JANUARY 8 2014 REGULAR MEETING

The Police Commission of the City and County of San Francisco met in Room

400, City Hall, #1 Dr. Carlton B. Goodlett Place, San Francisco, at 5:30 p.m.

PRESENT: Commissioners Mazzucco, Marshall, DeJesus, Chan, Kingsley, Loftus

ABSENT: Commissioner Turman

(Commissioner Marshall arrived at 5:40 p.m.)

APPROVAL OF MINUTES

- For the meetings of November 6th , 13th , December 4th and 11, 2013

Motion by Commissioner Kingsley, second by Commissioner Chan. Approved 5-

0.

PUBLIC COMMENT

Maria Bailey spoke in regards to terrorist. (Document submitted)

Mark Gruber, Taxi Cab Driver, spoke of the death of a child struck by a vehicle

driving for Uber. He spoke of concerns in regards to illegal transport companies.

Carl Macmurdo, taxi driver, stated that this is an enforcement issue and that

insurance fraud is happening and that PUC does not have enough investigators and that

local enforcement should be utilized.

John Han, taxi driver, spoke of enforcements against TNC vehicles not having

liability insurance.

Barry, President Taxicab Association, spoke of probable cause for commercial

liability insurance and stated that this is public safety issue.

John, African Commission, showed a tow-away sign and how his car was stolen

and vandalized and how Barrack Obama wants him killed.

Jordan Nagle, building owner, spoke in regards to legislation by David Chiu and

how it affects the neighborhood.

Stephen, permit consultant, spoke in regards to the Broadway corridor and

concerns regarding clubs in the area and problems due to the entertainment industry.

Barry Toronto, taxicab driver, spoke in regards to the actions of Officer Ma who

responded when he called 911.

Mary Maguire, taxicab driver & former Commissioner, stated that the officers

cannot do the job without the proper tools and spoke in regards to illegal drivers texting

which probably caused the accident killing the little girl. She discussed concerns why

taxi issues are always being passed around. She stated that the PUC cannot do

enforcement.

Ms. Paulette Brown thanked the Department for the toys donated. She went on

to talk about the homicide of her son, Aubrey Abrakasa, and showed names of

individuals involved with the homicide of her son.

Emil Lawrence spoke in regards to the accident on Polk Street and talked about

illegal taxi drivers and not having the proper business license.

Clyde spoke in regards to homicides.

Jakkee Bryson commended Captain Cherniss and officers from Tenderloin

Station and spoke of PC 415, section 14b.

Unidentified spoke in regards to an incident on Black Friday and concern for his

safety.

REPORTS AND ANNOUNCEMENTS

a. Chief’s Report

- Review of recent activities

- Presentation of the Limited English Proficiency Services Annual Report

- Presentation re: Traffic Enforcement Programs & Actions

Chief Suhr spoke in regards to texting while driving and that is a violation but for

an officer to be able to distinguish between commercial and personal insurance is hard.

Chief Suhr spoke of recent events including the gun buyback and spoke of gun violence.

Officer Chiang presented the Limited English Proficiency Services Annual Report

and showed a short video on Spousal and Elder Abuse.

Commander Ali, MTA, presented the Traffic Safety Statistics and Efforts report.

b. OCC Director’s Report

- Review of recent activities

Ms. Ines Fraenkel, for Director Hicks, has no report.

Commissioner Mazzucco reported on attending the Academy’s Graduation on

Friday, December 27th .

Commissioner Loftus reported on attending the event where the Academy

brought the new recruits to the Boys and Girls Club.

Commissioner Kingsley commented on the recent Academy graduation.

Commissioner Marshall reported collecting 1800 guns during the gun buyback

event.

d. Commission Announcements and scheduling of items identified for

consideration at future Commission meetings

Inspector Monroe announced that the next meeting will be on January 22nd

and the joint meeting with the Board of Supervisors Public Safety Committee will be on

Thursday, January 16th starting at 5 p.m., at City Hall, Room 250.

PUBLIC COMMENT

Edward, Bicycle Coalition, spoke in regards to bias of police against bicyclists

and spoke in regards to deficiency of the statistics. He asked that statistics involving

bicyclists be gathered and urge that traffic complaints be logged.

Eric, program designer Bicycle Coalition, stated that full and complete reporting

is happening; that training for the police; what the strategy for focus on the five will be

and how will it be reported to the public.

Unidentified thanked the Department for focus on the five and commended

Commander Ali for being responsive and asked that all collisions be reported by SFPD

and officers should be trained on all levels, enforcement of traffic laws and that there be

transparency in how law is enforced.

Unidentified spoke regarding LEP.

Ms. Paulette Brown stated that the video on domestic violence and elder abuse

was really good and suggested a video for homicide witnesses and asked about a report

on cold cases.

Jakkee Bryson commended San Francisco’s law enforcement and stated that

there is only so much the police can do and people needs to pay attention.

DISCUSSION AND POSSIBLE ACTION TO APPOINT JOHN FITZINGER AS A PATROL

SPECIAL OFFICER, OR TAKE OTHER ACTION, IF NECESSARY

Officer Carla Brown recommended Asst. Fitzinger be appointed as Patrol Special

Officer.

Motion by Commissioner Kingsley, second by Commissioner Loftus. Approved

5-1.

APPROVAL TO APPOINT ASSISTANT PATROL SPECIAL OFFICER JOHN FITZINGER TO

PATROL SPECIAL OFFICER

RESOLVED, that the Police Commission hereby approves to appoint John

Fitzinger to Patrol Special Officer.

AYES: Commissioners Mazzucco, Marshall, DeJesus, Kingsley, Loftus

NAYS: Commissioner Chan

ABSENT: Commissioner Turman
