SUNSHINE ORDINANCE TASK FORCE

COMPLIANCE AND AMENDMENTS COMMITTEE

MINUTES*

Wednesday, September 10, 2003

Call to Order

The meeting convened at 4:00 p.m.

Roll Call: All present

1.

Approval of minutes of August 13, 2003. Minutes approved (Nickliss/Knee)

2.

Report on Orders of Determination and requests from Committee.

Report given.

Public comment from Sue Cauthen regarding the Library’s non-compliance with the Order of Determination on her complaint.

The Task Force Administrator will send a letter to Mr. Housh of the Library and request a formal response regarding the Order of Determination.

This item is to be scheduled for the next Compliance and Amendments Committee meeting.

3.

Discussion of public hearing before the Ethics Commission regarding procedures for screening and training applicants to City commissions and at-will employment.

The Task Force Administrator will ask the Sunshine Task Force members if they attended the public hearing to prepare a written report for the Task Force members.

4.

Discussion of possible amendments to the Sunshine Ordinance.

Deputy City Attorney Llorente handed out a memorandum dated September 10, 2003 regarding discussion points for proposed amendments.

Discussion for the next Compliance and Amendments Committee meeting: (1) memorandum on proposed amendments; (2) amendments regarding non-profits that may have influence over City agencies because they provide funding; and (3) off-site meeting requirements. The Task Force Administrator will invite Mr. Jim Chappell of the San Francisco Planning and Urban Research Associates to discuss off-site meetings.

Public comment from Sue Cauthen regarding non-profits funding requirements, off-site meeting requirements, and Mr. Chappell’s request to be noticed for all future meetings.

Member Nickliss recommended that subsequent drafts of proposed amendments should include changing the name of the Sunshine Ordinance Task Force to the Open Government Commission.

5.

Possible dates and places for community meetings.

The Task Force Administrator handed out a list of possible groups to invite to community meetings and possible dates for meetings.

Other groups were added to the contact list as follows:

  • Carolyn Knee, San Franciscans for Sunshine
  • Non-profit organizations
  • Green Party County Council
  • The Reform Party
  • The American Independent Party


A recommendation was made to hold four meetings, one every two months between September and March.

Public comment from Sue Cauthen regarding her position as volunteer community liaison representative and recommended inviting groups that she has had contact with to the community meetings.


Deputy City Attorney Llorente recommended notifying the friends of every department.

7.

Future Committee items. No additional items were discussed. The next regular meeting is scheduled for October 13, 2003, 4:00 p.m.
