Approval of minutes of July 12, 2005.

Motion to approve minutes as of July 12, 2005 as amended. (Wolfe/Cauthen)

Continued item on determination of jurisdiction of complaint filed by Richard Midgett against the Controller’s Office for alleged failure to provide access to process/verification of funding resources.

Motion to continue item to next meeting without objection.

Determination of jurisdiction of complaint filed by Juan De Anda against the Department of Public Health for alleged denial of budget reports used to conduct Outreach from the Cultural Competence and Consumer Relations Office.

Speakers: Juan De Anda, complainant; Susan Esposito, Assistant Director of Clinical Services, Department of Public Health; Dr. Tina Yee, Director of Cultural Competence and Consumer Relations Office; Helene Brook, Executive Director of SF Mental Health Board spoke on SF Mental Health Board experience with Department of Public Health.

Motion to recommend jurisdiction of complaint filed by Juan De Anda against the Department of Public Health for alleged denial of budget reports used to conduct Outreach from the Cultural Competence and Consumer Relations Office. (Wolfe/Pilpel)

Determination of jurisdiction of complaint filed by Patrick Monette-Shaw against the Mayor’s Long Term Care Coordinating Council (LTCCC) for alleged refusal to take public testimony on one of the agenda items, and claiming it was a passive meeting body not subject to Sunshine Ordinance rules.

Speakers: Patrick Monette-Shaw, complainant; Anne Hinton, Director of Aging and Adult Services (DAAS); Donna Calame, LTCCC Member spoke in support of DAAS.

Motion to recommend jurisdiction of complaint filed by Patrick Monette-Shaw against the Mayor’s Long Term Care Coordinating Council (LTCCC) for alleged refusal to take public testimony on one of the agenda items, and untimely posting of meeting agendas and minutes. (Wolfe/Pilpel)

Determination of jurisdiction of complaint filed by James Keys against the Mayor's Office for alleged violation of public records access regarding Comcast information.

Member Pilpel disclosed he is a friend of Ms. Darlene Chui, however, he is able to make objective decisions regarding this item.

Motion to recommend jurisdiction of complaint filed by James Keys against the Mayor’s Office for alleged violation of public records access regarding Comcast information. (Wolfe/Cauthen)

Determination of jurisdiction of complaint filed by Tom Feledy against the Department of Human Resources and San Francisco Police Department, for alleged denial of access to public records pertaining to 2004 SFPD Lieutenant's test citing attorney-client privilege; and the Civil Service Commission for alleged misuse of the "anticipated litigation" exception to the Brown Act.

Member Pilpel disclosed friendship with Ms. Favetti and Ms. Sanchez, but able to make objective decision.

Speakers: Tom Feledy, complainant; Kate Favetti, Executive Officer, Civil Service Commission; Jennifer Johnston, Department of Human Resources (DHR), spoke on behalf of DHR and Police Department.

Motion to recommend jurisdiction of complaint filed by Tom Feledy against the Department of Human Resources and San Francisco Police Department for alleged denial of access to public records pertaining to the 2004 SFPD Lieutenant’s Test citing attorney-client privilege and attorney work product and motion to recommend jurisdiction of complaint against the Civil Service Commission pertaining to the 2004 SFPD Lieutenant’s test for alleged citing anticipated pre-litigation defense exception to the Brown Act. (Pilpel/Wolfe) (Note: This complaint will be considered as 2 separate complaints.
