- Approval of Minutes
There was no public comment, and the corrected minutes were unanimously approved as follows.
RESOLUTION NO. 1002-17-250: Motion to approve August 7, 2017 Minutes.
- Pioneer Monument Discussion
Mr. DeCaigny began by directing attention to the staff report prepared on the history of the Pioneer Monument and the Civic Arts Collection guidelines for deaccession, removal, alteration or destruction of public artworks. He discussed the context of public interest in the possible removal of the sculpture. He also explained that the Commission was being asked at this meeting not to actually remove the sculpture, but to initiate the process of reviewing whether and how the sculpture should be removed, and at what cost. He further explained that because the sculpture is part of the Civic Center, any relocation or removal is subject to review by the City's Historic Preservation Commission, and may also be subject to the jurisdiction of other City agencies.
President Beltran called for public comment.
Public Comment:
Reid Stuart said that things change, and while he doesn’t deny the controversy, he thought that it was important to acknowledge the past.
James Haas said that the body that finally made the decision to place the plaque was the Planning Commission, with input from Native representatives. He always felt it was important to have dialogue.
Mari Villaluna introduced herself as a native San Franciscan, Mohawk, Navajo and Mexican. She urged the Commission to take the statue down.
San Francisco Poet Laureate Kim Schuck said she was born and raised in San Francisco, and was part of the Cherokee nation. She said that racism is learned, and urged removal of the statue.
Randy Burns introduced himself as Northern Paiute, and as a longtime gay activist. He said that the Human Rights Commission worked with the LGBT community on a report included in the packet, and asked for removal of the statue.
Anthony Oertel suggested that the Commission add a text to the monument, such as a poem by Huang Zunxian which he submitted. He said this would allow the sculpture to be seen from different viewpoints.
Barbara Mumby spoke as a private citizen, on a break from her job as Community Investments Senior Program Officer. She submitted the following written statement:
“Hello Commissioners: normally I come before you as a staff member of the Arts Commission. I would like to stress that in this moment I am not here in an official capacity: I am currently taking a personal break so that I can offer public comment as a member of the Native American community.
“Monuments are erected to commemorate a victory – it is time to reconcile that purposeful acts of genocide do not make a country or state victorious – it is a shameful and disgraceful blight on a history that continues to be whitewashed and denied by nationalists. There is a reason we do not see monuments erected to commemorate Hitler and the Holocaust – why should it be any different when the victims are the indigenous people of this continent?
“Today you have the power to help us change the narrative and let the world know that we are not weak, submissive, conquered, heathen savages- but that we are human beings.
“Thank you.”
Sophia Catalano, a member of Intertribal Friendship House, said her husband is Apache. She said that history can never be rewritten, and she didn’t want children to see the statue; cost is not a reason not to remove it.
Laura Sinai asked the Commission to remove the statue.
Ramon Quintero said the City didn’t need the statue.
Marian Halley said that she is a tour guide, and almost 90% of her clients are from other countries. She said she is embarassed to point out the statue and finds it impossible to explain. She said the plaque is buried in the grass and not visible, and the statue should come down.
Dee Allen of Oakland said that for San Francisco to honor and practice diversity, the statue must be destroyed like the Confederate statues.
Kevin Williams, the son of Ruth Williams, described himself as “openly Black,” with Native ancestry, a Cherokee grandmother. He called the monument destructive.
Edward Wright said that it was not enough to repudiate white supremacy through words and the language of resistance. He said the removal of the sculpture was long overdue, and the crimes of the past should not be glorified.
Hazel White said that the statue shamefully confirms white supremacy. As the mother of a person of color, she spends enormous energy protecting her child from cruelty.
Clif Cox said that he was part Cherokee and remembered that the land was stolen from indigenous people. He said there should be a two-spirit mural in the city.
Hailey Malaika Clarke said it doesn’t take someone with an art degree to see how disgusting the statue is, and it should not be on a pedestal in the center of the city. She urged the Commission to find a solution today, and take it down or cover it.
Anandi grew up in the Bay area and said that people here like to think of themselves as better, not like southerners, but can’t say that with this statue, which should be taken down without riots and conflict.
Patrick Flanagan said he was Irish and Italian, with not one drop of Native blood, and he hates the depiction in the statue. He said that in the 1990s, even though the Franciscans and the Spanish Consulate opposed it, the Commission placed the statue.
Derek Smith called for the statue to be removed.
Julie Roberts-Phung noted that people showed up to change the name of Justin Herman Plaza, and she asked the Commission to take immediate action to remove or cover the statue.
Mary Jean Robertson of KPOO said that the Commission seemed to be listening, and it was a pleasure to see the passion of people in the room. She urged the Commission to remove the statue.
Jaime Viloric said he was a resident of the neighborhood voicing opposition to the statue. He said this was the opposite of the Comfort Women memorial recently unveiled.
Michael Levin is a lifelong resident who praised the Comfort Women memorial. He said that the vaquero in this monument was originally spinning a lariat which was stolen sometime in the past. He said this was all that was left of the pre-1906 City Hall district and hoped the Commission would have some feeling for this.
Francisco da Costa said he was Ohlone, and his people have been here for 13,000 years. He said there was no need to ask, and the statue should come down. He said that the Mayor had a letter from him, and was demanding, not requesting, that the statue should be removed.
The Commission thanked members of the public for their testimony and they discussed the proposal in great detail, including the required review and approval by the Historic Preservation Commission. Commissioners also encouraged members of the public to express their concerns to the Historic Preservation Commission when that body considers removal of the sculpture. They noted that while cost was not a determining factor in the decision, the Arts Commission will need to know all the costs involved. They also affirmed that any action will be reviewed with the City Attorney's office. There was no further public comment, and the motion was unanimously approved as follows.
RESOLUTION NO. 1002-17-251: Motion to initiate the review process described in Section 7 of the Guidelines of the Civic Art Collection of the City and County of San Francisco, (“Deaccession, Removal, Alteration, and Destruction Policies and Procedures”), in order for the Commission to consider deaccessioning and/or removal of the “Early Days” sculptural group of the Pioneer Monument (James Lick Monument) by Frank Happersberger, located on Fulton Street between Larkin and Hyde streets. The monument was a gift from James Lick and was dedicated in 1894.
The Commission requested that staff post signage near the statue indicating that the Commission had begun the process of review for its possible removal.
- Director’s Report
Mr. DeCaigny began his report by introducing Molly Barrons, a new Program Associate in the Community Investments team.
He reported on the recent opening of The Idea of a Boundary, curated by Galleries Associate Curator Jackie Im for the main gallery at 401 Van Ness, and on the September 30 event marking the closing of the 155 Grove Street window gallery.
Mr. DeCaigny announced upcoming application deadlines and calls for entry, all of which are posted on the Commission's website. Finally, he announced that memorials would be presented only twice a year during Commission meetings, to allow staff to better gather information, except in the case of the death of a staff member or Commissioner.

- Committee Reports and Committee Matters
- Executive Committee—JD Beltran, Chair
- President Beltran reported that the Committee discussed proposed revisions to the Planning Code regarding the Public Art Trust. The Committee agreed that now that the legislation has been in force for five years, this is a good time to evaluate how it is working and to propose changes to improve it. The Commission discussed the process for revising the legislation, noting that final authority rests with the Board of Supervisors.
- Discussion and possible motion to recommend the proposed revisions to the Public Art Trust legislation, Section 429 of the Planning Code.
The Commission held an extensive discussion of the proposed revisions, and some Commissioners requested clarification of some of the provisions, as well as expressing significant concern with some aspects, including the amount of the discount from their percent-for-art amount for developers to contribute to the fund. Ultimately, President Beltran tabled the motion to approve the draft legislation and requested that staff work on it further, including further consultation with the Planning Department and other appropriate City staff. There was no public comment, and there was no vote.
- President Beltran reported that the Committee had also discussed revisions to the agreement with the Mayor's Office of Housing and Community Development ("MOHCD") regarding MOHCD's responsibility to have Civic Design Review of their future projects, and to include art enrichment. She explained that the recent change in how the City works with developers on affordable housing projects—the City now retains ownership of the property and leases it for a long term rather than selling it to the developer—means that there is now a mandate for design review and public art. MOHCD has already begun several projects which are very far along, and this agreement exempts those projects. The revised agreement adds a few additional projects inadvertently omitted from that list by MOHCD for exemption from Civic Design Review only.
President Beltran presented the following motion, and the Commission discussed it briefly. Commissioner Collins noted for the record that he had a potential conflict regarding the property at 88 Broadway and 735 Davis, because his employer was involved in that project. However, the project had previously been voted upon, and the present motion did not address that project.
There was no public comment, and the motion was unanimously approved as follows.
RESOLUTION NO. 1002-17-252: Motion to approve the revised agreement between the San Francisco Arts Commission and the Mayor’s Office of Housing and Community Development regarding Civic Design Review and Public Art requirements for affordable housing projects, except for the property at 88 Broadway and 735 Davis, which already was exempted. The earlier agreement was approved by Resolution No. 0605-17-173.

A speaker urged the Commission to look further at the projects, including Hope SF, and not to pander to developers or focus just on toilets and rest stops.

- Commissioner Keehn reported that she had toured the Transbay Terminal with Director of Public Art Trust and Special Projects Jill Manton, and was very impressed. She reported that the Committee reviewed several projects, approving the gift of La Rose des Vents. She also praised Collections staff for the conservation work done over the last year

- Consent Calendar
President Beltran noted that Mr. DeCaigny had to leave, and that Deputy Director Rebekah Krell was sitting in for him. President Beltran took Consent Calendar item 58, regarding a grant to Bayview Opera House, separately in order to hear public comment on this item.
Public Comment:
Leela Molex expressed concern about the management of the Opera House, noting that she had applied for funds for an art festival and was told they were no longer available.
Kevin Williams expressed concern about the management and operations of the Bayview Opera House, and about the fence. He charged that some people on the board of directors are driven by politics, whereas it was not previously political. Other speakers echoed his concerns, including Dwayne Gaines, Gladys DeWitt and James Autry.
President Beltran and Ms. Krell noted that the Special Project Grant in the current motion was for capital improvements, and was separate from and additional to the regular annual grant.
President Beltran added that the limitation of one minute for public comment at this meeting was set to accommodate the very large number of speakers on the Pioneer Monument, and she assured members of the public that Commissioners do read their letters and e-mails.
There was no further public comment, and the motion was unanimously approved as follows.
RESOLUTION NO. 1002-17-311: Motion to increase the Special Project Grant to the Bayview Opera House (authorized by Resolution No. 0104-16-011) by $69,500, for a total grant amount not to exceed $369,500. This grant is to support capital improvements to the building.
President Beltran called for consideration of the remainder of the Consent Calendar. There was no further public comment, and the Consent Calendar was approved unanimously as follows.

Visual Arts Committee Recommendations (August 16, 2017)
- RESOLUTION NO. 1002-17-258: Motion to approve the mural design entitled West Portal Centennial by Sirron Norris. The painted mural will consist of two parts, each 20 ft., 9 in. by 4 ft., 5 in., and will be located on a brick wall along the perimeter of the parking lot that spans 170 and 186 West Portal Avenue. The project is funded by the Department of Economic and Workforce Development and is sponsored by the West Portal Merchants Association. The mural will not become part of the Civic Art Collection. Final approval is pending approval by the San Francisco Municipal Transportation Agency.
- RESOLUTION NO. 1002-17-259: Motion to approve the mural designs for phase two of the Laguna Honda Mural Project by artists Elaine Chu and Yukakoe Ezoe. The additional painted mural will measure 5 ft. by 160 ft. and will be located immediately left of the existing mural Celebrating 150 Years of Compassionate, Dedicated Service to the Community, 2015 (Resolution No. 1005-15-282) at 375 Laguna Honda Boulevard. The project is funded by a District 7 Participatory Grant and is sponsored by the Precita Eyes Muralists Association. The mural will not become part of the Civic Art Collection.
- RESOLUTION NO. 1002-17-260: Motion to authorize the Director of Cultural Affairs to issue a Letter of Conditional Acceptance to the “Comfort Women” Justice Coalition for the proposed gift of Women’s Column of Strength, by Steven Whyte, pending staff verification of receipt of all contract documents as required in the Agreement between the “Comfort Women” Justice Coalition and the Arts Commission dated August 8, 2017.
- RESOLUTION NO. 1002-17-261: Motion to authorize a $600,000 increase of the contract with Kiboworks to extend the linear footage of the Jenny Holzer artwork at the Transbay Transit Center by 110 linear feet for a new total linear footage of 200 feet and a contract amount not to exceed $1,340,000.

Civic Design Review Committee Recommendations (September 18, 2017)
- RESOLUTION NO. 1002-17-284: Motion to approve Phases 1 and 2 of the San Francisco Airport (“SFO”) Mel Leong Treatment Plant—Lab Administration Building.
- RESOLUTION NO. 1002-17-285: Motion to approve Phase 2 of the JCDecaux Public Restrooms and Kiosks Project contingent upon addressing the bottom bump-out so that it may be uniform on all three sides and as flush as possible.
- RESOLUTION NO. 1002-17-286: Motion to approve Phase 2 of the Castro Mission Health Center Renovations Project.
- RESOLUTION NO. 1002-17-287: Motion to approve Phase 2 of the San Francisco Fire Department Ambulance Deployment Facility Project contingent upon aligning the mullion lines to the metal bond panel to exhibit continuity between the structure and the skin of the building.
- RESOLUTION NO. 1002-17-288: Motion to approve Phases 2 and 3 of the Tad’s Steakhouse Project contingent upon: 1) the synthesis of Option A and Option B, which incorporates the above continuous wood of Option A and the below open glazing structure of Option B; and 2) the centering of the sign between the two piers.

Visual Arts Committee Recommendations (September 20, 2017)
- RESOLUTION NO. 1002-17-291: Motion to authorize the Director of Cultural Affairs to enter into contract with artist Jorge Pardo for an amount not to exceed $815,000 for the design development, construction documents, fabrication, transportation and consultation during installation, for the Van Ness Avenue Bus Rapid Transit Project.
- RESOLUTION NO. 1002-17-292: Motion to authorize an increase to ARG Conservation Services’ contract in the amount of $249,000 (from $500,000 to $749,000) to perform as-needed fine art conservation services for miscellaneous artworks, including but not limited to: the restoration of the Abraham Lincoln Brigade Monument, 2008 by Ann Chamberlin and Walter Hood (SFAC Accession No. 2008.3); and the conservation of Amazarasti-no Hotoke (The Buddha that sits throughout the sunny and rainy weather without shelter), ca. 1790 by an anonymous artist (SFAC Accession No. 1948.1).
- RESOLUTION NO. 1002-17-293: Motion to authorize an increase to Atthowe Fine Art Services’ contract in the amount of $249,000 (from $500,000 to $749,000) to perform as-needed fine art conservation services for miscellaneous artworks, including but not limited to the rigging and restoration of the Whales, 1939 by Robert B. Howard (SFAC Accession No. 1940.10).
- RESOLUTION NO. 1002-17-294: Motion to authorize an increase to Atthowe Fine Art Services’ contract in the amount of $249,000 (from $500,000 to $749,000) to perform as-needed fine art services for miscellaneous public art projects, including but not limited to various capital improvement projects: SFO Gaterooms and Terminal 1; Office of the Chief Medical Examiner; and Bayview Gateway.
- RESOLUTION NO. 1002-17-295: Motion to authorize the Director of Cultural Affairs to enter into an agreement with Julie Lepinard and JSLH Foundation for their proposed gift to the City of La Rose des Vents, a sculpture by Jean-Michel Othoniel (valued at $540,000) and accompanying maintenance endowment (estimated at $190,322) and other associated costs. The sculpture will be installed in Golden Gate Park pending final site selection and approval by the Recreation and Park Department.
- RESOLUTION NO. 1002-17-296: Motion to approve the selection of Nikki McClure, with alternate Al Price, as the artist for the gateways to the Ambulance Deployment Facility, a project of the San Francisco Fire Department, and approval to pay the artist an honorarium of $3,000 for a preliminary proposal for the project.
- RESOLUTION NO. 1002-17-297: Motion to approve the selected artist Sarah Sze’s proposal for the atrium lobby of the 1500 Mission Street office building as recommended by the project selection panel.
- RESOLUTION NO. 1002-17-298: Motion to authorize the Director of Cultural Affairs to enter into contract with Sarah Sze for an amount not to exceed $750,000 for design, fabrication, transportation and installation consultation of an artwork for the atrium lobby of the 1500 Mission Street office building.

Executive Committee Recommendations (September 25, 2017)
- RESOLUTION NO. 1002-17-310: Motion to increase the Arts for Neighborhood Vitality grant to the San Francisco Juneteenth Festival (Fiscal Sponsor: Queer Cultural Center; grant authorized by Resolution No. 0710-17-179) by $50,000, for a total grant amount not to exceed $53,000. This grant has been increased to expand the annual festival and build the capacity of the organization.
- RESOLUTION NO. 1002-17-312: Motion to increase the Special Project Grant to the Queer Cultural Center (authorized by Resolution No. 0104-16-017) by $40,000, for a total grant amount not to exceed $120,000 and to extend the grant window to June 30, 2018. This grant is to support capacity-building and technical assistance services to emerging artists from historically underserved and underrepresented communities.
- RESOLUTION NO. 1002-17-313: Motion to increase the Cultural Center grant to the African American Art and Culture Complex (authorized by Resolution No. 0807-17-214) by $150,000, for a total grant amount not to exceed $805,302: $698,370 to AAACC to support the transition of leadership and build capacity, and $106,932 to sub-grantee Queer Cultural Center (“QCC”), pending MPP and budget revisions.
- RESOLUTION NO. 1002-17-314: Motion to increase the Special Project Grant to the New Conservatory Theatre Center (authorized by Resolution No. 1205-16-319) by $50,000, for a total grant amount not to exceed $100,000, and to extend the grant window to June 30, 2018. This grant is to provide continued support to the YouthAware children’s theater program.
- RESOLUTION NO. 1002-17-315: Motion to authorize the Director of Cultural Affairs to enter into a grant agreement with Youth Art Exchange (Fiscal Sponsor: Tides Center) for an amount not to exceed $18,170 to complete utility box murals with funding as selected by the District 7 Participatory Budget process.
- RESOLUTION NO. 1002-17-316: Motion to authorize the Director of Cultural Affairs to enter into a grant agreement with Ocean View–Merced Heights–Ingleside Community Action Organization (“OMI-CAO”) for an amount not to exceed $25,000 to complete a mural as selected by the District 7 Participatory Budget process.
- RESOLUTION NO. 1002-17-317: Motion to increase the Special Project Grant to the Arts Education Alliance of the Bay Area (authorized by Resolution No. 0104-16-016) by $10,000, for a total grant amount not to exceed $60,000. This grant is to support professional development and networking for the arts provider and teaching artists community.
- RESOLUTION NO. 1002-17-318: Motion to increase the FY2017-2018 Cultural Equity Initiatives grant to CounterPulse (authorized by Resolution No. 0501-17-111) by $10,000, for a total grant amount not to exceed $107,336. This grant is to support the organization’s ability to provide expanded capacity-building supports to their constituents.
