Complaint filed by Michael Addario against the San Francisco Arts Commission for alleged violation of meeting rules.

Mr. Addario, complainant, said the Arts Commission did not consult the Street Artists Program Committee about changing its meetings from monthly to bimonthly. The San Francisco Street Artists fully fund the City program. He also said a web site for the program was created free of charge, but the person later wanted payment for her services. Without member's knowledge, he said, the web site creator was paid a $500 honorarium taken from the membership's funds. Later, when commissioners agreed to pay for a new web site, members were not told of its purpose, goal and design and there was no mention of a competitive bidding process.

Mr. Howard Lazar, director of the Street Artists program, said the complaint is without merit because the Arts Commission has discretion to discuss and take action on committee meeting schedules. He also said all postings, discussions and actions related to the case met Sunshine Ordinance requirements as they were clearly noticed on the Arts Commission agenda. There is, he added, no provision in the Sunshine Ordinance which requires an agency to hear a matter concerning committee meeting schedules or any other item of business at an advisory committee level before presenting the matter to the full commission for consideration and action.

Chair Cauthen said even if Mr. Addario's complaint is without merit, the fact that an allegation is made about a section of the Sunshine Ordinance does give the Task Force de facto jurisdiction

In rebuttal, Mr Addario said agenda and agenda changes were always placed on the Street Artists' web site whereas the meeting change was placed on the Arts Commission web site
