Tuesday, July 16, 2002


I. President Mendelson called the meeting to order at 7:40 AM.

2.          COMMISSION MEMBERS PRESENT: Robert Kenealey, Alix Rosenthal, Michael Mendelson, Brenda Stowers, Thomas Schulz. ABSENT:
Richard Shadoian.

4. Public Comment – Peter Cohn spoke in objection to the starting time for this meeting; David Rogers said that the Commission should have made a more detailed statement after the closed session on 4/22/02; Kathleen Grogan spoke about the intent of this early meeting; Dr. Amos Brown spoke in favor of the former Director; Peter Fries said that Item #7 should have been resolved before this meeting; Rev. Arnold Townsend urged the Commission to “stick with the system. It will work for you”; Rev. Gregory Richardson said that money was being wasted; John Bardis congratulated the Commission and wished it had more experience and had acted sooner re: the former Director; Susan Horstall presented 4 letters and spoke in support of the former Director; Helena Brook spoke in support of the former Director.

5. Discussion and possible action to request a supplemental appropriation from the Board of Supervisors for lease of real estate for the Department of Elections and any additional costs presented by the Director that are not covered in the Annual Appropriation. TABLED.

6. Discussion and possible action to support the Board of Supervisor’s proposed legislation regarding paid ballot argument fees and submission deadlines. TABLED.

7. Discussion and possible action to direct the Director to refrain from hiring and firing employees until the Commission approves revised personnel practice standards. TABLED.

8. It was discussed whether to go into Closed Session. DECISION: To go into Close Session.

9. CLOSED SESSION – Commission entered Closed Session at 8:12 pm. Returned to Open Session at 9:00 pm.

10. Discussion whether to disclose Closed Session. The Commission decided not to disclose the Closed Session discussion pursuant to Ralph Brown Act section 54957.1 and Sunshine Ordinance section 67.12.

Public Comment: David Rodgers asked for a general sense of what was discussed with the attorneys, “as fully as the Commission can.”

Commissioner Schulz moved that closed session not be disclosed. Commissioner Kenealey seconded. The vote was 5 – 0.
