Ann Treboux submitted the following written statement:
“BARBARA SKLAR FILED A MALICIOUS AFFADAVIT AGAINST ME ON MARCH 1, 2015. DIANA ROSENSTEIN, A FORMER PUBLIC DEFENDER FILED IN SF SUPERIOR COURT WITHOUT INVESTIGATING OR ASKING FOR EVIDENCE. THIS CASE WAS OVERTURNED ON APPEAL AT THE CALIFORNIA COURT OF APPEAL-FIRST DISTRICT, FIFTH DIVISION. IN THE NEXT FEW DAYS, I WILL FILE A CIVIL CASE AGAINST THE SFAC AND BARBARA SKLAR. NOT ONLY DID SHE LIE ON HER AFFADAVIT, SHE MADE THE MISTAKE OF LISTENING TO HOWARD LAZAR.
“THE STREET ARTIST PROGRAM HAS BEEN MIS MANAGED FOR OVER 42 YEARS BY HOWARD LAZAR. NOT ONLY HE SQUANDERED STREET ARTISTS FUNDS; HE INVENTS TALL TALES AND USES ANYONE TO DO HIS BIDDING.

- Director’s Report
Mr. DeCaigny began his remarks by lamenting the awful loss of life in the Oakland Ghost Ship fire on Friday, December 2. He reported that he had spoken with Roberto Bedoya, Oakland’s Cultural Affairs Manager, to extend support in the coming days.
Turning to the Arts Commission’s activities, Mr. DeCaigny reported on the opening of the opening of Not Alone, Exploring Bonds Between and With Members of the Armed Forces, with some 250 people in attendance. Galleries Director Meg Shiffler thanked President Beltran, who grew up in a military family, for her support on the exhibition. Mr. DeCaigny reported that In Search of Great Men, the show in City Hall, featuring photographs by Guggenheiim Fellow McNair Evans, would close on December 16. President Beltran urged everyone to see this powerful and moving body of work.
Mr. DeCaigny announced the installation of temporary sculpture by HYBCOZO in Patricia’s Green; the illuminated sculptures are based on Penrose tiling patterns. He thanked Director of Special Projects Jill Manton for her efforts on the project.
He reported that applications for the prequalified arttist pool were being accepted until 11:59 p.m.on December 2, and that 600 applications had already been submitted. He added that the deadline for responses to the Request for Qualifications for work at San Francisco Airport has been extended to January 9, 2017.
Finally, Mr. DeCaigny reported on discussions within the United States Urban Arts Federation (“USUAF”), representing the nation’s sixty largest cities, regarding potential impacts from the national election. He noted that, along with Seattle, Nashville and other cities, San Francisco recently affirmed its status as a sanctuary city, and the City will do what it can to keep federal funding, which, for the Arts Commission, is primarily grants from the National Endowment for the Arts. He will be meeting with colleagues in the USUAF over the coming months.

- Committee Reports and Committee Matters
- Executive Committee—JD Beltran, Chair
- President Beltran reported that the Committee did not meet, and she asked Mr. DeCaigny to discuss the following motion, which the Committee would have considered.
Mr. DeCaigny reminded the Commission that San Francisco would be hosting the national conference of Americans for the Arts (“AFTA”) in June, 2017, and the following motion would allow for funding the host obligations, including presenting local artists on the main stage, receptions at the Exploratorium and the de Young Museum, and “Artventures” to get visiting participants out to see arts sites around the Bay Area. He added that staff will also seek private resources and state funds to support the event. He added that scholarships will be offered to help local, regional and statewide artists to attend at a discount, possibly including lodging and travel, if needed.
The Commission briefly discussed the motion, and noted that this was an opportunity for national and international attention to San Francisco, and that the organization has long wanted to meet in San Francisco. Mr. DeCaigny explained that the pre-conference sessions will begin on June 15, and the conference will run from June 16 through June 18, and upwards of 1200 participants are expected. Finally, he thanked Director of Public and Private Partnerships Rachelle Axel for her work with AFTA, and her leadership in fundraising.

- RESOLUTION NO. 1205-16-317: Motion to approve the Director of Cultural Affairs entering into a grant agreement with Americans for the Arts for an amount not to exceed $200,000 to support the administration of payment to artist presenters and associated event costs of the Americans for the Arts Convention in San Francisco in June 2017 as part of local host obligations.

- Civic Design Review Committee—Kimberlee Stryker, Chair
- In the absence of Commissioner Stryker, Commissioner Schnair reported that the Committee had a relatively short meeting, reviewing two projects for the Public Utilities Commission at the Southeast Wastewater Treatment Plant (“SEP”). She added that Commissioner Keehn is working to make sure the artists selected for public art projects will be involved from the beginning phases of design, and that it was wonderful to integrate the art and the architecture. Commissioner Schnair reported that the Committee also reviewed conceptual design for new tennis facilities in Golden Gate Park; larger courts will allow tournaments to be held there.

- In the absence of Commissioner Melania, Vice President Ordeñana reported that the Committee did not meet, and he asked Mr. DeCaigny to discuss the following motions. Mr. DeCaigny explained that every year the Commission approves a pool of panelists to serve on review panels; they are then chosen for each specific panel in the spring, based on their background, schedules and the needs for each project. While this pool includes many new people, he added that Commissioners can certainly nominate others if they feel the pool is missing some representation. In response to a question, Mr. DeCaigny explained that any Commissioner who has been sworn in, which they all have been, may serve on a panel, and should contact him or staff if they are interested.
Vice President Ordeñana said that Allison Sparks is a member of the Board of Directors of his employer, the San Francisco Lesbian, Gay, Bisexual, Transgender Center, and that Krista Smith works for Queer Cultural Center, which rents space from his employer. He did not believe either if these represents a conflict of interest, but chose to disclose the information for the sake of transparency.

Mr. DeCaigny explained that the following grants were the result of addbacks from the Board of Supervisors and of the participatory budgeting process. He explained that in the fall, the Arts Commission conducts a special Request for Proposals for these restricted funds. In response to a question, he confirmed that these are one-time grants, and that staff reviews the proposals to confirm that the grantee is capable of performing the work and meets the Board restrictions.
He was pleased to note that one of the projects was the restoration of the Mission Cultural Center’s mural, with funds added back by Supervisor Campos.

- Consent Calendar
There was no public comment.
Commissioner Chew recused himself from consideration of item 11 of the Consent Calendar, regarding a temporary sculpture in the Civic Center Plaza in collaboration with the Asian Art Museum, because he works with the Asian Art Museum. Commissioner Chew left the room at 2:38 p.m.
President Beltran called for a vote on the following item, which was unanimously approved as follows, with the recusal of Commissioner Chew.
RESOLUTION NO. 1205-16-331: Motion to approve temporary sculpture exhibition in Civic Center Plaza in collaboration with the Asian Art Museum featuring work by artist Freeman Lau for a period from January 17–March 10, 2017 at no cost to the City with all funds provided by the Hong Kong Economic and Trade Office, pending approval from the Recreation and Park Commission.
Commissioner Chew returned to the room at 2:39 p.m.

Civic Design Review Committee Recommendations (November 14, 2016)
- RESOLUTION NO. 1205-16-325: Motion to approve Phase 1 of the SEP Power Feed and Primary Switchgear Upgrades project contingent upon the stairs being more holistically incorporated with the concrete massing of the building.
- RESOLUTION NO. 1205-16-326: Motion to approve Phase 1 of the SEP New Headworks Facility project contingent upon: (1) creating a unified rhythm by developing the proportions of the wall through patterns and materials; (2) resolving the ribbed walls of the influent episode wall; and (3) addressing the transitions of the episode walls.
Visual Arts Committee Recommendations (November 16, 2016)
- RESOLUTION NO. 1205-16-327: Motion to approve the untitled mural designs by artist Aileen Barr for Tunnel Top Park. The mosaic murals will be installed along both the north seating wall (15 in. by 44 ft.) and the south seating wall (15 in. by 66 ft.), located within Tunnel Top Park at 1100 Pennsylvania Avenue. The project is funded with a Community Challenge Grant and is sponsored by the Tunnel Top Steering Committee; the mosaic murals will not become part of the Civic Art Collection.
- RESOLUTION NO. 1205-16-328: Motion to approve the mural design based on an artwork, S. P. Tunnels, 1935 by Charles Surendorf. The artwork will be reproduced by the artists Eli Lippert and Monica Magtoto, with approval from the Charles Surendorf II Art Foundation. The painted mural will measure approximately 8 ft. by 11 ft. along the south side wall, located within Tunnel Top Park at 1100 Pennsylvania Avenue. The project is funded with a Community Challenge Grant and is sponsored by the Tunnel Top Steering Committee; the painted mural will not become part of the Civic Art Collection.
- RESOLUTION NO. 1205-16-329: Motion to approve the completed installation of the artwork entitled Shadow Kingdom, 2015, by Adriane Colburn at Daggett Park on 16th Street between Hubbell and 7th streets.
- RESOLUTION NO. 1205-16-330: Motion to approve the design of a bust of former mayor Gavin Newsom, a proposed gift to the City by ArtCare, a nonprofit organization.
- RESOLUTION NO. 1205-16-332: Motion to approve the contract with KiboWorks for the final design, fabrication, transportation and mounting of the Jenny Holzer artwork at the Transbay Transit Center for a total amount not to exceed $725,000.
- RESOLUTION NO. 1205-16-333: Motion to approve the Design Development Deliverables by Christine Corday for the Moscone Expansion Howard Street Project.
- RESOLUTION NO. 1205-16-334: Motion to approve the selected artist Norie Sato for the Southeast Wastewater Treatment Plant Headworks Building as recommended by the selection panel.
- RESOLUTION NO. 1205-16-335: Motion to authorize the Director of Cultural Affairs to enter into contract with Norie Sato for design and construction documents of an artwork for the Southeast Wastewater Treatment Plant Headworks Building in an amount not to exceed $90,000.
- RESOLUTION NO. 1205-16-336: Motion to approve the project outline and proposed method of selection for discrete works of two-dimensional art and sculpture for San Francisco International Airport.
- RESOLUTION NO. 1205-16-337: Motion to approve St. Mary’s Square Extension Plaza as the site location for two sculptures proposed as gifts to the City: (1) a sculpture from 500 Pine St. Co., LLC, in satisfaction of Section 429 of the San Francisco Planning Code; and (2) Comfort Women Memorial to be donated by the Comfort Women Justice Committee and funded privately.
- RESOLUTION NO. 1205-16-338: Motion to approve the proposed design as an alteration of the original monument, Abraham Lincoln Brigade National Monument, 2008 by Ann Chamberlain and Walter Hood (SFAC Accession No. 2008.3) located on the northeast corner of Justin Herman Plaza at Embarcadero Street.

- New Business and Announcements
Commissioner Silverman announced two upcoming art fairs: the Fog Design+Art Fair, and the Untitled art fair, January 12-15.
Mr. DeCaigny reported sadly on the recent passing of two artists connected with San Francisco: composer Pauline Oliveros, 84, and sculptor Houston Conwill, 69.
