When the Board convened today for the continued hearing on these matters, the taxpayer’s agent filed an objection to Board Member Alec Lambie sitting on this panel, due to Mr. Lambie’s involvement with managing the campaign of a candidate running for office of the Assessor in the March 2002 election. Without acknowledging whether or not the objection met the requirements of Revenue and Taxation Code §1624.4, Mr. Lambie recused himself from the panel. After reviewing all of the previously submitted correspondence from the taxpayer’s agent regarding this issue, Board Member Peter Fatooh commented on the credibility of the agent, and then recused himself from the hearing panel for that reason as well.
The record reflects that the administrator will need to seat two new board members for this panel. Discussion was held with the parties as to how the evidentiary hearing for these applications will proceed, including whether the parties will stipulate to having the new board members listen to the previous hearing tapes and review the evidence already under submission.
There being no further business, the Board, at the hour of 10:42 a.m., recessed to reconvene Tuesday, January 15, 2002 at 1:30 p.m.
