Paula Datesh submitted the following written statement:
“On March 15-I went to the 6am lottery at Justin Herman Plaza. I had not been there in 2 years. I took a space at the top of the Embarcadero BART. At 9:32am-John Tunui came up to kick my stuff; called me, “evil” and told the people around me not to talk to me. I called the non emergency SFPD number and 2 cars came. Tunui was not on the plaza but hung around taunting me until they came. He claimed he was there to tell me about a fork lift issue. SFPD questioned those who saw him and he was told not to return. About 10am, Tunui returned saying, “you bitch you called the cops on me!” I called SFPD again and he was told he would be arrested if he continued. I never returned or worked in the street after that.
“I do not know Tunui. He has slandered me at public meetings; lied under Oath at 2 previous civil hearings and altered documents to support his claims. He has harassed me in the financial district for 2 years and I have spent more time in Court than out working. I was never questioned by anyone at the SFAC about this and I do not believe Tunui will stop. Two Superior Court Judges have told him that if he is in their Courtroom again-he goes to jail. He is due in Court this Wednesday.
“The first police report I filed was from 25 Van Ness-3 years ago. Tom Decaigney refused to take responsibility for Tunui's actions or do anything about it. I am diabetic and Tunui has sent me to the emergency room 3 times.
“I do not want your Street Artist permit. That program is too mismanaged and Tunui will never stop harassing me.”

- Director’s Report
Mr. DeCaigny welcomed Alex Tan as the new Community Investments Program Associate, and briefly described his background and experience. He reported on a variety of agency activities, including the WritersCorps 20th anniversary event at the Contemporary Jewish Museum and posters celebrating the program; the SOMArts exhibit Dis/Play, celebrating the 25th anniversary of the Americans with Disabilities Act; Hung Yi’s Fancy Animal Carnival on temporary display in the Civic Center Plaza; and the first annual grants meeting held at the African American Arts and Culture Complex with the partial sponsorship of ArtCare. He thanked Commissioner Shelby for his participation in the event.
He also reported on the award of the first round of nonprofit displacement grants, and on the announcement of Bloomberg Philanthropies’ invitational funding opportunity in six cities, including San Francisco. Mr. DeCaigny reported on the opening of the Public Safety Building and showed images of the beautiful public artworks installed in the building, and covered in the San Francisco Chronicle.
Mr. DeCaigny then introduced ACLS Fellow Dr. Anh Thang Dao-Shah to present the logic model and performance measures she has developed in response to the strategic plan and the Controller’s office requirements for performance measures. She reviewed the draft logic model and performance measures documents, explaining how she developed them and how they were related to the strategic plan and its elements.
President Beltran added that the Executive Committee had discussed Dr. Dao-Shah’s presentation in great detail. Mr. DeCaigny reviewed the next steps for the agency. The Commission discussed the report and made several suggestions regarding metrics. They noted that many additional artists might be employed, or arts organizations might benefit, as a result of other artists receiving direct commissions or grants. The Commission also asked about the study on economic impact conducted biennially by the National Endowment for the Arts; the Arts Commission participates in this study. Dr. Dao-Shah briefly described the next steps in conducting and presenting her research on the agency and its programs. The Commission commended her work.
Mr. DeCaigny briefly reviewed the Year One update on the strategic plan, noting that he had reviewed it in great detail with the Executive Committee the previous Monday. He explained that as staff had discussed the plan in connection with performance reviews, it became apparent that some of the agency’s core functions were not fully represented in the objectives, and he discussed how that would be addressed. President Beltran added that the Executive Committee had discussed the update in detail and made several suggestions.
The Commission suggested updates more frequently than annually, perhaps semiannually or quarterly; Mr. DeCaigny agreed. In response to questions, Mr. DeCaigny reviewed the history of the strategic plan, stakeholder engagement in the process and the efforts to communicate the plan to the public; he added that the plan is posted on the Commission’s website.
The Commission thanked Mr. DeCaigny and staff for their work, and President Beltran said how thrilled she was with the current state of the agency.

- Community Arts, Education and Grants Committee—Sherene Melania, Chair
- In the absence of Commissioner Melania, Commissioner Shiota reported that Community Investments Program Director Judy Nemzoff had introduced Alex Tan, the new Community Investments Program Associate. Commissioner Shiota reported that the Committee also discussed the grantee meeting and approved the grants on today’s Consent Calendar.

Commissioner Shiota reported that the Committee also discussed the grantee meeting and approved the grants on today’s Consent Calendar.
- Civic Design Review Committee—Cass Calder Smith, Chair
- In the absence of Commissioner Smith, Commissioner Stryker reported that the Committee had reviewed a project at San Francisco Airport, Terminal 1, which is undergoing significant changes. She reported that the Committee also reviewed the Moccasin project, a small administrative building that is part of the Hetch Hetchy water system; the Committee praised the project, which aspires to LEED certification. Finally, she reported that the Committee reviewed the Central Subway Chinatown Plaza and recommended some changes to the design team.

- Commissioner Sklar reported that the Committee approved revised criteria for artwork, and will delay their implementation to give the artists time to adapt. She reported that the Committee met consultant Kate Faust, who is working with the program on implementation of the strategic plan. She reported that there was a great deal of public comment, and that the Committee discussed appropriate decorum.
Commissioner Sklar reported on her observations of the involvement of street artists in their communities in Cuba, which she recently visited.
President Beltran added that Commissioner Sklar is working with staff to help improve the program and the quality of the artists, and to determine how the program can better align with the overall agency mission.
Mr. DeCaigny added that the outside perspective of Ms. Faust under the auspices of the Goldman School of Public Policy was invaluable. He said that the program licenses some 350 artists each year, and he invited broad input to help strengthen and raise the quality of the program.

- Visual Arts Committee—Dorka Keehn, Chair
- Commissioner Keehn reported that the Committee had approved three finalists for the first project under the Public Art Trust, and discussed the next steps in choosing the finalist. She reported that the Committee had approved revised guidelines, and thanked Public Art Program Director Susan Pontious for her work on the document.
Commissioner Keehn reported on other projects reviewed by the Committee, including artworks for San Francisco Airport’s temporary boarding area for Terminal 1. She reported that the Committee also had to cancel a visionary work proposed by Mark Brest van Kempen for the Alameda Creek watershed whose technical and engineering needs have pushed the project far over budget. President Beltran added that the Committee and staff were very disappointed that the project was just not feasible.

- Consent Calendar
Commissioner Ordeñana recused himself from consideration of item 8, regarding the Native American Arts and Cultural Traditions Grants, because one of the grantees, the Queer Cultural Center, rents space from his employer, the San Francisco Lesbian Gay Bisexual Transgender Center. Commissioner Shelby recused himself from consideration of items 6 and 7, regarding grants to the Yerba Buena Gardens Festival, because he is an artist in residence at Yerba Buena.
Commissioners Ordeñana and Shelby left the room at 3:28, and President Beltran called for a vote on the three items below. There was no public comment, and the motion was approved unanimously, with the recusal of Commissioners Ordeñana and Shelby.
RESOLUTION NO. 0406-15-112: Motion to approve recommendation to award Yerba Buena Gardens Festival for funding in the 2014-2015 cycle of Organization Project Grants (“OPG”) and to authorize the Director of Cultural Affairs to enter into grant agreement for $15,000.
RESOLUTION NO. 0406-15-113: Motion to approve recommendations to award Yerba Buena Gardens Festival for funding in the 2014-2015 cycle of Native American Arts and Cultural Traditions (“NAACT”) and to authorize the Director of Cultural Affairs to enter into grant agreement for $7,500.
RESOLUTION NO. 0406-15-114: Motion to approve recommendations to award ten grants totaling $87,500 in the 2014-2015 cycle of Native American Arts and Cultural Traditions (“NAACT”) to the following organizations and individuals, and to authorize the Director of Cultural Affairs to enter into grant agreements with each organization and individual for the amounts listed:

Commissioners Ordeñana and Shelby returned to the room at 3:30, and President Beltran called for a vote on the remainder of the Consent Calendar. There was no public comment, and the remainder of the Consent Calendar was approved unanimously as follows.

Visual Arts Committee Recommendations (March 18, 2015) - RESOLUTION NO. 0406-15-116: Motion to approve the selected finalists: James Carpenter, Ned Kahn and Joseph Kosuth, for the Bill Graham Civic Auditorium Public Art Project as recommended by the Bill Graham Civic Auditorium Public Art Project Art Selection Panel.
- RESOLUTION NO. 0406-15-117: Motion to pay an honorarium in the amount of up to $2,500, plus reasonable travel costs to the following artists: James Carpenter, Ned Kahn and Joseph Kosuth, to develop proposals for the Bill Graham Civic Auditorium Public Art Project.

Executive Committee Recommendations (March 30, 2015) - RESOLUTION NO. 0406-15-130: Motion to authorize the Director of Cultural Affairs to enter into a grant agreement with Precita Eyes Muralists Association, Inc. in an amount not to exceed $100,000 for the restoration of murals and the creation of Peace Flags along the Calle 24 Latino Cultural District corridor in District 9.
- RESOLUTION NO. 0406-15-131: Motion to authorize the Director of Cultural Affairs to enter into a grant agreement with Youth Art Exchange in an amount not to exceed $17,500 for the expansion of three art walks in the Excelsior neighborhood in District 11.
- RESOLUTION NO. 0406-15-107: Motion to approve the Community Arts, Education and Grants Committee Meeting Minutes of March 10, 2015.
- New Business and Announcements
Commissioner Stryker recommended an exhibition of architectural sketches on display at the University of California’s Wurster Hall. She explained that they are called “scalies,” because they show people in relation to the designs, for scale.
President Beltran reported that there are many events and activities commemorating the centennial of the Panama-Pacific International Exposition, and that a scale model from the Arts Commission’s Civic Art Collection is on display at the California Historical Society.
There was no public comment.
- Adjournment
President Beltran sadly announced the recent passing of Paule Anglim, who operated a renowned and influential gallery for several decades, and was important in recognizing and promoting Beat and conceptual artists, including Paul Kos, Louise Bourgeois and many others.
There being no further business, the meeting was adjourned at 3:36 p.m. in memory of Paule Anglim.
