Chair Tan called the meeting to order at 5:37PM.

Director, Jocelyn Kane called the Roll.

Absent Demetri Moshoyannis.
Chair Tan made one edit to item 5B on the consent calendar would be pulled and placed on the regular agenda.

8/2/15 4:00 PM Nihonmachi Street Fair Japantown Peace Plaza – Post St. btwn Webster & Laguna
Complaint from 1501 Post regarding loud bass. Investigated and requested that producers lower bass on stage closest to complainant address. Admonished for sound being audible in excess of 250 feet from the last attendee of the event.

COMPLAINTS:
8/15/2015 9:30 PM Swank 488 Presidio Ave.: A complaint was generated in regards to noise emanating from an open door.
8/15/2015 8:50 PM Lone Star 1354 Harrison St.: A complaint was generated in regards to noise and open windows at the venue. Hot weather may have been at cause.
8/14/2015 11:30 PM Unpermitted Event 1559 Howard St.: A complaint was generated in regards to another illegal party. Planning department has assigned personnel to look into the situation.
8/14/2015 10:30 AM Unpermitted Event 398 11th St.: A complaint was generated in regards to an illegal event.
8/14/2015 10:00 PM City Club 155 Sansome St.: Another complaint was generated in regards to noise at the event space. In contact with lawyer.
COMPLIANCE:

8/6/2015 4:00 PM The Devil’s Acre 256 Columbus Ave.: A sound test was performed and a recommendation issued in regards to the venues approved LLP.
INSPECTIONS:
8/9/2015 5:00 PM The Endup 401 6th St.: A walk through inspection was performed. In compliance.
4. Police Department Comments & Questions. [Discussion Item] This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety).

5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

There will be no separate discussion of these items unless a member of the Commission, the public, or staff so requests, in which event the matter shall be removed from the Consent Calendar and considered as a separate item at this or a future hearing.

d) EC-1336 – Pigott, Nicholas, The Grubstake Diner, 1525 Pine Street, Extended Hours Premises Permit.
Mark Rennie spoke on behalf of the applicant. He added the venue has been around since the 70’s recommends the location and their food and was a legacy venue. He added they will add a security person and request a conditional grant.
Commissioner Joseph stated she loves the venue.

e) EC-1337 – Chun, Andrew, Press Club, 20 Yerba Buena Lane, Place of Entertainment Permit.
Andrew Chun stated he also owned Schroder’s for live entertainment. He added he wanted to get the Press Club above board and have been in business since 2008. He added they were an active part of the community. He added they have not had any incidents and would remain a wine bar.
Officer McGoldrick with Southern police station recommends approval for the permit application.

f) EC-1338 – Wathen, Craig, Amnesia, 853 Valencia Street, Place of Entertainment Permit.
Craig Wathen stated they wanted to continue the business as is. He added they held a meet and greet for residence in the neighborhood to let them know their business plans.
Officer Parker was in support of the application she added there were no police concerns for the venue as there has been no prior issues.
Ryan Hogan stated he was in support of the permit.
Jen Anderson supports permit application.
Bryant Dennison supports permit application.
Jody Richardson supports permit application. venue.
Elsa stated she supported the venue and permit application.
Patrick Stevens stated he supports venue and the live music.
Heidi a Bookkeeper who lives across from the venue supports the venue.
Mark Rennie supports venue, feels the venue was a magic bar.
Jeff a local musician fully supports the venue and welcomes the new owner.

6. Report from the Residential Development Review Committee The Committee is a 3-member group that meets before the Regular Entertainment Commission meeting to review residential projects per Admin Code 116 and make recommendations. [Action item]
Chair Tan stated they meet for the very first time as a committee included himself, Commissioner Joseph and Commissioner Caminong. He added essential they had several guest which included one of the owners of 1015 Folsom and an architect for residential projects who wanted to be informed of what the Commission’s conditions would be on types of projects. He added the bulk of meeting was about recommendations on noise attenuation. He added the plan was to have a standing basic item on the regular agenda that has an update about the projects they looked at or the work they need approved by the entire commission.
7. Recommended Noise Attenuation Conditions for Chapter 116 Residential Projects. Discussion and possible action to adopt a standard set of recommended conditions relating to noise attenuation to be provided to the Planning Department and Department of Building Inspection for all proposed residential projects within 300 radial feet of a Place of Entertainment [Action Item]
Commissioner Joseph suggested to put the record into document.
RECOMMENDED NOISE ATTENUATION CONDITIONS FOR CHAPTER 116 RESIDENTIAL PROJECTS:
Outreach: Project sponsor shall include in its community outreach process any businesses located within 300 feet of the proposed project that operate between the hours of 9PM‐5AM. Notice shall be made in person, written or electronic form.
Sound Study: Project sponsor shall conduct an acoustical sound study, which shall
include sound readings taken when performances are taking place at the proximate
Places of Entertainment, as well as when patrons arrive and leave these locations at
closing time. Readings should be taken at locations that most accurately capture sound from the Place of Entertainment to best of their ability.
Any recommendation(s) in the sound study regarding window glaze ratings and soundproofing materials including but not limited to walls, doors, roofing, etc. shall
be given highest consideration by the project sponsor when designing and building
the project.
Design Considerations:
(1) During design phase, project sponsor shall consider the entrance and egress location and paths of travel at the Place(s) of Entertainment in designing the location of (a) any entrance/egress for the residential building and (b) any parking garage in the building.
(2) In designing doors, windows, and other openings for the residential building, project sponsor should consider the POE’s operations and noise during all hours of the day and night.
Construction Impacts: Project sponsor shall communicate with adjacent or nearby
Place(s) of Entertainment as to the construction schedule, daytime and nighttime, and consider how this schedule and any storage of construction materials may
impact the POE operations.
Communication: Project Sponsor shall make a cell phone number available to Place(s) of Entertainment management during all phases of development through construction. In addition, a line of communication should be created to ongoing building management throughout the occupation phase and beyond.
Commissioner Frost stated it was good and it was a working document and was an excellent stating point.

8. Commissioner Comments & Questions. [Discussion item]
Commissioner Joseph thanked staff for the Entertainment Commission and the people who donated the food. She added the Commission has come a long way.
Commissioner Lee stated Elton John was great and they were doing a great job trying to keep the neighbors happy.
Commissioner Caminong thanked Inspector Burke for taking her on the ride-along. She added it was a real eye-opening experience and they went to six venues and it was a good education and recommended it her fellow Commissioners.
9. New Business Request for Future Agenda Items. [Action item] (This item is to allow Commissioners to introduce agenda items for future consideration).
Chair Tan stated the regularly commission
meeting for September 1, 2015 has been
cancelled and the next scheduled meeting is
September 15, 2015.
