1. Call to Order and Roll Call: Commissioner Lantz called the meeting to order at 5:10p.m. Commissioners Present: Commissioners Baires, Copi, Der, Hall, Herzallah, Jackson, Kwong, Lantz, Lauterborn, Lazer-Smith, Lauterborn, McLaughlin, Mourning, Rodriguez, White, and Williams Commissioners Absent: Commissioner Chang Staff Present: Colleen Montoya, Ron S. McCan, and Ayoka Turner.

2. Motion to approve agenda: There was a motion to approve the agenda. Motion Approved.

3. Staff Report:

Ayoka reviewed the Committee dates and times, and asked Commissioners to turn in their bio’s and business card order forms if they have not yet done so.

8. Old Business

  1. Discussion and possible action re: Referral from the Board of Supervisors, File 041148: Ordinance amending San Francisco Police Code Sec. 1022 to define "security plan"; amending Police Code Sec. 1023 to require applicants for dance permits to have a security plan, and to require owners or managers of places that are rented to persons planning to use the facility for a dance to inform such persons that a permit is required for such activity; amending Police Code Sec. 1027 to make the violation of Secs. 1023 through 1026 an infraction or a misdemeanor, to increase the maximum penalty for violation thereof to $1000, and subject to revocation of the permit; amending Police Code Sec. 1060 to define "security plan;" amending Police Code Sec. 1060.5 to revise determination of application criteria to require a security plan; amending Police Code Sec. 1060.25 to increase the maximum penalty for violation of Article 15.1 to an infraction or a misdemeanor, to increase the maximum penalty for violation thereof to $1000, and subject to revocation of the permit; adding Police Code Sec. 1060.29 to require one night event permits for one night events; and amending Police Code Sec. 2.26 to include one night events under the schedule of permits and filing fees. Amy Ackerman, Deputy City Attorney reviewed the legislation with the Commissioners and answered questions. Terrance Alan, Chair of the Late Night Coalition gave public comment. There was a motion to not support this legislation at this time. MOTION APPROVED. There was a motion to send the following statement:

We as the Youth Commission are primarily interested in insuring safe events for all youth in San Francisco. Unfortunately, in our opinion this legislation is overall incomplete, and should be re-worked before the full Board of Supervisors votes on it. This law, named after Scharod Flemming should be re-worked so that it is clear that this legislation would have actually kept him safe and alive.

At this time, the San Francisco Youth Commission is unable to support this legislation based on the following points:

  • This legislation is based on a single event and is a ‘one size fits all solution’. It is not indicative of typical youth events in San Francisco. We don’t want this legislation to be a ‘solution looking for a problem’.
  • This legislation will make it more difficult for youth to find and/or create safe events.
  • The Youth Commission does not believe that the security measures outlined in this legislation will achieve the goal of creating safer spaces or replaces community involvement in making safe youth events.
  • There is no definition of what "Security" means, or the requirements for who can be "Security."
  • There are conflicting/confusing fee requirements for One-Night Dance Permits ($44) vs. One-Night Event Permits ($255). It isn’t clear what the difference between these two permits is. In the opinion of the Youth Commission, the $44.00 fee would be the preferred fee for both permits.
  • This legislation only amends a portion of the entertainment laws and doesn’t fix some other key issues.
  • This legislation seems to have been formed without coordinated input from youth organizations, the Entertainment Commission, community groups and the San Francisco Police Department.
  • The 10-day waiting period and hearing required for One Night Dance Permits seems excessive and is not necessary.
  • Events that are not for the purpose of making a profit should have different requirements as events that are for the purpose of making a profit.
  • The amended legislation should include input from the broader entertainment community, which will be affected by this legislation.
  • This legislation should separately address events for 100 people or less, or should exempt them from this process.

Motion Approved.

9. New Business

  1. Discussion and possible action re: Approval of Absence for Commissioners Baires (9/7 meeting) and Chang (9/20 meeting). Commissioner Baires: excused. Commissioner Chang was not present at this meeting.
  2. Discussion and possible action re: Approval of Request for Leave of Absence for Commissioner Chang [Commissioner Chang]. There was a motion to approve Commissioner Chang’s absence. MOTION APPROVED.

  3. Discussion and possible action re: Youth Commission’s 2004-2005 Executive Committee Elections. Community Affairs Officer: Commissioner Williams (unopposed): Unanimous. Media & Public Relations Officer: Commissioner Der: 5; Commissioner McLaughlin: 6; Commissioner White: 5. There was a second vote: : Commissioner Der: 5; Commissioner McLaughlin: 5; Commissioner White: 5. There was a third vote: Commissioner Der: 2; Commissioner McLaughlin: 5; Commissioner White: 8. There was a run-off between Commissioners McLaughlin and White. Commissioner McLaughlin: 5; Commissioner White: 10. Commissioner White is elected Media & Public Relations Officer.

  4. Discussion and possible action re: Report back on the Teacher’s for Social Justice Conference and Youth Commission Media Training held on Saturday, October 2, 2004. Commissioners reported back on their experience at the Teachers for Social Justice Conference and the media training.

  5. Discussion and possible action re: Referral from the Board of Supervisors, File 041150: Ordinance amending Article 23 of the San Francisco Public Works Code by (1) amending Sections 1301 through 1304, deleting existing Section 1305, amending and retaining part of existing Section 1306 as renumbered Section 1305, and amending and placing part of existing Section 1306 in new Section 1306, to require that property owners either remove graffiti from their property or request a hearing within 30 days of receiving a notice of violation, clarify and streamline review procedures for graffiti violations, and authorize special assessments to recover graffiti removal costs; and (2) making technical corrections to Sections 1307 and 1308. Rebekah Krell from Supervisor Elsbernd’s office introduced this item and answered questions from the Commissioners. There was a motion to support this item. Motion Failed.

  6. Discussion and possible action re: Referral from the Board of Supervisors, File 041098: Resolution authorizing the Department of Children, Youth and Their Families to accept and expend a grant in the amount of $339,964 from the United States Department of Justice, Violence Against Women Office for Safe Havens. There was a motion to support this item. Motion Approved.
