The Police Commission of the City and County of San Francisco met via videoconference at 5:36 p.m.

                PRESENT:             Commissioners Taylor, DeJesus, Elias, Brookter, Hamasaki

                ABSENT:               Commissioners Cohen

REPORTS TO THE COMMISSION

a.            Chief’s Request

-              Weekly crime trends

-              Major/Significant Incidents

-              Presentation of the SB 1421 Monthly Updates

-              Presentation of the monthly Collaborative Reform Initiatives “CRI” Updates

-              Presentation regarding Data Driven Prevention and Intervention Strategies               

                Chief Scott reported on crime trends:  Part 1 crimes:  down 37 percent; burglary up 42 percent; larceny down 39 percent; auto burglary down 51 percent; violent crimes down 19 percent; homicide up 30 percent with a total of 35 homicides year-to-date; gun violence: up 2 percent. Significant incidents:  The Chief spoke of a homicide on September 9th at the 1000 block of Oakdale and investigation is ongoing.  The Chief spoke of a shooting on September 10th in the Tenderloin area where shell casings were found in the middle of the street where an SUV drove into someone at the scene and one individual fired shots and fled.  Three victims are listed as one is critical, one is stable, and one was discharged from the hospital.  The Chief reported on the unveiling of the Black Lives Matter poster in the Bayview.               

                Lieutenant Kate Waaland presented the monthly SB 1421 monthly update.  Lt. Waaland also talked about the SB 1421 portal.

                Chief Scott reported on the monthly Collaborative Reform Initiatives Updates.               

                Director Tiffany Sutton presented the Data Driven Prevention & Intervention Strategies.

b.            DPA Director’s Report

-              Report on recent DPA activities, and announcements

-              Presentation of the 2019 Annual Report               

                Director Henderson gave an update on year-to-date stats:  581 cases opened cases and 640 closed cases year to date; 383 pending cases.  He stated that the new SB 1421 portal is now up and working.  Outreach:  Mediation brochures are now available in other languages.  Director Henderson reported that on Sept 15th, DPA hosted a virtual session on police reform and community involvement; On September 16th, DPA hosted a virtual informational session on mediation and plans to do two mediation information session a month to address community education about the division and to response to questions that have been raised about how mediation works; September 29th, DPA is hosting a virtual oversight agency panel discussion with CPCC.

                Director Henderson then went on to present the Annual Report presentation.

                Commissioner Brookter thanked the Chief, Captain Dangerfield, Command Staff, and Bayview Station staff for the unveiling of the Black Lives Matter poster for going above and beyond what was authored in the resolution.  He further thanked Commissioner Taylor for co-authoring the resolution and his fellow commissioners for the unanimous vote for the resolution.  He thanked Canin Thornton, Velma Gamera, Jermain Jones, and Tiffany Sutton for inviting him to speak on a panel regarding reforms and policies that the Commission is working on.                 

d.            Commission announcements and scheduling of items identified for consideration at future Commission Meetings.               

PUBLIC COMMENT               

                Brian spoke and read his email :  “Members of the Commission, you should all be ashamed of yourselves for your anti-police bias and total disrespect for members of your own police department.  Sgt. William (Bud) Clinton, a well-respected member of the SFPD with over 27 years of distinguished service to our city, was attacked on July 25, 2020 by a violent and dangerous man in the Park district.  Sgt. Clinton was transported to the hospital where he received treatment for a serious stab wound to his face.  Yesterday I learned that Bud that not one of you called him or his family to express your concern or inquired about his condition, even after you were notified of the incident.  I’m sure you still won’t contact him after being publicly called out.  It’s clear by your inaction that you don’t care about SFPD officers.  Any actions you do take ensure that SFPD officers are less safe when doing their job.  You’re disgraceful!”

                Mimi Klausner spoke of her complaint about the agenda and that each item should be separated on the agenda and allow the public comment on each agenda item and spoke of concerns about discipline.

                Edna spoke of the police union and that bad officers should be removed from the force and that wrong is wrong.

                Unidentified spoke of the police contract and that it should be discussed in public and spoke of conversations done behind closed doors.

                Peter spoke of the police contract and that there should be more police accountability.

                Zack, Public Defender’s Office, spoke of the DPA’s annual report and SB 1421 records.

                Johnny stated that all POA contract negotiations should be held in public.

                Unidentified, District 9, demands that all POA negotiations be held in public.

                Brian Cox, Public Defender’s Office, spoke as to why DPA is only reporting the annual report now and spoke of concerns about discipline.

                Debra spoke of all discussions regarding POA be held in open session and spoke of no accountability for murders.

                Terry spoke of transparency of POA contract negotiations and should be held in open session.

                Brad Edwards spoke of inconsistencies of report regarding the sideshows.

DISCUSSION AND POSSIBLE ACTION TO ADOPT REVISED DGO 5.23, “INTERACTIONS WITH DEAF AND HARD OF HEARING INDIVIDUALS.”  MEET AND CONFER DRAFT WAS APPROVED BY THE COMMISSION ON JULY 15, 2020

                Motion by Commissioner DeJesus, second by Commissioner Brookter.  Approved 5.0.

RESOLUTION 20-59

ADOPTION OF DEPARTMENT GENERAL ORDER 5.23, “INTERACTIONS WITH DEAF AND HARD OF HEARING INDIVIDUALS”                         

            RESOLVED, that the Police Commission hereby adopts attached draft dated July 2, 2020, of Department General Order 5.23, “Interactions with Deaf and Hard of Hearing Individuals.”

                Magick Altman spoke of witnessing harass homeless people and spoke of the Mario Woods decision that took five years and spoke of what causes violence.

                Peter to demand all negotiations with the POA be held in open session.

                Unidentified spoke that the POA negotiations happen in public.

                Brian Cox spoke of approval of DGO 5.03 and going into meet and confer and what’s the delay in approval of the policy.

                Unidentified demand that all POA negotiations be held in open session.

                District 9 caller demand that all POA negotiations be held in open session.

                SF Resident stated that he will keep calling in.

                Jessica called to demand that all negotiations regarding POA be held in open session.

                Cindy called to demand that all negotiations regarding POA be held in open session.

                District 5 resident spoke that everything should be held publically and that police should be disarmed and disbanded.

                Unidentified spoke of concerns.

                Unidentified spoke of holding contract negotiations with the POA.                               

PUBLIC COMMENT ON ALL MATTERS PERTAINING TO CLOSED SESSION               

                Magick Altman spoke of opening closed session and not holding POA negotiations in closed session.

                Unidentified spoke of how confused she is and that she is frustrated.

                Peter thanked the Commission for clarifying the process and that the public should hear discussion with negotiator.

                Unidentified asked that the Commission discuss with the public why they are meeting in closed session.

                Simone spoke of how confused he is and that he doesn’t care about reform and all he cares about is debanding the police and he does not care what’s on the agenda and just want to hear what is discussed in closed session.

                Lawrence, District 9, to vote that closed session items be held in open session.

                Unidentified, District 5, spoke of transparency and negotiations behind closed doors.
