MINUTES OF SPECIAL MEETING

1. Call to Order and Roll Call

The meeting was called to order by Chair William L. Lee at 9:40 a.m.

2. Discussion and Action Regarding Allocation of Real Estate Fraud Prosecution Trust Fund

Mr. Lee asked Deputy City Attorney Baumgartner to explain the rules governing allocation of the Real Estate Fraud Prosecution funds. Ms. Baumgartner stated that the rules are mandated by the State; that there is an administrative fee of 10% that is allocated to the Assessor/Recorder Office ($2.00) per recorded document), 60% to be allocated to the District Attorney's Office and 40% to be allocated to the Police Department. These allocations are subject to review by this committee.

Fred Garcia appeared for the Recorder and answered questions pertaining to recordation fees and the administrative time required to process the documents

Police Lt. Tom Bruton, Fraud Division and Captain John Ehrlich, Investigations Unit appeared on behalf of the Police Department. Lt. Bruton explained that the Police Department wanted to use the funds for investigation of fraud cases and preventive activities.

Mr. Lee moved that for the 2001-2002 budget year, the Committee allocate 10% of the Real Estate Prosecution Fund to the San Francisco Assessor/Recorder Office, 60 % to the San Francisco District Attorney's Office and 40% to the San Francisco Police Department. Seconded by Ms. Baumgartner, the motion was unanimously adopted.


3. ADJOURNMENT
Mr. Lee adjourned the meeting at 10:00 a.m.
