CALL TO ORDER

Chair Tan called the meeting to order at 5:32PM.

Present at the meeting were Commissioners, Bryant Tan, Al Perez, Steven Lee, Audrey Joseph, Demetri Moshoyannis, Dori Caminong and Liam Frost.

1. Public Comment

Members of the public may address the Commission on items of interest to the public that are within the subject matter jurisdiction of the Commission with respect to agenda items, members of the public may address the Commission for up to three minutes at the time such item is called.

2. Review and approve the minutes of May 19, 2015. [Action item]

3. Discussion and possible action to approve the review process for implementation of legislation encouraging compatibility between Entertainment Venues and new Residential Development [File #141298] [Action Item]

Commissioner Joseph moved to continue the item to the next Commission meeting Commissioner Frost second the motion.

Report from Executive Director Legislative/Policy Update; Update on LLP expansion legislation Staff and Office Update: Entertainment Commission Summit IIV, June 8, 2015; Commissioner training on planning process June 16, 2015; Update on sound concerns at AT&T Park; Update on staffing changes; Corrective Actions: Nothing to Report. Report from Sound Inspector’s Sean Burke and Jordan Pauley report on recent venue sound inspections and report of activities by staff. [Discussion Item]

INSPECTIONS:
Inspector Pauley - Notes for EC meeting 6/2/15
5/31/2015 11:50 PM Grant & Green 1371 Grant Ave.: An outdoor inspection was performed to assess practices of security… A follow up action in response to a gun possession involving the bar earlier this year.

COMPLAINT:
5/29/2015 11:50 PM Vessel 85 Campton Pl.: An outdoor inspection was performed to assess crowd noise. The crowd noise was not excessive, nor was the accumulation of patrons. Activity looks to be normal. Venue was found in compliance.

COMPLIANCE:
5/30/2015 11:30 PM The Basement 222 Hyde St.: I was cc’d on an email from Sam at Faithful Fools. The Basement had it’s hard opening last Saturday night and levels apparently ran a bit loud. Though the complainant and venue were able to resolve the issue amongst themselves, I stopped by to talk to Larry Livingston and staff about possible remedies. Will follow up.

5/29/2015 11:00PM Fort 1 SF 2801 Leavenworth St.: Performed a summary inspection of Fort 1 to assess activity level. The venue was open but patron traffic was extremely light.

Ended at midnight, as per one night event permit. Clean exit. Professional security team.
5/24/15 4:00 PM Chambers 601 Eddy
1st of multiple outdoor events. Inaudible from 250’ as per city code. No complaints received.
COMPLAINTS
5/22/15 Dolores Park Cafe 501 Dolores
Via inspector mobile phone. Issue resolved between neighbor and operator.
5/22/15 Homestead 2301 Folsom
Complainant, operator, and landlord are attempting to resolve.
5/23/15 West Bay Conference Center 1290 Fillmore
Via mobile phone. On vacation and unable to respond.
5/30/15 West Bay Conference Center 1290 Fillmore Via mobile phone. Unable to respond prior to event end.

5. Police Department Comments & Questions. [Discussion Item] (This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety).

6. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

a) EC-1334 - Tim Ryan dba The Willows, 1582 Folsom Billiard Table permit.

Lt. Dave Falzon stated he had no objections to the permit license.

Scott supports the applicants program and feels it will serve the arts.

Commissioner Joseph moved to continue the item at the request permit applicant for the June 16, 2015 hearing Commissioner Moshoyannis second the motion

c) EC-1327 - Barry Synoground dba Code Word, 917 Folsom St. Place of Entertainment/ Extended Hours Premises.

Barry Synoground stated he was asked to continue the item to the next Commission meeting.

Officer Dave Falzon stated unfortunately the police didn’t received the documents until today, however there was a paper trail back in May and got lost in the shuffle.

d) EC-1313 - Josette Melchor dba Gray Area, 2665 Mission St. Place of Entertainment permit.
Josette Melchor stated they have installed new soundproofing and has done public outreach.

Public comment

Marty Grossman lives behind the Gray Area Theatre feels the building was totally inadequate for sound. He added they need a wall inside the wall to stop the base.

Scott Piper stated he was an art representative and supports the venue and feels they were responsive and responsible operators and were reactivating the theater. He hoped the applicant could work with the neighbors.

The production manager who works at the venue stated he spoke with the resident and did sound test and was shocked by the comments that it was not done.

Barry Drew a sound tech that works with the venue explained the sound implantation for the venue.

Commissioner Joseph stated the applicant had tried very hard to resolve the issues and would put conditions on their sound.

Commissioner Joseph moved to approve with base frequency taking out below 50 megahurst and base taken out and the speakers be placed on some type of cushion and isolate it from the floor operate during the week until midnight and on the weekend until 1:00 A.M. Friday, Saturday and holiday night Commissioner Caminong second the motion
