ASSESSMENT APPEALS BOARD

In the meeting of Assessment Appeals Board Number 1 for the City and County of San Francisco on Wednesday, March 9, 2005 at 9:45 a.m.

Having no public comment and with the below listed applicant being present and heard, the Board continued its evidentiary hearing on merits of valuation affecting the various roll years at issue. Applicant’s representative, Peter Kanter, completed his cross-examination of John Clifford, MAI appraiser and witness for the Assessor. The Board then heard redirect testimony from Mr. Clifford for the Assessor, followed by cross-redirect by Mr. Kanter of Mr. Clifford.

Following the testimony of Mr. Clifford, the Board heard testimony from Alex Tharayil, Chief Appraiser, representing the Assessor. At the hour of 11:20 a.m. the Board went into closed session to deliberate the relevance and admission of Assessor’s Exhibit Q into the record as evidence. The Board reconvened in open session at 11:30 a.m. and ruled in favor of the Applicant, determining that Assessor’s Exhibit Q will not be admitted as evidence for these proceedings. A motion was made by the Applicant to seal Exhibit Q as a confidential document so it is not made available to the public. The Assessor did not oppose Applicant’s motion. The Board determined that Assessor’s Exhibit Q was confidential in nature, and as such sealed the document from public access. After Mr. Kanter began his cross-examination of Mr. Tharayil, the Board took certain action, as specified under this date, on the original applications:

The Assessment Appeals Board reconvened at the hour of 1:37 p.m.

The Board convened in open session, and with all the parties present from the morning session, the Board continued to hear the Assessor’s redirect testimony from Mr. Tharayil. The Board then heard testimony from the Assessor’s next witness, Mr. Bill Rhoda, a sports industry consultant, followed by cross-examination of Mr. Rhoda by Mr. Kanter, applicant’s representative. After hearing the Assessor’s redirect testimony from Mr. Rhoda, the Board took certain action, as specified under this date, on the original of the respective application:
