COMPLIANCE AND AMENDMENTS COMMITTEE


MINUTES*

Wednesday, May 12, 2004

4:00 p.m., City Hall, Room 406

Note: First name indicates member making motion; second name indicates member seconding motion. All items unanimous except as noted.


Call to Order: Meeting convened at 4:10 p.m.

Approval of minutes of April 14, 2004. Approved. (Nickliss/Knee) (Dogwill absent)

2.

Administrator’s report. (discussion and possible action)

(a) Report on Orders of Determination.

  1. Progress of Dan Boreen complaints

Report given by Administrator.

Public comment from Peter Warfield regarding his two additional complaints and why they were placed on the Compliance & Amendments Committee agenda; also regarding letter from the Public Library dated May 5, 2004 regarding his Order of Determination of April 22, 2004 and the two current complaints he has submitted.

Peter Witt regarding additional complaint against the Taxi Commission of January 13 and March 23, 2004

The Committee reviewed Taxi Commission videotapes of January 12 and March 23, 2004.

Mr. Witt addressed the Committee expressing his concern regarding not being able to speak at the public comment portion of the meetings.

After discussion among the members of the Committee and having viewed the two video tapes, the Committee found no violation of Mr. Witt being denied public speaking time; no action was taken on this item.

4.

John Kelly regarding follow-up on the Compliance & Amendments Committee meeting consensus of April 14, 2004.

Mr. Kelly addressed the Committee expressing concern the notes and measurements at 525 5th Street had been destroyed.

Jim Hutchinson, Department of Building Inspection, stated the department no longer has the measurements.

This item was continued to the June meeting.

5.

Peter Warfield regarding two additional complaints against the Public Library.

Mr. Warfield requested a hearing before the full Task Force on his May 4, 2004 complaint requesting additional information on RSI.

This complaint will be forwarded to the full task force meeting of May 25, 2004 for a public hearing.

Motion adopted requesting a letter be sent to the Public Library regarding Mr. Warfield’s complaint dated May 4, 2004, which referred to the Task Force Order of Determination of April 22, 2004. The letter will request the Public Library to respond to the Compliance & Amendments Committee regarding their response to the Order of Determination of April 22, 2004.

6.

Discussion regarding departments’ failure to submit sole source contract information. This item placed on the full Task Force agenda for May 25, 2004.

7.

Public comment for items not listed on the agenda.

Public comment from Peter Warfield regarding outlining Compliance & Amendments Committee procedures; and requested letters be sent to repeat violators of the Sunshine Ordinance.

Public comment from Doug Comstock regarding the proposed amendments to the Sunshine Ordinance; outlining dates of meetings with Supervisors.
