  2. Approval of Minutes
    There was no public comment, and the minutes were unanimously approved as follows.
     
    RESOLUTION NO. 0806-18-238: Motion to approve July 9, 2018 Minutes.
     
  3. General Public Comment
    Tom Gilberti suggested the creation of two public artworks: first, a statue of Eleanor Roosevelt at U.N. Plaza commemorating her role in the creation of the United Nations, and second, a pair of sculptures flanking the entrance to the Hall of Justice depicting the death of Mario Woods. One side would show Mr. Woods with five guns pointing toward him in the second before his death, and the other would show him crumpled on the ground a second later, with the guns still pointed at him. The speaker proposed that the statues could be demolished along with the building, setting the City on a new path regarding mental health and criminal justice.
     
    There was no further public comment.
     
  4. Director’s Report
    Mr. DeCaigny introduced Deputy City Attorney Jon Givner, head of the ethics team in the office, to review the City Attorney’s advice on political activity by City officers, including Commissioners, and employees. This timing was chosen partly because of the ballot measure restoring the arts nexus with the Hotel Tax Fund, as recently approved by the Board of Supervisors.
     
    Mr. Givner reminded everyone that the City Attorney’s latest letter on political activity is posted on their website. He began by explaining that everyone has First Amendment rights, including the right to speak or to spend money in support of or against a measure or a candidate. City resources, however, may not be used to advocate for or against a candidate or a ballot measure. The Commission, for example, cannot pass a resolution advocating for or against a measure or candidate. The Commission could direct staff to prepare an objective and fact-based analysis of the impact of a measure on arts funding, but not then recommend a vote for or against. City staff cannot do fundraising or advocacy work on City premises such as City Hall or City offices, or using City equipment such as phones or computers, or during paid work time. Neither City staff nor Commissioners can solicit campaign contributions from other City staff or Commissioners, unless it is incidental to a mass solicitation to some outside group such as an arts nonprofit.
     
    Commissioners asked several questions, including whether they could identify themselves as Arts Commissioners (yes, but it must be clear they are not speaking on behalf of the Commission) and how any potential report on the impact of a measure might be distributed (only in the normal way in which other reports or publications are distributed, and not in the way a campaign mailer would be).
     
    Mr. Givner encouraged Commissioners to contact him with any questions, and thanked the Commission for inviting him.
     
    Turning to other subjects, Mr. DeCaigny reminded everyone that there would be no meeting of the full Commission in September, and no meeting of the Executive Committee in August.
     
    He congratulated Director of Special Projects Jill Manton and Program Associate Aleta Lee on the public art installed at the new Salesforce Transit Center, and he announced the upcoming dedication and public open house. He showed images of the artworks by Julie Chang, Ned Kahn, Jenny Holzer and James Carpenter. The Commission commended Ms. Manton and Ms. Lee, noting that the project has been underway for eleven years, as well as Director of Communications Kate Patterson-Murphy for a great job publicizing the project. Mr. DeCaigny also commended City partners, including the Department of Public Works and the Municipal Transportation Agency.
     
    Mr. DeCaigny also reported on the dedication of Auspicious Clouds in Chinatown, commending Project Manager Marcus Davies for his work on the project, and Points of Departure on Geary Street. He announced events in the Galleries, including a workshop led by artist Weston Teruya creating amulets, and a panel connected with the current Conversations 7 exhibition.
     
    Mr. DeCaigny reported that the Board of Appeal would rehear the matter of the removal of the Early Days portion of the Pioneer Monument on Wednesday, September 12.
     
    Mr. DeCaigny was pleased to report, as mentioned earlier, that the Board of Supervisors unanimously approved the ballot measure to restore the connection between the Hotel Tax and support for the arts. In response to questions from the Commission, staff reviewed the outlines of the measure, and reminded everyone that explanatory documents were online, having been posted with the agenda for the July 9, 2018 Commission meeting.
     
    There was no public comment.
     
  5. Committee Reports and Committee Matters
    1. Executive Committee—JD Beltran, Chair
      1. At the request of President Beltran, Mr. DeCaigny discussed the following motion, which updates the agreement in support of the World Cities Culture Summit, November 14-16. He pointed out that this is largely generous private funding rather than City funds. He added that Lisa Hasenbalg, SF Travel’s liaison for the event, had recently accepted a position in Wisconsin, and that her supervisor, Howard Pickett, is ably picking up where she left off; he is very confident in the team, which also includes event manager Geraldine O’Brien, who worked on the Americans for the Arts conference.
         
        President Beltran noted a correction to the motion: the name of the event is World Cities Culture Summit, not World City.
         
        There was no public comment, and the corrected motion was unanimously approved as follows.
         
      2. RESOLUTION NO. 0806-18-239: Motion to rescind Resolution No. 0402-18-120, which authorized the Director of Cultural Affairs to enter into a grant agreement with SF Travel for an amount not to exceed $275,000 to support artist presenters, keynote speakers, translation services, cultural venue fees and associated costs of the World Cities Culture Summit in San Francisco in November 2018 as part of local co-host obligations;
        and to authorize the Director of Cultural Affairs to enter into a contract with SF Travel for an amount not to exceed $370,750 to manage World Cities Culture Summit events, including artist presenters, keynote speakers, translation services, cultural venue fees and associated costs of the Summit in San Francisco in November 2018 as part of local co-host obligations.
         
        President Beltran reported that the Executive Committee had discussed the Street Artists’ Code of Conduct at their last meeting. She called for public comment on the following motion.
         
        Public Comment:
         
        Tom Gilberti questioned the change from “street artist” to “artist vendor” and wondered whether it was all right with the artists. He noted the problem with “vendors” who sell things they don’t make themselves.
         
        There was no further public comment.
         
         
        Vice President Ordeñana recused himself from consideration of the following motion because the vendor, MJM Management Group, is a donor to his employer, the San Francisco Lesbian Gay Bisexual Transgender Center, and this represented a possible financial conflict. He left the room at 2:47 p.m.
         
        Staff explained the proposal, a six-month trial with a preliminary evaluation after three months, and an option to renew if the program is successful. There will be three people (an administrator and two security guards) onsite each day, on Fridays, Saturdays and Sundays, the busiest days of the market. The Commission discussed the motion, and there was no further public comment.
         
        The motion was unanimously approved as follows, with the recusal of Vice President Ordeñana.
         
      3. RESOLUTION NO. 0806-18-240: Motion to authorize the Director of Cultural Affairs to enter into a contract with MJM Management Group for an amount not to exceed $60,000 to provide onsite management for the Embarcadero Plaza art vendor market.
         
        Vice President Ordeñana returned to the room at 2:50 p.m.
         
    2. Civic Design Review Committee—Kimberlee Stryker, Chair
      1. Commissioner Stryker reported that the Committee reviewed two projects, one at San Francisco Airport, and the renovation of the Golden Gate Park tennis center. The Committee thought the tennis center was nicely integrated in the park, and noted that it had strong community support.
         
        There was no public comment.
         
    3. Visual Arts Committee—Dorka Keehn, Chair
      1. Commissioner Keehn reported that the Committee had a short meeting, reviewing a small gallery memorializing the assassinated Supervisor Harvey Milk, after whom San Francisco Airport Terminal One has been renamed. She briefly discussed the role of the Airport Art Museum, the only one in a United States airport.
         
        Commissioner Keehn explained that the following motion could not be voted on at the Committee’s recent meeting because the artist is represented by Commissioner Silverman, and her recusal would have left the Committee without a quorum. President Beltran explained that she would have to recuse herself, because the artist is her superior at the California College of the Arts. She left the room at 2:56 p.m.
         
        Public Art Program Director showed the images of the artworks and discussed them briefly. The Commission discussed their placement in the terminal.
         
        There was no public comment, and the motion was unanimously approved as follows, with the recusal of President Beltran.
         
      2. RESOLUTION NO. 0806-18-241: Motion to approve the purchase of the following artworks for display at the San Francisco International Airport: Terminal 1, Boarding Area B:

      3. RESOLUTION NO. 0806-18-242: Motion to approve the mural design of Pentacle Coffee Mural (working title) by artist Jeffrey Cheung. The painted mural will be installed on an exterior wall at 64 Sixth Street, along the wall facing Jessie Street, measuring approximately 14 ft. by 69 ft. The project is funded by Working Solutions and the Office of Economic Workforce Development, and is sponsored by Working Solutions; the painted mural will not become part of the Civic Art Collection.
         
  6. Consent Calendar
    Vice President Ordeñana recused himself from consideration of items 12, 13 and 14, regarding cost of living adjustments and Management and Programming Plans for the Queer Cultural Center, because they rent space from his employer, the San Francisco Lesbian Gay Bisexual Transgender Center. He left the room at 3:01 p.m.
     
    President Beltran called for a vote on the following three motions. There was no public comment, and the motions were unanimously approved as follows, with the recusal of Vice President Ordeñana.
     
    RESOLUTION NO. 0806-18-255: Motion to rescind the retroactive cost of living adjustment (“COLA”) increases to the FY2017-2018 Cultural Center grant agreements, authorized by Resolution No. 0709-18-190 in amounts not to exceed the following: African American Art and Culture Complex (“AAACC”), by $16,382 for a total grant of $671,662.14: $562,060.68 to AAACC and $109,601.46 to sub-grantee Queer Cultural Center.
     
    RESOLUTION NO. 0806-18-256: Motion to approve retroactive cost of living adjustment (“COLA”) increases to the FY2017-2018 Cultural Center grant agreements in amounts not to exceed the following: African American Art and Culture Complex (“AAACC”) by $16,382 for a total grant of $821,662 ($712,061 to AAACC and $109,601 to sub-grantee Queer Cultural Center).
     
    RESOLUTION NO. 0806-18-257: Motion to approve the proposed FY2018-2019 Management and Programming Plan (“MPP”) and Budget for the African American Art and Culture Complex (“AAACC”) for a grant amount not to exceed $671,662.14: $562,060.68 to AAACC and $109,601.46 to sub-grantee Queer Cultural Center (“QCC”), pending MPP and budget revisions.
     
     
    Vice President Ordeñana returned to the meeting room at 3:02 p.m.
     
     
    President Beltran called for consideration of the remainder of the Consent Calendar.
     
    There was no public comment, and the remaining Consent Calendar was approved unanimously as follows.

    4. RESOLUTION NO. 0806-18-247: Motion to approve the selected artist Alison Pebworth and conceptual proposal for one or more artworks for the Geneva Powerhouse Public Art Project as recommended by the artist selection panel.
       
    5. RESOLUTION NO. 0806-18-248: Motion to authorize the Director of Cultural Affairs to enter into contract with Alison Pebworth for an amount not to exceed $97,000 for design, fabrication, transportation, and installation consultation of artworks for the Geneva Powerhouse Project.
       
    6. RESOLUTION NO. 0806-18-249: Motion to approve Steven Whyte’s proposal for Comfort Women Interactive Tribute (working title) as a derivative version of Comfort Women’s Column of Strength. The Commission agrees that the new proposal is sufficiently different from San Francisco’s “Comfort Women” Memorial in design and intent so that the artist would not be in violation of Paragraph 5 (g) of the artist’s agreement with the City dated July 27, 2017.
       
    7. RESOLUTION NO. 0806-18-250: Motion to approve San Francisco International Airport’s art plan for the Harvey B. Milk Terminal.
       
    8. RESOLUTION NO. 0806-18-251: Motion to approve Suhas Bhujbal, Emory Douglas, Kenyatta Hinkle, and Sanaz Mazinani as finalists for the 1550 Evans Southeast Community Center Main Lobby Public Art Project and Louisiana Bendolph, Alice Beasley, Phillip Hua, and Ron Moultrie Saunders for the 1550 Evans Southeast Community Center Alex Pitcher Room as recommended by the artist selection panel.
       
    9. RESOLUTION NO. 0806-18-252: Motion to approve the selected artist Michael Bartalos for the Ambulance Deployment Facility (“ADF”) gateways, a project for the San Francisco Fire Department, as recommended by the ADF artist selection panel.
       
    10. RESOLUTION NO. 0806-18-253: Motion to authorize the Director of Cultural Affairs to enter into contract with the selected artist Michael Bartalos for an amount not to exceed $311,200 for design, engineering, fabrication, transportation and installation consultation of artwork gates for the Ambulance Deployment Facility.
       
    11. RESOLUTION NO. 0806-18-254: Motion to approve Weston Teruya’s six final designs for the 2018 Art on Market Street Kiosk Poster Series, pending revision of the text and an update to the background color.

RESOLUTION NO. 0806-18-264: Motion to approve an increase to the WritersCorps Teaching-Artist-in-Residence grant (authorized by Resolution No. 0501-17-122) for the amount of $52,000 annually for two fiscal years 2018-2020 to Celeste Chan (Fiscal Sponsor: Intersection for the Arts) in partnership with Chrysalis Studio’s Queer Ancestors Project; and to authorize the Director of Cultural Affairs to amend the grant agreement pending availability of funds.
       
    19. RESOLUTION NO. 0806-18-265: Motion to adopt the Artist Code of Conduct as revised.

    20. RESOLUTION NO. 0806-18-266: Motion to approve Phases 2 and 3 of the San Francisco (“SFO”) Boarding Area A Gate Enhancement Project—Gate A2 Bus Lobby.
       
    21. RESOLUTION NO. 0806-18-267: Motion to approve Phase 3 of the Golden Gate Park Tennis Center Project contingent upon: 1) the project team’s return for an informal review of the development of the fenestration on the west façade for better integration with the building design.
       
  7. New Business and Announcements
    Mr. DeCaigny announced that Governor Brown will be hosting the Global Climate Action Summit in San Francisco September 10-14, at Moscone Center, Yerba Buena Center for the Arts and other venues. San Francisco Arts Monthly is helping to publicize associated arts events, including the opening of 10,000 Fahrenheit at the SFAC Galleries on September 14. The Department of the Environment is also helping to coordinate summit activities.
     
    President Beltran announced that the Center for Impact at California College of the Arts is hosting a daylong conference on September 11 in advance of the summit.
     
    In response to a question from President Beltran, Commissioner Shelby reported that he had recently returned from a month performing with Anna Deavere Smith at the Royal Court Theatre in London in Notes From the Field, on the school-to-prison pipeline.
     
    Commissioner Stryker announced that at the end of August, she would be participating in training with Al Gore’s Climate Reality Leadership Corps, and she hoped to share some of what she learns with the Commission.
     
    There was no further news or announcements, and there was no public comment.
