(1)    PUBLIC COMMENT: 

 

At this time, members of the public may address the Board on items of interest to the public that are within the subject matter jurisdiction of the Board except agenda items.  With respect to agenda items, your opportunity to address the Board will be afforded when the item is reached in the meeting with one exception. When the agenda item has already been reviewed in a public hearing at which members of the public were allowed to testify and the Board has closed the public hearing, your opportunity to address the Board must be exercised during the Public Comment portion of the calendar.   Each member of the public may address the Board for up to three minutes.   If it is demonstrated that comments by the public will exceed 15 minutes, the President may continue Public Comment to another time during the meeting.

Discussion and possible adoption of the Jan. 26, 2011 minutes.

 

ACTION: Upon motion by President Goh, the Board voted 5-0 to adopt the January 26, 2011 minutes.

(4)    ADDENDUM ITEMS: 

 

(4a)    JURISDICTION REQUEST: 

 

Subject property at 2350 Broadway.  Letter from John Sanger, attorney for Adam Rubinson, requestor, asking that the Board take jurisdiction over BPA No. 2010/09/27/1718, which was issued on Nov. 15, 2010.  The appeal period ended on Nov. 30, 2010, and the jurisdiction request was received at the Board office on Jan. 12, 2011.  Permit Holder: Michael Bykhovsky.  Project: complete interior renovation; replace in-kind all exterior street façade windows with new insul units to match; infill east light well at 3rd and 4th floors; excavate basement/crawl for new basement floor at rear; remodel all floors; provide new interior stairs; new skylights at roof.

 

ACTION: WITHDRAWN BY REQUESTOR.

.  Appeal Nos. 10-105/106, Canaan TutoringCenterService & ChineseGospelChurch vs. DBI, PDA, decided Nov. 17, 2010.  At that time, the Board voted 4-0-1 to revoke the subject permit with adoption of findings at a later time.  Permit Holder: Greg Schoepp.  Project: new medical cannabis dispensary (MCD) in former chiropractor’s office; minor interior alterations; BPA No. 2009/12/03/2572.

 

ACTION: Upon motion by Commissioner Fung, the Board voted 5-0 to adopt the findings as amended: deleting paragraph 4(f) and revising paragraph 4(h).

Appealing the denial on Aug. 16, 2010, of Regular Taxi Medallion.

PUBLIC HEARING HELD AND CLOSED ON OCT. 20, 2010.  FOR FURTHER CONSIDERATION TODAY.  Note: matter continued to allow time for parties to submit additional info pursuant to the Board’s comments; additional briefing is allowed.

 

ACTION: Upon motion by Commissioner Fung, the Board voted 3-2 (President Goh and Commissioner Hwang dissented) to grant the appeal, overrule the department and direct MTA to issue the medallion, with findings to be adopted at a later time.  Lacking the four votes needed to pass, the motion failed.  With no further motion made, the departmental determination was upheld as a matter of law.

Appealing a forty-five (45) - day suspension of a Tobacco Product Sales Establishment Permit, imposed on Dec. 08, 2010.  Reason(s) for suspension: selling tobacco products to minors.

ACTION: Upon motion by President Goh, the Board voted 5-0 to reschedule this matter to February 16, 2011.

ACTION: Upon motion by Commissioner Fung, the Board voted 3-2 (Vice President Garcia and Commissioner Peterson dissented) to deny the appeal and uphold the department on the basis that the permit complies with the Planning and Building Codes and the department did not err in issuing it.

ACTION: Upon motion by Vice President Garcia, the Board voted 2-3 (President Goh, Commissioner Fung and Commissioner Hwang dissented) to grant the appeal and overturn the department with findings to be adopted at a later time.  Lacking the four votes needed to pass, the motion failed.  With no further motion made, the departmental determination was upheld as a matter of law.
