4. Informational Presentation from the Office of Economic and Workforce Development regarding Board of Supervisors File No. 181211: Health, Planning, and Police Codes - Small Business Permit Streamlining. [Discussion Item]
 
Ben Van Houten Business Development Manager for Nightlife & Entertainment spoke on behalf of his agenda item.  He added the goal was to help small businesses successfully open their doors.  He added there has been increasing concern about storefront vacancies in recent years from a number of different stakeholders’ small business people in government as well.  He added in December, the Mayor announced a citywide storefront vacancies strategy, which has three different components, legislation, new program investments, and administrative reforms.  He added the new legislation was introduced by the Mayor and Supervisor Brown in December. He added his office conducted a retail study that was prepared by strategic economics, a consulting firm, and it was released in February 2018 on the state of retail, the opportunities and challenges facing neighborhood commercial districts in San Francisco. He added the key findings from the study were that retailers were experimenting with new strategies, they are looking at bringing food and beverage into the retail environment, doing entertainment and events, which is something that is in alignment with an uptake we have seen and limited live performances that they have seen.  He added the key findings were that land use and permitting challenges are big obstacles for business trying to get open or expand. He added the goals and this legislation or how can we help new businesses save time
and money in the permitting process to save money in the permitting process to get opened and a faster way so that they aren't burdened by so many months of rent before they can
open their doors.
 
Commissioner Lee asked would the Planning Department have an entertainment specialist who could help out and would it be on the table.
 
Ben Van Houten stated from his perspective it was a clear and consistence guidance and how can they further support city staff expertise development.

6. Report from the Senior Analyst: Dylan Rice shares an update about SF Outdoor Events Network initiative to strengthen the vitality of community and cultural events. [Discussion Item]
 
Senior Analyst Dylan Rice stated the dated the next SF Outdoor Events Network mixer will be held on January 28, 2019 and the topic is Cannabis and Special events.  He added it is a timely and he was excited to be collaborating with President Ben Bleiman on the program.  He added he would be moderating a panel discussion. He added the context for this is that with the state and governor passing legislation recently that allows local jurisdictions to decide if and where they would like to have temporary
cannabis events in their jurisdictions and what does that mean for San Francisco.   He added what is next for special events that want to add cannabis sales and consumption to their event, it is early, but what kinds of things should event producers and other kinds of industry people start thinking about in terms of the rules and to the best, and the models.   He added many folks are asking him about what are the opportunities for revenue, how does that work within the legal framework.  He added they have a powerhouse panel that will be moderated.   He added on the policy side, they have the director of the office of cannabis, Nicole Elliott, and they will have Supervisor Rafael.  He added there would also be ample time for audience questions.
 
Commissioner Caminong asked if there would be an intention to livestream the event. 
 
Senior Analyst Dylan Rice started the director brought it up today, and he thinks they should try again; they had some technical problems again with the last one, they learned that when you have ambient music in the background, Facebook algorithm recognizes it as a copyrighted song and limits the amount of time you can have that for a stream. 
 
Commissioner Tan asked for those who could not attend, if the commission could have some sort of highlights, presentation, and forthcoming for the entertainment commission meeting and report back.   He added I think if you have a quick power point of how this goes and the questions that are being discussed.

Deputy Director Kaitlyn Azevedo stated the applicants currently hold a limited live performance permit and recently received approval from the planning department to be zoned for a Place of Entertainment Permit. They have worked with Charles Salter to draft a noise abatement plan and install a high fidelity sound system. She added they would continue to have D.J.s have play and occasionally host dance events. Eight letters of support.  She added
Northern station approves this permit with no added conditions. 
 
Public comment
 
Cole with Blue Bear School of Music spoke in support of the permit application.  He added they are a local 501c3 nonprofit music school and have been around since 1971.  He added he was also a local D.J., and he and musicians have done some small events at Phonobar and Chuck and Tom characters were solid.    He added Phonobar has donated a tremendous amount just out of the goodness of their hearts, and he feels they are generally trying to do something that is good for the community and good for the music community.  He added he hoped the Commission approved their permit.

g) EC-1479 – Rappaport, Andrew of Minnesota Street Project, LLC, Minnesota Street Project, 1275 Minnesota St., Limited Live Performance Permit.
 
Deputy Director Kaitlyn Azevedo stated the next application is a limited live performance permit for Minnesota Street project, located at 1275 Minnesota Street in the dog patch. The applicants will use this permit to host public programs and private events, including lecture, presentations, performances, fundraiser, dinners and receptions with amplified sound. Additionally they will have live music, dances, and film screenings. Included in the file is one letter of opposition from the mill wheel south H.O.A. Board representing neighbors living across the street from the venue on Minnesota Street and the entertainment commission staff worked with the H.O.A. Board and Minnesota street project to mediate concerns and develop solutions to mitigate future problems. She added there were staff recommendations listed below for the proposed solutions that were agreed upon by the applicant and also sent over to the mill wheel H.O.A.  She added there were two letters of support along with neighborhood outreach and the applicants conducted such as flyers they distributed, and a community gathering they hosted at the premises. In follow up to the mediation, she received a second email from the H.O.A. to the applicant stating that the discussion after their community gathering was very positive and they appreciate the efforts to make their co-existence as neighbors directionally better. Bayview Station approved this permit with the condition of emailing the event calendar to the permit officer monthly.
Andrew Rappaport stated he was the program and engagement co-founder with his wife Deborah who could not be present.  He added they started back in 2014 to try 
to stem the outflow of visual arts from San Francisco live music venues have been challenged by real estate prices and someone needed to do something, and they nominated themselves.

Bruce Healy stated he was head of the neighborhood association and a member of the block association. He added they have had a great discourse with the Minnesota Street Project over the four years they have been here.   He added he also submitted a letter of support.  He added they have had a discourse not only within the block, but also with the neighborhood. He added the engagement has encouraged all of them to think a little bit more thoughtfully about their neighbors.  He added he and the neighborhood as a whole was in support of the permit.

h) EC-1476 – Deckker, Chris and Meyer, Bertram of OneDome Global Inc., OneDome, 1025 Market St., Place of Entertainment Permit.
 
Deputy Director Kaitlyn Azevedo stated the final permit application on the agenda is a Place of Entertainment permit at 1025 Market Street 
She added the premises is an immersive arts and retail space with an experiential gallery for patrons to explore. They plan to host private functions and music events with live D.J.S, there is no alcohol served or allowed at the premises. She added there were ten letters of support from neighboring businesses. Tenderloin Station approves the permit with no added conditions.
 
Chris Deckker stated they are an immersive arts and technology experiential retail venue.  He added it is a new classification and they are located between six and seven on Market Street. 
He added entertainment was not their primary business. He added they are sort of a gallery experience if you like, using the latest technology and they have an augmented reality immersive experience.  He added downstairs they have a digital labyrinth immersive experience featuring different artists from around the world.   He added the venue is super family-friendly and they opened in October of last year and have gotten rave reviews and families, kids, and all sorts of demographics in different cultures.  He added they made a choice not to go alcoholic. He added they have an incredible elixir bar from Nevada city so it feels like you're having a cocktail but it is all herbal.    He added they are not against alcohol, but as a venue, they want to be a new paradigm and it was more of a wellness concept.
 
Commissioner Tan asked how some of his events have gone.  He added he has heard great things about his location.

9. Discussion and possible approval, denial, or other action as necessary, relating to Ms. Milano’s request for a partial stay, until March 19, 2019, of the Entertainment Commission’s December 18, 2018 decision imposing additional conditions on the #EC-1377 Place of Entertainment and Extended Hours Premises permits for dba Halcyon located at 314 11th Street, San Francisco, CA 94103.  Ms. Milano has requested a partial stay of the following conditions:
1.) Permit holder shall keep a nightly record of the decibel level inside the permitted establishment from start to finish of all hosted entertainment. A report from the decibel meter logs shall be made available to the Entertainment Commission. 2.) Permit holder shall hire a sound consultant to conduct a sound study over a two-night period from 10pm-6am when Halcyon is operating past 4am to gather sound data around ambient levels during the POE and EHP time periods. Entertainment Commission staff shall be on site during the study. Sound consultant shall conduct new sound tests in concert with Entertainment Commission staff for new POE and EHP sound limits based on this study of ambient. 3) Permit holder shall use a sound limiter at all times while operating sound equipment to ensure compliance with approved sound limits.

Director Maggie Weiland stated the three conditions were a lot in maintaining sound. 
 
Commissioner Lee stated the sound limiter was a big deal.  He added the honor system has been let go and to really solve this issue the sound meter was the best way.  
 
Commissioner Caminong stated she would approve the month extension but wants to see documentation of proof as to when and what they are having done. 
 
Commissioner Falzon stated he was comfortable with the continuance of the three stipulations to the March date.   
 
Commissioner Tan stated he would like to have seen a representative come and speak on her behalf. He added he was ok to agree upon a stay.

Commissioner Falzon moved to have a partial stay granted, adding that the permit holder must send Entertainment Commission Executive Director the dates of when and what they have done to prove they are moving forward.  Commissioner Caminong second the motion.

At the January 15, 2019 meeting, the Commission voted to approve Ms. Milano’s request for a partial stay until March 19, 2019 for conditions #1-3 listed above.   They voted this approval with one stipulation: the Commission is requiring that Ms. Milano provide proof of progress to Commission staff of the above conditions, including vendors hired, and dates scheduled for any sound testing, etc.

Commissioner Tan inquired about the status of Mezzanine.  
Deputy Director Maggie Weiland stated there was nothing we can say publicly right now but President Bleiman and she have been working very closely with Ben and Deborah, the owner, as well as supervisor Haney’s office on this. We are hoping for some positive news.
 
Chair Bleiman stated, “I have been in this business now ten years, ten years as an owner on the last time a positive piece of legislation came out of city hall that actually helps nightlife was, the last one I remember was when supervisor breed was a supervisor, chapter 116. The presentation that the beard showed us today is actually incredible from a nightlife standpoint. I encourage everyone to familiarize themselves with it, and know the nightlife communities very much behind it.”
 
 
Executive Director Maggie Weiland stated this is commissioner Caminong’s idea, her thought child.  She added we are beginning to implement a new program, and we went through so many names.  Eleven Districts of Entertainment.  She added for each month in the calendar year in 2019, January being month one, we would work with the corresponding supervisorial district. Starting with supervisor Fewer in January, and going out with the supervisor in her district to permitted venues.  She added it is to be able to build relationships with those supervisors and to be able to trade ideas and issues around entertainment specific to their district. 
 
Chair Bleiman stated the commission has been regulating nightlife, but it is also supposed to be promoting it. He added this is the first concrete other than the summits and the holiday party, concrete efforts that we have made.  He added it seems like a very easy and productive endeavor.
 
Executive Director Maggie Weiland stated in month 12 we are hoping to do a tour with Mayor Breed, and have a combination at the holiday party.
