ASSESSMENT APPEALS BOARD

In the special meeting of Assessment Appeals Board Number 3 of the City and County of San Francisco, Friday, August 22, 2003 at 9:32 a.m.

Present: Diane Robinson, Donald Kavanagh and Donald Schmidt

Quorum present

Chairperson: Diane Robinson, Presiding

The Board held a special meeting to discuss and possibly take action regarding the Board’s consideration of taking notice of public data that is contained and published by the National Council of Real Estate and Fiduciaries, also known as NCREIF, regarding discount rates for apartment complexes nationwide as it relates to the following application numbers:

88-0144 through 88-0157; 89-0438 through 89-0449 and 89-0451; 90-0464, 90-0465 and 90-0467 through 90-0476; 91-0580 through 91-0592; 92-0726 through 92-0738; 93-6487 through 93-6496; 94-2125 through 94-2137; 94-2570 through 94-2582; 95-1713 through 95-1725; 95-1726 through 95-1738; 96-1949 through 96-1961; 97-0262 through 97-0274; 98-0969 through 98-0980; 99-0568 through 99-0579; 00-0541 through 00-0549; 01-0652 through 01-0660; and 02-2198 through 02-2200.

All applications filed by Robert S. Beach and/or Rod Divelbiss, agent/attorney at the time of filing, on behalf of various applicants as listed below:

At the hour of 9:45 a.m., following open discussion on this matter, the Board convened into closed to further review and deliberate the issue of taking notice of the NCREIF public data. At the hour of 11:46 a.m., the Board reconvened in open session and announced its decision not to take notice of the NCREIF public data.

There being no further business, the Board, at the hour of 11:51 a.m., recessed to reconvene Wednesday, August 27, 2003 at 9:30 a.m.
