MARCH 13, 2013 REGULAR MEETING

The Police Commission of the City and County of San Francisco met in Room

400, City Hall, #1 Dr. Carlton B. Goodlett Place, San Francisco, at 5:35 p.m.

PRESENT: Commissioners Mazzucco, Chan, Kingsley, Turman

ABSENT: Commissioners Marshall, DeJesus, Loftus

CONSENT CALENDAR

- Request of Captain Timothy Falvey, Ingleside Station, for approval to accept

gift of three (3) iPad minis from Ms. Yvette Seifter Hirth for use by members of

Ingleside Station to track stolen phones, other electronic devices, or be used in the

field for other investigative purpose. Valued at approximately $1,977

Motion by Commissioner Kingsley, second by Commissioner Chan. Approved 4-

0.

PUBLIC COMMENT

Ray Hartz commended Captain Falvey on his promotion.

RESOLUTION NO. 13-15

APPROVAL OF THE REQUEST OF CAPTAIN TIMOTHY FALVEY, INGLESIDE STATION, TO

ACCEPT GIFT OF THREE (3) IPAD MINIS FROM MISS YVETTE SEIFTER HIRTH FOR USE BY

MEMBERS OF THE INGLESIDE STATION TO TRACK STOLEN PHONES, OTHER

ELECTRONIC DEVICES, OR BE USED IN THE FILED FOR OTHER INVESTIGATIVE

PURPOSES. VALUED AT APPROXIMATELY $1,977

RESOLVED, that the Police Commission hereby approves the request of Captain

Timothy Falvey, Ingleside Station, to accept gift of three (3) iPad Minis from Miss Yvette

Seifter Hirth for use by members of Ingleside Station to track stolen phones, other

electronic devices, or be used in the field for other investigative purpose. Valued at

approximately $1,977.

PUBLIC COMMENT

Jackee Bryson would like to nominate Captain Redmond for her Lone

Ranger/Bruce Lee award for his good work during an incident on 6th Street.

Ray Hartz announced that we have a new Pope. He spoke in regards to

comments made by Martin Halloran of the POA. (document submitted). "Last month,

Martin Halloran of the Police Officers Association took exception to some of my

remarks. I take equal exception to his remarks and simply ask him to check his facts. I

am amazed that when someone challenges the actions of either the Police Commission

or members of the SFPD, no one has the integrity to show up to defend their own

actions! They send a surrogate who can make remarks disregarding the facts and

successfully evade answering any actual questions that might arise. This is OD #12018

of the SOTF, finding Chief Suhr to have violated the Sunshine Ordinance. St. Goss, for all

his expertise, cannot answer a simple IDR in compliance with the law. Some will say I

simply want to "embarrass" people with my remarks. Not within my power! If the

Order is embarrassing, it is members of the SFPD that have embarrassed the Chief, not

me!"

REPORTS AND ANNOUNCEMENTS

- Presentation of the Document Protocol Report, 4th Quarter 2012

Deputy Chief Shinn, for Chief Suhr, spoke of recent activities included arrests

made for human trafficking, arrest of a suspect for an attack on a toddler at Golden

Gate Park, and the opening of the new substation on 6th Street, and went on to talk

about the testimony of the Chief at the Bipartisan Committee in Washington, DC.

Captain McFadden, Major Crimes Unit, presented the iPhone

robberies/prevention (Wireless Devices) presentation.

Irina, SF Safe Program Director, addressed the Commission and explained what

Safe is doing with the public for prevention and awareness.

Captain Pedrini, Risk Management, presented the 4th Quarter 2012 Document

Protocol Report.

Ms. Samara Marion, OCC, also addressed the Commission regarding the OCC’s

concerns with the Document Protocol Report.

b. OCC Director’s Report

- Review of recent activities

- Presentation of the OCC’s Monthly Comprehensive Statistical Report and

companion reports for the periods January 1, 2013 through February 28, 2013

and January 1, 2012 through February 29, 2012, Mediation of Complaints in

February 2013 and Adjudication of Sustained Complaints in February 2013

Director Hicks presented the OCC’s monthly Comprehensive Statistical Report.

Director Hicks also read an award recently presented to Donna Salazar for her work with

mediations.

Commissioner Mazzucco thanked the City Attorney’s Office for recent victories

in upholding terminations.

d. Commission Announcements and scheduling of items identified for

consideration at future Commission meetings

Inspector Monroe announced that there will be no meeting next week and that

on the 27th of March will be in the Mission District at Everett Middle School, 450 Church

Street, starting at 6 p.m.

PUBLIC COMMENT

Ray Hartz, SF Open Government, thanked Captain McFadden for his

presentation. He went on to talk about Martin Halloran’s comments regarding

Inspector Miranda and his OCC complaint. (document submitted) "Last month, Martin

Halloran of the Police Officers Association took exception to some of my remarks. He

mentioned that there "are avenues o register complaints," mentioned OCC, and

questioned my motives for not using those avenues. According to him, I chose to come

here and make disparaging remarks regarding two SFPD officers, without knowing their

history in the department. He should get his facts straight. I did file a complaint with

OCC in regard to Inspector Miranda. On January 30, 2013, during a break in the police

commission meeting, I handed director Hicks that complaint. I can understand Mr.

Halloran’s confusion in the matter, since here we are six weeks later and I have yet to

receive any acknowledgement of the complaint. I wouldn’t be at all surprised to hear

nothing for 6 to 9 months, only to receive a dismissal form letter regarding the

complaint. Not surprised at all!"

Emil Lawrence suggested that flyers be put up in local areas regarding the

district meeting and went on to talk about crimes in the Mission.
