2. Approval of Meeting Minutes.  Discussion and possible action to approve the minutes of the November 19, 2019, and December 3, 2019 Commission meeting. [Discussion and Possible Action Item]

MOTION: Commissioner Falzon moved to approve the November 19, 2019 and the December 3, 2019 minutes, Commissioner Perez seconded the motion.

       5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Discussion and Possible Action Item] 

  c) EC-190 – Aaron Burhz and Anthony LaVia of Big Hair, LLC, dba Beauty Bar, 2299 Mission St.,

            Place of Entertainment permit – amendment to permit conditions

 

Public comment – None

 

MOTION: Commissioner Falzon moved to approve moving item 5c to the beginning of the agenda, Commissioner Thomas seconded the motion.

 

ACTION:  Item 5c moved on the agenda.

Public comment – None

 

MOTION: Commissioner Thomas moved to approve and accept staff’s proposed recommendations to delete all of the existing permits conditions except for No. 1E and adopt the proposed conditions 1-9, Commissioner Falzon seconded the motion.

 

  1. At least one manager & a sound technician shall be onsite during all hours of live or DJ entertainment. 

Proposed Conditions:

  1. Monthly event calendar to be sent to SFPD Mission Station and Entertainment Commission at the beginning of each month.
  2. Occupancy shall not exceed 49 persons per SFFD.
  3. Permit holder shall have three security cameras installed on the exterior of the premises and two interior cameras installed on the interior of the premises. Permit holder shall retain footage for 30 days and access footage upon request from SFPD.
  4. All members of the security team must be LEAD trained and possess guard cards.
  5. Security shall perform pat downs and bag checks on patrons upon entry and reentry into the premises.
  6. Permit holder shall keep a log of patrons who have been removed from the premises, and not allow those patrons reentry into the premises indefinitely.
  7.  Permit holder shall utilize an ID scanner and metal detector wand upon venue entry for all patrons.
  8.  No third party promoters shall be permitted to host events at the premises.
  9.  Permit holder shall contact SFPD by calling 911 dispatch if an altercation occurs inside the premises or within a 100-foot radius in all directions of the premises of the business.

 

ACTION: Amended POE conditions for EC-190 dba Beauty Bar.

MISSION

Completely inebriated people shouting at the top of their lungs in front of this bar for half an hour. Security not is making them stop or quiet down. Absolutely fed up with the disregard and disrespect this place shows to the neighbors every night. ACTION: Deputy Director Azevedo continues to follow up with complainant and is actively working with SFPD Mission Station. Inspectors continue to visit this venue when they are in the field and observe their closing time procedures. Patrons exit at a normal volume and do not loiter. Security does a good job of clearing the sidewalk.

Resident is calling about a very loud concert that sounds to be coming from ATT Park. It is really unfair to do this to people during the week. This is supposed to go on until 11:30 at night. ACTION: Deputy Director Azevedo forwarded all complaints for this event to SF Giants Events Staff. This premises is permitted to have entertainment until 11 pm, but advertised the end time as 10:30. Giants staff acknowledged they went past their anticipated end time.

Carbon Lounge blasts music after 2am for HOURS. It's ridiculous. ACTION:  Director Weiland spoke with the complainant and determined that Carbon is not the source of the sound. It was unclear which business in the area was responsible, so Inspector Fiorentino followed up with the surrounding businesses. Carbon was closed at 2am. He spoke with a manager of the adult club, Twist, who said they've heard late night karaoke coming from New Thai Elephant restaurant. He followed up with the restaurant the following Monday during business hours. He also observed Goodfellas Pizza serving food after 2am without an EHP permit, and explained the permitting process. Deputy Director Azevedo has contacted the owners about the EHP permit.

Inspector Fiorentino went at the direction of Deputy Director to see if they were having entertainment without a permit. They were, so a citation was issued.

Inspector Fiorentino inspected an event and found liive entertainment, a live DJ, which was not permitted for this event. Deputy Director spoke with owner on 12/5/19 and informed him their LLP permit was denied by Planning, and we were also denying their OTIEP for an event on 12/6/19. Citation issued for entertainment without a permit.

 

4. Discussion and Possible Action to adopt written comments and/or recommendations to be submitted by the Executive Director of the Planning Department and/or Department of Building Inspection regarding noise issues for proposed residential and/or hotel/motel projects per Chapter 116 of the of the Administrative Code. [Discussion and Possible Action Item]

MOTION: Commissioner Falzon moved to approve the project with the Staff recommendations, Commissioner Perez seconded the motion.

5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Discussion and Possible Action Item]

Regular Agenda:

 

  1. EC-1556 – Juan Burgos and Ilda Cabrera of AEM&M Holdings Corporation, dba El Toro, 2470 San Bruno Ave., Place of Entertainment permit – change in ownership.

PUBLIC COMMENT: None

MOTION: Commissioner Thomas moved to approve with staff recommendations; the Good Neighbor Policy, using the existing internal sound limit, and the applicant must send a monthly calendar of events to SFPD Bayview station, Commissioner Lee seconded the motion.

ACTION: The Place of Entertainment-change in ownership permit for El Toro was approved and conditionally granted to the applicant.

MOTION: Commissioner Falzon moved to approve and accept the staff recommendations, making an edit to No. 6 and replacing the existing language with “ID verification device”, Commissioner Thomas seconded the motion.

ACTION: The Limited Live Performance for El Trebol Sports Bar #1 was approved with the revised staff recommendations, and conditionally granted to the applicant.
