Report from Compliance & Amendments Committee meeting of December 10, 2003.
Committee Chair Richard Knee reported on the meeting of December 10, 2003 as follows.
- Mr. Dan Boreen and the Fire Department agreed to work together to resolve Mr. Boreen’s complaint with Task Force Administrator Hall’s assistance. Task Force Administrator Hall stated that she had been in contact with Mr. Boreen and would be setting up meetings.
- Mr. Peter Witt’s complaint had been continued to the next Compliance and Amendments Committee meeting at which time tapes of recent Taxi Commission meetings would be made available to review.

Resolution requesting the City Attorney to designate a Deputy City Attorney to inventory records of Mayor’s Office for preservation as public records and available for public inspection in accordance with the Sunshine Ordinance and the city’s record retention policy.
Mr. Tim Redmond, Bay Guardian discussed designating a Deputy City Attorney and member of the Sunshine Task Force to monitor compliance with retention of public records by the Mayor’s Office during the transition of Mayors. The December 12, 2003 letter from City Attorney, Dennis J. Herrera to Mayor Willie L. Brown, Jr. regarding transition – retention of public records was discussed.
Motion to pass a Resolution requesting the City Attorney designate a Deputy City Attorney or other representative to inventory the records of the Mayor’s Office for preserving as public records and available for public inspection in accordance with the Sunshine Ordinance and the City’s record retention policy and in the spirit and philosophy of providing assistance to the Mayor’s successor and all future successors in obtaining information and background on ongoing issues. (Knee/Nickliss)
Public comment from Mr. Dan Boreen recommending that all shredders should be disallowed in the City and County of San Francisco.
Public comment from Mr. Peter Warfield in strong support of the above motion. He discussed a section in the Sunshine Ordinance that gives the Task Force broad powers to research, investigate and provide reports to City departments with regard to a range of activities related to the Sunshine Task Force Ordinance. Department retention policy was discussed.
Amendment to Motion: Motion to urge the City Attorney to offer assistance to the Mayor, the District Attorney, and all outgoing department heads in ensuring that all public records from their tenures remain intact and be publicly accessible. (Knee/Nickliss) (Ayes: Jenkins, Knee, Nickliss, Sterner, Mehra and Williams) (Noes: None) (Absent: Brugmann, Cauthen, Comstock, Dogwill, Parker)
Public comment from Mr. Dan Boreen to include acting department heads in the motion.
Public comment from Mr. Peter Warfield endorsing the broadest possible application of the above motion.

Public hearing, complaint of Daniel Boreen against the Fire Department for alleged failure to provide records. (continued from last meeting)
Mr. Daniel Boreen spoke in support of his complaint stating that the July 22, 2003 Order of Determination did not cover the investigation statements.
No action taken.
