OCTOBER 8, 2014 REGULAR MEETING
The Police Commission of the City and County of San Francisco met in Room 400, City Hall, #1 Dr. Carlton B. Goodlett Place, San Francisco, at 5:30 p.m.

PRESENT: Commissioners Loftus, Turman, Mazzucco, Marshall, DeJesus, Hwang, Melara

PRESENTATION OF CERTIFICATES OF APPRECIATION
- Mr. John Girarde
- Mr. Kyle Mizokami

Captain Perea, along with Commissioner Mazzucco and Chief Suhr, presented the certificates to Mr. Girarde and Mr. Mizokami.

CONSENT CALENDAR
- Police Commission Report of Disciplinary Actions – 3rd Quarter 2014
- Request for approval to accept gifts of 50 books, titled “Give and Take,” valued at approximately $400.00, from an anonymous donor for use by the members of the Department

Motion by Commissioner Marshall, second by Commissioner Mazzucco. Approved 7-0.

RESOLUTION NO. 14-47

APPROVAL TO ACCEPT GIFTS OF 50 BOOKS, TITLED “GIVE AND TAKE,“ VALUED AT APPROXIMATELY $400.00, FROM AN ANONYMOUS DONOR FOR USE BY THE MEMBERS OF THE DEPARTMENT

RESOLVED, that the Police Commission hereby approves the request of the Chief of Police to accept donation of 50 books, titled “Give and Take,” from an anonymous donor for use by the members of the Department.

PUBLIC COMMENT

Jakkee Bryson asked for more officers for the Tenderloin District. She discussed concerns regarding illegal drug activities at a bus stop located at 445 O’Farrell Street and how people cannot use that bus stop. Ms. Bryson also commended Captain Cherniss for his help in removing garbage bins.
Emile Lawrence spoke in regards to memo written by Captain Perea and went on to talk about article written in regards to incident involving Alex Nieto. (submitted documents)
Clyde spoke of incidents regarding domestic violence and testing of rape kits.

Commissioner Turman addressed the audience and explained the incident of accused domestic violence against him.

Larry John Edmund Juicy spoke of an incident where a crack addicted woman attacked him and broke his arm at the Ambassador Hotel where he resides. He asked the Commission for help.

REPORTS AND ANNOUNCEMENTS
a. Chief’s Report
- Review of recent activities
- Status update regarding the Department’s Domestic Violence Unit

Chief Suhr spoke of recent activities including Hardly Strictly Bluegrass, and recent homicide, the Giants winning, the visit of VP Biden, and the arrival of President Obama on Friday, Italian Heritage on Sunday, and recent officer-involved shooting and a recent boat crash where the occupant did not survive. The Chief also announced that the town hall meeting regarding the OIS will be tomorrow at 6:30 p.m.

Captain Gracie, Special Victims Unit, presented the status update report regarding the Department’s Domestic Violence Unit.

b. OCC Director’s Report
- Review of recent activities
- Presentation of the OCC’s Statistical Reports, Summary of Cases received in September 2014, Mediation of Complaints in September 2014, Adjudication of Sustained Complaints in September 2014

Director Hicks spoke of recent activities including the role of OCC during OIS incidents and presented the OCC Statistical Reports for September 2014.

d. Commission Announcements and scheduling of items identified for consideration at future Commission meetings

Inspector Monroe announced that there is no meeting on the 15th. The next meeting will be in the Ingleside on October 22nd at the Balboa High School, Green Room, 1000 Cayuga Street, starting at 6 p.m.

DISCUSSION AND POSSIBLE ACTION TO RECOMMEND THAT THE BOARD OF SUPERVISORS APPROVE A GIFT OF A GIBBS QUADSKI XL, VALUED AT $40,000.00, FROM MR. MARC BENIOFF, FOR USE BY THE SFPD MARINE UNIT

Sergeant Matthews explained the gift of a Quadski from Mr. Benioff.

RESOLUTION NO. 14-48

RECOMMENDATION TO THE BOARD OF SUPERVISORS FOR APPROVAL TO ACCEPT GIFT OF A GIBBS QUADSKI XL, VALUED AT $50,550.00, FROM MR. MARK BENIOFF, FOR USE BY THE SFPD MARIN UNIT

WHEREAS, Mr. Mark Benioff has graciously donated a gift of a Gibbs Quadski XL, valued at $50,550.00, for use by the SFPD Marine Unit in patrolling the waters of the San Francisco Bay; and

WHEREAS, this Quadski will offer greater versatility by being able to transform from a land-based vehicle to a water craft by the push of a button; therefore be it

RESOLVED, that the Police Commission hereby recommend that the Board of Supervisors approve the gift and authorize the Chief of Police to accept this gift of a Gibbs Quadski XL for use by the SFPD Marin Unit.

DISCUSSION AND POSSIBLE ACTION TO ADOPT REVISED DEPARTMENT GENERAL ORDER 6.09, “DOMESTIC VIOLENCE,” OR TAKE OTHER ACTION, IF NECESSARY

Captain McFadden and Sgt. Kilshaw presented revised Department General Order 6.09, “Domestic Violence.”

Commissioner Hwang disclosed that he works with a Domestic Violence Agency, Asian Pacific Islander Legal Outreach. API is a member of the domestic violence consortium. He stated that there is no conflict on his part.

Commissioner Melara also stated that she works with a program that deals with families that have experienced domestic violence in 80 percent of the cases. She stated that there is no conflict on her part.

John Sutikawa, CPS agency, spoke of the duties and responsibility of the Children’s Protective Services agency.

PUBLIC COMMENT

Adele, Director of SF Youth Commission, discussed concerns regarding the role of CPS and training of officers.
David, Youth Commissioner, asked for clear data collection.
Joanne Woo, Youth Commissioner, asked to implement training for officers working with juveniles.
Michelle Lee, Youth Commissioner, asked the Chief to review data in six to 12 months and that SFPD work with FCS.

Chief Suhr will give an update in six months.

Emile Lawrence stated that the Department needs rules that they can understand.
Commissioner Andrea Shorter, VP of Commission on the Status of Women, thanked the Department for the work done in regards to safety of children.
Beverly Upton, Executive Director of SF Domestic Violence Consortium, spoke of how proud she is of DGO 6.20 but there are still concerns about when to involve CPS in domestic violence cases and the mistrust with the involvement of CPS/FCS.
Norio, Community Against Violence, stated that the agency has concerns about the policy as it is written and concerns specifically with Rule G(6) & (7).
Kathy Baxter, Director Child Abuse Council, would like to talk about Family Violence stated that the Department has to be clear with first responders when they go into a home and there are children. She stated that there is no MOU between family and children and the police department.
Kathy Black, Executive Director Casa De Las Madres, stated that she is in support of the policy and thanked Captain McFadden and Sgt. Kilshaw for their hard work.
Arte, Attorney at Asian Pacific Island Legal Outreach, thanked Captain McFadden and Sgt. Kilshaw for their work and spoke of provision G and spoke of concerns regarding CPS/FCS.
Paul Henderson, Mayor’s Office, thanked the Commissioners and the Chief for this policy and supports the Commission’s vote.

Motion by Commissioner Turman, second by Commissioner Melara. Approved 7-0.

RESOLUTION NO. 14-49

ADOPTION OF REVISED DEPARTMENT GENERAL ORDER 6.09, “DOMESTIC VIOLENCE”

RESOLVED, that the Police Commission hereby approves to adopt revised Department General Order 6.09, “Domestic Violence,” draft dated 10/1/14.

DISCUSSION AND POSSIBLE ACTION TO ADOPT DEPARTMENT GENERAL ORDER, 6.20, “MEMBER-INVOLVED DOMESTIC VIOLENCE,” OR TAKE OTHER ACTION, IF NECESSARY

Captain McFadden and Sgt. Kilshaw presented DGO 6.20, “Member-Involved Domestic Violence.”

PUBLIC COMMENT
Beverly Upton commended work with Captain McFadden and Deputy Chief Tomioka on this policy and express support for this DGO.
Jakkee Bryson commended everyone who worked on this DGO.
Norio thanked the Department for this policy.

Motion by Commissioner Melara, second by Commissioner Turman. Approved 7-0.

RESOLUTION NO. 14-50

ADOPTION OF DEPARTMENT GENERAL ORDER 6.20, “MEMBER-INVOLVED DOMESTIC VIOLENCE”

RESOLVED, that the Police Commission hereby approves to adopt Department General Order 6.20, “Member-Involved Domestic Violence,” draft dated 10/8/14.
