CALL TO ORDER

Chair Tan called the meeting to order at 5:35PM.

2. Review and approve the minutes of August 18, 2015 [Action item]

Commissioner Moshoyannis moved to continue the minutes of August 18, 2015 Commissioner Frost second the motion.

8/28/15 8:30 AM Club 26 Mix 3024 Mission St. – Barricade obstructing sidewalk. Investigating.

SOUND TESTS
8/25/15 3:00 PM Amnesia 853 Valencia St.

SOUND INSPECTIONS
8/28/15 12:30 PM MAC Cosmetics Powell St. Cable Car Turnaround.
Were found testing speakers upon arrival (prior to approved start time of permit). Admonished producer. No complaints.

9/4-5/15 2-11 PM AT&T Park 24 Willie Mays Plaza – Audible in Dogpatch, Potrero Hill, and Bernal Heights neighborhoods. Soundcheck began 30 minutes prior to approved time on permit. Show lasted 10 minutes longer than approved time on permit. Decibel measurements taken from Potrero Hill, Dogpatch, and Bernal Heights. Meeting scheduled with Giants tomorrow. Still awaiting complaints from hotline and information from sound consultant hired by Giants.

9/11/15 6PM-1AM SF Opera Guild Grove btwn Franklin & Van Ness – In compliance. No complaints.
9/11-12/15 2-11 PM Chambers/Phoenix Hotel 601 Eddy St. – In compliance. No complaints.

Inspector Pauley - Notes for EC meeting 9/15/15
COMPLAINTS:
9/15/2015 1:00 PM King Kong Pool Hall 735 O’Farrell St.: A noise complaint was generated; investigation is pending.
9/15/2015 11:30 AM Café Royal 800 Post St.: Multiple noise complaints have been generated in regards to the venue. PD sent over a list of dates that these issues occurred. The investigation is pending.
8/30/2015 12:30 AM Tunnel Top 601 Bush St.: A complaint was generated in regards to noise emanating from the bar. PD made contact with the bar and sent a copy of their exchange. I both stopped by the bar and followed up with the complainant about the issue… No further complaints have been received.

COMPLIANCE:
9/11/2015 5:45 PM Family Billiards 2807 Geary Blvd.: Behind on their tax license bill.
9/4/2015 1:30 PM AT&T Park 24 Willie Mays Plaza: Sound check test performed during the setup for the Billy Joel event. There were issues with time management but compensatory measures taken.
9/1/2015 10:30 AM Dennys 495 Beach St.: Fight occurred involving female patrons. Venue behind on tax license bill.
8/21/2015 10:45 PM Tee Off 3129 Clement St.: Venue is having regular unpermitted live performance. The investigation is pending.

SOUND TESTS:
9/4/2015 7:15 PM Press Club 20 Yerba Buena Ln.: A sound test was performed and a recommendation issued in regards to the venues approved permit.
8/27/2015 2:30 PM Mochica 1469 18th St.: A sound test was performed and a recommendation issued in regards to the venues approved permit.
8/20/2015 12:30 PM Odd Job 1337 Mission St.: A sound test was performed and a recommendation issued in regards to the venues approved permit.

INSPECTIONS:
8/31/2015 12:15 AM Harlot SF 46 Minna St.: An inspection was performed. The venue is in compliance.
8/30/2015 11:30 PM The Abbey Tavern 4100 Geary St.: An inspection was performed The permit was posted. The venue is in compliance.
8/30/2015 11:00 PM Neck of The Woods 406 Clement St.: An inspection was performed during a Nepalese benefit concert. The venue is in compliance.

4. Police Department Comments & Questions. [Discussion Item]

5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

Consent Calendar

All matters listed hereunder constitute a Consent Calendar, are considered to be routine by the Entertainment Commission, and will be acted upon by a single roll call vote of the Commission. There will be no separate discussion of these items unless a member of the Commission, the public, or staff so requests, in which event the matter shall be removed from the Consent Calendar and considered as a separate item at this or a future hearing.

Regular Agenda:

The Pearl, located at 601 19th Street is a unique new space that will have both a restaurant and private events area including a rooftop terrace and urban farm. The venue will predominantly be used for weddings, non-profit functions, and corporate events. Dogpatch Neighborhood Association and the neighboring HOA both provided letters of support for the project. Bayview Station has no objection to the application for a Place of Entertainment, and recommends the Good Neighbor Policy, no extended hours premises permit, as well as sending a monthly calendar of events as conditions.

c) EC-1343 – Mendelson, Adam, The Pearl, 601 19th Street, Place of Entertainment Permit.

d) EC-1344 – Langer, Jordan, The Midway, 900 Marin Street, Place of Entertainment and Extended Hours Premises Permits.

e) EC-1345 – Ho, David, Sam Wo Restaurant & Bakery, 713 Clay Street, Extended Hours Premises Permit.

Commissioner Lee recused himself from item E).

Extended Hours Premises permit for Sam Wo Restaurant and Bakery located at 713 Clay Street. A staple of Chinatown, the first version of Sam Wo was built shortly after the 1906 earthquake and was located on Washington Street. After being closed for the past few years, Sam Wo is back at a new location and wants to be a late-night eatery once again. There are several letters of support in your file from the community as well as a letter from the Chinatown Community Development Center’s Executive Director, Norman Fong. Central Station approves the application for an Extended Hours Premises permit and recommends that the applicant hire security when the Extended Hours permit is being utilized, as well as installing and maintaining security cameras at the entrance of the restaurant and keeping footage for a minimum of 14 days.

Chris Curtis lives in the neighborhood and frequent the venue and supports permit application.

Commissioner Joseph moved to approve with SFPD police condition No. 2 and modifying condition 1 shall hire security on Friday Saturday nights Commissioner second the motion

Deputy Director Weiland moved items F, G, & H up on the agenda.

The last permit applications on our agenda are three loudspeaker permits for Swissnex all occurring in the next two weeks. These loudspeaker permits do not fit within our standard process because of the location of these events – they are set to be located in a parklet. The particular parklet for these permits is located at 730 Montgomery Street, directly fronting the Swissnex office. We currently do not have policy regarding issuing loudspeaker permits in parklets, and are seeking help and possible conditions from this Commission for a path forward in permitting events held in this type of public space. Some of the concerns from both the Planning Department and Entertainment Commission are a plan for maintaining a clear path of travel for pedestrians during the events, ensuring that no part of these events takes place in the street, or pushes pedestrians to make use of the street to get around the activity. We have also asked for a site plan for the proposed activities and a reason for why amplification is absolutely necessary.

g) ECLSP-4892, Bernard, Sylvian, Swissnex, 730 Montgomery Street, Friday, September 18, 2015, 7:00PM – 10:00PM, Loudspeaker Permit.

h) ECLSP-4923, Bernard, Sylvian, Swissnex, 730 Montgomery Street, Wednesday, September 23, 2015, 7:30PM –9:00PM, Loudspeaker Permit.

Robin Abod from the planning Commission spoke on the items for Swissnex and Pavement to Parks.

6. Report from the Residential Development Review Committee The Committee is a 3-member group that meets before the Regular Entertainment Commission meeting to review residential projects per Admin Code 116 and make recommendations. [Action item]

Chair Tan stated they meet earlier today from 3PM-5Pm it was the second meeting of the committee. He added they heard from two projects and they essentially provided a lot of information about sound attenuation and the process with their neighbors. He added the Commission’s recommendation was adequate notification of the property.

7. Commissioner Comments & Questions.

8. New Business Request for Future Agenda Items. [Action item] (This item is to allow Commissioners to introduce agenda items for future consideration).

Commissioner Joseph suggested to staff should set a committee to make some policies on park policies.

Director Kane stated the commission should come up with some possible guidelines as a commission so she can suggest to planning.
