SUNSHINE ORDINANCE TASK FORCE

COMPLAINT COMMITTEE

Members: Daniel Guillory, Chair, Bruce Brugmann, Paul Hogan

Roll Call: All present

1. Approval of minutes of January 16, 2001.

    Minutes approved. (Guillory/Brugmann)

    No public comment.

3. Complaint by SEIU Local 790 & The Committee to Save Our Services

    Public Comment from Ms. Fernandez, Bayview Hunters Point Mental Health Center; had not heard this was a complaint before reading it.

    Member Brugmann asked about the amount of money received from the foundation.

    Male speaker, Member of Bayview Hunters Point Foundation, stated they were receiving $8 million a year.

    Motion adopted that the Task Force has jurisdiction over this complaint and the item be placed on the full Task Force agenda. (Brugmann/Hogan)

2. Reconsideration of Clements/Jamerson complaints

    No public comment.

    Moved the Sunshine Task Force request the newly elected Board of Supervisors ask the State Attorney General for an opinion on these two complaints regarding a possible violation of the State Brown Act and the Sunshine Ordinance and the provision this time it not be subverted in any way, shape or form by anybody, that it go to the Board of Supervisors just like this as it was originally passed by the entire Task Force on a unanimous basis. No second to the motion.

    Moved this Committee waive any possible conflict of interest there may be to being advised by Deputy City Attorney Buck Delventhal. Committee Chair Guillory asked for an explanation of this motion. Member Hogan stated what would give rise to sending a letter to the Attorney General would be a perceived conflict of interest between our counsel who is advising us on this matter and the impartiality of that counsel and his/her ability to advise us and partially regarding the Brown Act and the Sunshine Ordinance and this body waive that conflict of interest so we eliminate those allegations and continue to be advised by Mr. Delventhal in this matter. No second to the motion.

    Member Brugmann stated there is jurisdiction. Motion adopted the Sunshine Ordinance Task Force has jurisdiction over this issue. (Brugmann/Hogan) (Guillory no)
