CALL TO ORDER

Chair Bryant Tan called the meeting to order at 5:36PM.

Executive Director Jocelyn Kane called the Roll.

2. Approval of Meeting Minutes.  Discussion and possible action to approve the minutes of September 20, 2016 Commission meeting. [Action item]

(B) Staff and Office Update:  Update on critical dates in 2016;   (C) Corrective Actions: Nothing to Report (D) Report from the Sound Inspectors: Jordan Pauley and Sean Burke report on recent venue sound inspections and report of activities by staff. 9/23/2016 11:45 PM Mayes 1233 Polk St.: Talked to owner regarding foot traffic issues. Performed a walkthrough of Mayes premise.

SOUND TEST:
9/29/2016 6:15 PM The Great Northern 119 Erie St.: Performed a sound test in support of the venue’s POE permit.

COMPLAINTS:
9/27/2016 10:00 AM Club Malibu 3395 Mission St.: Issues surrounding ventilation holes cut into the venue’s exterior.

4. Police Department Comments & Questions.  This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety.  [Discussion Item]

Lt. Dave Falzon stated he and the Entertainment Commission had a meeting with the End UP.  He added they discussed the incident at the End Up which resulted in a homicide.  He added he was not satisfied with the owner’s response to the incident.

5. Limited Live Performance Permits in Union Street Neighborhood Commercial District Discussion and possible to action to (1) endorse a proposed ordinance (Board of Supervisors File No. 160962) that would allow the Director of the Entertainment Commission to extend from 10:00 p.m. until 11:00 p.m. the hours during which Live Performances may be presented at Limited Live Performance Locales in the Union Street Neighborhood Commercial District, and (2) authorize the Director to send a letter to the Clerk of the Board of Supervisors stating the Commission's endorsement of the proposed ordinance. (ACTION ITEM)

6. Residential Development Review Consent Calendar

All matters listed hereunder constitute a Consent Calendar, are considered to be routine by the Entertainment Commission, and may be acted upon by a single roll call vote of the Commission.  There will be no separate discussion of these items unless a member of the Commission, the public, or staff so requests, in which event the matter shall be removed from the Consent Calendar and considered as a separate item at this or a future hearing. The following action is to adopt written comments and/or recommendations to be submitted to the Planning Department and/or Department of Building Inspection regarding noise issues for proposed residential projects per Chapter 116 of the Administrative Code. [Action Item]

Consent Agenda:

a)  524 Howard St., Bl/Lot 3721/013  which is located within 300 feet of the Temple Nightclub, a permitted Place of Entertainment.

75 Arkansas, Bl/Lot 3953/001 which is located within 300 feet of The Parkside and Bottom of the Hill, permitted Places of Entertainment.
111 Turk Street, Bl/Lot 0343/001 which is located within 300 feet of The Warfield, the Golden Gate Theater, and Aunt Charlie’s Lounge, permitted Places of Entertainment.

7. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

Regular Agenda:

EC-1382 – Loan, Phung, Kien Thanh Coffee Shop, 431 Eddy Street, Limited Live Performance Permit.

Deputy Director Wieland stated the applicant withdrew their application.

EC-1384 – Wilde, Sarah and Pankow, Chris, Club Deluxe, 1509-1511 Haight Street, Place of Entertainment Permit, Change in Ownership.

Commissioner Joseph suggested fans for inside the venue.

Michael Nulty stated they should mitigate the issue after hearing the responses.

Getch Taylor supports the venue and permit application.

Walter Earl a musician supports the permit application.

Micheal Nulty asked for a continuance for two weeks due to the applicant not reaching out to the neighbors.

Mark Rennie supports the venue and stated it was a beautiful space and addition to the neighborhood.

Stephano Castalano supports the venue.

Commissioner Lee asked if Commercial property was part Residential Development Review.

Executive Director Jocelyn Kane stated commercial property was not part of the legislation.

Commissioner Perez commended Deputy Director Maggie Wieland on the Annual Report and Senior Analyst Dylan Rice for his presentation

Chair Bryant Tan suggested adding suggested a consent calendar.

Commissioner Frost commended Senior Analyst Dylan Rice on his presentation.
