis O’Mahony, Officers James Cunningham, Derrick Lee, Stuart Molver, Antonette Valenzuela, and Officer Donald McIntyre are hereby awarded the Gold Medal of Valor and granted a reward of $1500.00, as provided under said section of the Charter; and be it further

RESOLVED, that Captain Timothy Oberzeir, retired Lieutenant Dave Johnson, Sergeants Walter Ware, Ron Liberta, Neil Cunningham, Officers Matthew Lobre, Shante Williams, Ryan Daugherty, Valerie Durkin, Aaron Cowhig, Gregory Latus, David Sands, John Cathey, Chris Costa, Cody Barnes, Alane Baca, Andrea Joseph, John Glynn (retired), Michael Keane, Stephen Kirwan, Jeff Brown, Jon Rochlin, Sanjay Shastri, Robert Toomey, Angel Poon, Tauvaa Johnson are hereby awarded the Silver Medal of Valor and granted a reward of $1000.00, as provided for under said section of the Charter; and be it further

RESOLVED, that Sergeant Matthew Mason, Officers Patrick Brady, Ryan Doherty, Edrick Talusan, Thomas Ly, Kevin Rightmire, Alvaro Mora are hereby awarded Bronze Medals of Valor and granted rewards of $500.00 each, as provided for under said section of the Charter; and be it further

RESOLVED, that Sergeants Matthew Sullivan, Dominico Discenza, Sean Frost, Michael Wibunsin, Patrick Griffin, Leonard Poggio, Christopher Canning, Michael Moody, Matthew Mason, Inspectors John Peterson, Thomas Maguire, Officers Matthew Friedman, Reginald Prasad, Robert Deleon are hereby awarded the Meritorious Conduct Award and granted rewards of $200.00 each, as provided for under said section of the Charter.
