Chair Tan called the meeting to order at 5:36PM.

2. Approval of Meeting Minutes.  Discussion and possible action to approve the minutes of the (continued minutes) February 16, 2016, March 15, 2016 & April 5, 2016 Commission meeting [Action item]

3. Report from the Sound Inspectors Jordan Pauley and Sean Burke report on recent venue sound inspections and report of activities by staff. [Discussion Item]

Inspector Pauley report for 4/19/16 meeting

COMPLIANCE:

4/17/2016 2:15 AM Beatbox 314 11th St.: Have received several complaints about entertainment noise emanating from the venue during afterhours operation. Venue was in compliance.
4/17/2016 12:15 AM Holy Cow Nightclub 1535 Folsom St.: Observed sound, patron management, atmosphere of venue. In compliance.
4/16/2016 12:00 AM Hue 447 Broadway: Talked to venue management and security about issues regarding their smoking section – which is now located on the sidewalk, and whether or not it would be a good idea to move it back into the alley where it was previously located. On busier nights, sidewalk smoking section causes foot-traffic congestion. In compliance.
4/15/2016 11:30 PM Fort One 2801 Leavenworth St.: Venue has been operating quietly over the last month or so. Noise has been under control as well as line management and security presence. In compliance.

COMPLAINTS:

4/17/2016 2:20 AM Hawthorn 46 Geary St.: Neighbors are complaining about noise emanating from venue. Discussed matter with main complainant and SRO hotel management. An interior soundtest is scheduled for the coming weekend.
4/13/2016 12:45 AM 1015 Folsom 1015 Folsom St.: A complaint was received in regards to a midweek event.
4/7/2016 5:15 PM The Square Bar & Kitchen 1707 Powell St.: A neighbor complained about noise of interior speakers. Speakers are located within the walls, unbaffled. Management was given 30 days to remove speakers from wall or face further action.

VIOLATIONS:

4/16/2016 1:20 AM Kells Irish Pub 530 Jackson St.:  Venue was noticeably in violation of sidewalk ordinance well before end of the night/last call. Venue issued NOV.

Inspector Burke report for 4/19/16 meeting

4/17/17  El Toro   470 San Bruno Ave.  Complaint of music audible inside residence. Investigation pending.

4/8/16   8:45P     Playland  1351 Polk St.  Took ambient measurement to assist with complaint investigation.

4/8/16   1:30A     Playland  41 Frank Norris St.  Took measurements inside residence to assist in frequency analyzation.

4/9/16   9:18P     Forrest Hill Clubhouse   301 Magellan Ave.  Site visit triggered by complaint via mobile phone call. NOV issued.

4/16/16 1:30A    Public Works  161 Erie St.  Site visit triggered by complaint via mobile phone text. NOV issued.

SITE INSPECTIONS

4/9/16   11:30P   Revolution Café   3248 22nd St.  Onviewed crowded sidewalks during routine patrol and investigated.

4/16/16 10:15P   Asiento 2730 21st St. site visit to investigate complaint of noise between the hours of 9-10pm.

4. Police Department Comments & Questions.

This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety. [Discussion Item]

5. Consent Calendar

All matters listed hereunder constitute a Consent Calendar, are considered to be routine by the Entertainment Commission, and will be acted upon by a single roll call vote of the Commission.  There will be no separate discussion of these items unless a member of the Commission, the public, or staff so requests, in which event the matter shall be removed from the Consent Calendar and considered as a

6. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

Regular Agenda:

EC-1363 – Gouddou, Michael & Timothy Landregan, Dada Bar, 65 Post Street, Place of Entertainment Permit, Change in Location.

Deputy Director Maggie Weiland stated the first permit this evening is for a Place of Entertainment permit application for Dada Bar. Dada Bar obtained a Place of Entertainment permit from our Commission in 2011 for their original location on 2nd Street. This permit application is for a change in location. The same owners are moving their business to 65 Post Street and plan to keep their existing art bar concept. Dada is primarily an after-work destination in the Financial District. It will also be used for art openings as well as private parties, and will have entertainment including DJS, poetry readings, and small live bands. Central Station approves this permit application and recommends three conditions that you will see in the back of your packet. Present were the owners of the Dada Bar were Michael Gouddou and Timothy Landregan.

Ralph and Executive Director of the Mechanics Institute was in support of the permit application.

Debbie a Library Director at the Mechanics Institute supports the permit application.   

Bill Shafer supports the permit application.

EC-1364 – Lau, Vince, Alex Lau & Colm Dougherty, Fiddler’s Green of SF, 1333 Columbus Avenue, Place of Entertainment Permit, Change in Ownership.

Deputy Director Maggie Weiland stated the second permit this evening is a change in ownership Place of Entertainment permit application for Fiddler’s Green of SF located at 1333 Columbus Avenue. The new owners of the longtime San Francisco bar, and Place of Entertainment under the previous owners, plan to keep the original Irish theme, operations, and entertainment. They will have entertainment daily until 2am including traditional Irish music starting at 9:30pm nightly, and DJs beginning at 10pm on weekends. Central Station approves this permit application and recommends three conditions that you will see in the back of your packet. Present were the owners of Fiddler’s Green of SF Vince Lau and Colm Dougherty.

Public comment

Dana Sheblee lives in the complex in the back of the venue.  He added there were times when the venue has been extremely loud on the weekends.    He added his intent was not to say it was too noisy but feels proper sound proofing and some restrictions due to the sound.

Commissioner Frost suggest they continue the item until a manager brought is brought in to address some concerns in since the Commission did not seem comfortable with the answer to some questions.

Commissioner Thomas moved to approve with the conditions that sound does not start until 10AM and the speakers are not to face Newcom Avenue, sound inspector sets noise levels and amplification to end at 10PM except for one night a month until midnight with notice to SFPD/EC and conditions set by staff and Commissioner Perez second the motion.
