ASSESSMENT APPEALS BOARD

JOINT MEETING OF

ASSESSMENT APPEALS BOARDS NO. 1 and 2

Pursuant to Administrative Code Section 2B.6

MONDAY, NOVEMBER 3, 2003

9:30 A.M.

CITY HALL, ROOM 406

  1. Roll Call.

2.   Selection of a Chairperson for the Joint Meeting.

3.   Public Comment (for items on the agenda as well as items not on the agenda but under the jurisdiction of the Boards).

4.   Presentation by the Assessor’s office of proposed changes to the City and County of San Francisco Administrative Code Section 2.B, adding sections 2B.21 (Production and Inspection Demand Procedures per Revenue & Taxation Code §441) and 2B.22 (Pre-Hearing Conferences per Property Tax Rule 305.2) for the Assessment Appeals Board. (See attachment #1).

5.   Assessor office to speak on what legal and/or local enforcement entitles the Assessor to physically inspect property for purpose of assessment.

6.   Reports from AAB legal counsel, Marie Blits and Dorji Roberts, regarding:

  • Applicability of Revenue & Taxation Code §441 as it relates to real property.
  • 3-person panel versus 1-person panel for the purpose of Prehearing Conferences per Property Tax Rule 305.2.

7.   Administrative Reports on the following:

  • Survey of other counties’ interpretation of establishing and implementing Prehearing Conferences in accordance with Property Tax Rule 305.2 (in conjunction with Legal Counsel)
  • 1st quarter 2003/2004 activity report.
  • Current caseload and number of appeals facing deadlines in September 2004.
  • Pending appeals exceeding $100 million in assessed value.

8.    Open discussion regarding other local procedural rules for the Assessment Appeals Board.

9.    Public Comment (for items on the agenda as well as items not on the agenda but under the jurisdiction of the Boards).

10.    Adjournment.
